租賃協(xié)議英文NTRACT房屋租賃合同The parties of this agreement are: 本合同雙方當事人:The Leaser (Party A): 出租方(甲方):The leasee (Party B): 承租方(乙方):According to The Contract Law of P.R.C and The Regulation On Premise Leasing of Beijing (hereinafter referred as to the Regulation), Party A and Party B, of their own volition, upon friendly negotiation, hereby agree to sign this contract for the deal that Party A lets the premises which is legally owned by Party A to Party B and Party B lease from Party A the said premises.根據(jù)中華人民共和國合同法、北京市房屋租賃條例(以下簡稱:條例)的規(guī)定,甲、乙雙方在平等、自愿、公平和誠實信用的基礎(chǔ)上,經(jīng)協(xié)商一致,就乙方承租甲方可依法出租的房屋事宜,訂立本合同。Article 1 General Condition of the premises to be let 出租或預(yù)租房屋情況1-1 Party A will let the premises located at (hereinafter referred as to the Premises)in Beijing to Party B. The gross area of the Premises is equal to square meters. The purpose of the Premises is for residence. Anne* I is the plane figure of the Premises. Party A has shown the plane figure and the Title-deed of the Premises (Number : ) to Party B.甲方出租給乙方的房屋座落在本市 (部位) 。(以下簡稱該房屋)。該房屋出租建筑面積為 平方米,房屋用途為 居住 。該房屋的平面圖見本合同附件(一)。甲方已向乙方出示該平面圖及該房屋產(chǎn)權(quán)證(產(chǎn)證編號: ):1-2 As the owner of the Premises, Party A establishes the lease relation with Party B. Prior to signing this contract, Party A (has or has not ) informed Party B of the mortgage on the Premises.甲方作為該房屋的 (房地產(chǎn)權(quán)利人/代管人/法律規(guī)定的其他權(quán)利人)與乙方建立租賃關(guān)系。簽訂本合同前,甲方 已告知乙方該房屋 (已/未)設(shè)定抵押。1-3 Range, Condition and Requirement of /for the part in common use of the Premises and the conditions of thee*isting decoration and facilities are illustrated in the Anne* II and III herein. Unless otherwise specified, the Anne* will be regarded as an inspection list to be checked and followed when Party A hands over the Premises to Party B or Party B returns the Premises to Party A when the lease term is due.該房屋的公用或合用部位的使用范圍、條件和要求及現(xiàn)有裝修、附屬設(shè)施、設(shè)備狀況有關(guān)事宜,由甲、乙雙方分別在本合同附件(二)、(三)中加以列明。甲、乙雙方同意該附件作為甲方向乙方交付該房屋和本合同終止時乙方向甲方返還該房屋的驗收依據(jù)。Article 2 Occupation Purpose租賃用途2-1 Party B guaranteed that the Premises will only be occupied for purpose, and hewill be abiden by the regulations on house using and managing in Beijing.乙方向甲方承諾,租賃該房屋作為_使用,并遵守國家和本市有關(guān)房屋使用和物業(yè)管理的規(guī)定.2-2 During the lease term, Party B shall not alter the use of the Premises unless Party B has obtained the written approval from Party A and completed the relevant registration forms at corresponding government offices.乙方保證,在租賃期內(nèi)未征得甲方書面同意以及按規(guī)定須經(jīng)有關(guān)部門審批核準前,不擅自改變上款約定的使用用途。Article 3 Deliveries Date and Lease Terms 交付日期和租賃期限3-1 Party A shall deliver the Premises to Party B on Date Month Year . The lease term of thePremises is months that commence on Date Month Year and will e*pire on Date Month Year .甲乙雙方約定,甲方于_年_月_日前向乙方交付該房屋。房屋租賃期自_年_月 _日起至_年_月_日止。3-2 Upon the e*piration of the lease, Party A is entitled to withdraw the rented premises, and Party B will vacate it in time. In the event Party B would like to e*tend the lease, he shall consult with Party A on relevant issue with a must of months prior notice to Party A.租賃期滿,甲方有權(quán)收回該房屋,乙方應(yīng)如期返還。乙方需要繼續(xù)承租該房屋的,則應(yīng)于租賃期屆滿前 個月,向甲方提出續(xù)租書面要求,經(jīng)甲方同意后重新簽訂租賃合同。Article 4 Rent and Terms of Payment 租金、支付方式和期限4-1 The monthly rent is RMB (or USD) of gross area.This rent shall be fi*ed for year (s)/month(s) and from the year/month, it may adjusted by both parties herein through negotiation, which is stipulated in the Supplementary Provisions.甲、乙雙方約定,該房屋每月租金為( 幣)_元。(大寫:_萬_仟_佰_拾_元_角整。該房屋租金 年/月)內(nèi)不變。自第 (年/月)起,雙方可協(xié)商對租金進行調(diào)整。有關(guān)調(diào)整事宜由甲、乙雙方在補充條款中約定。4-2 Party B shall pay the monthly rent by the date of that month. If overdue, Party B shall be charged % of the monthly rent as a penalty to Party A.乙方應(yīng)于每月 日前向甲方支付租金。逾期支付的,則乙方需按月租金的 支付違約金。4-3 The rent shall be paid in following manners:乙方支付租金的方式如下: 。Article 5 Deposit and Miscellaneous Charges保證金和其他費用5-1 It is agreed that Party B shall pay RMB (USD) , which is equal to the rent for month(s),as a deposit to Party A before the date of . Party A shall make out a receipt in written after receiving the foresaid amount.Upon the e*piration of this lease, after deducting the fees, which shall be undertaken by Party B, from the deposit, Party A shall return the rest to Party B without any interests.甲、乙雙方約定,甲方交付該房屋時,乙方應(yīng)向甲方支付房屋租賃保證金,保證金為 個月的租金,即( 幣) 元。甲方收取保證金后應(yīng)向乙方開具收款憑證。租賃關(guān)系終止時,甲方收取的房屋租賃保證金除用以抵充合同約定由乙方承擔的費用外,剩余部分無息歸還乙方。5-2 During the period of the lease, all charges for use of water, electricity, gas, telecommunication, equipments,property management and shall be paid by Party . Party shall pay other charges e*cept the above-mentioned charges.租賃期間,使用該房屋所發(fā)生的水、電、煤氣、通訊、設(shè)備等費用由 (甲方/乙方)承擔。其他有關(guān)費用,均由 (甲方/乙方)承擔。5-3 The charges undertaken by Party shall be paid in following manners:(甲方/乙方)承擔的上述費用,計算或分攤辦法、支付方式和時間: 。Article 6 Requirement for Use the Premise and Maintenance of the Premise房屋使用要求和維修責任6-1 In the event of any damage or fault of the rented premises, Party B shall inform Party A of it in time. The maintenance, shall be carried by Party A within days after receiving the promptly notice from Party B on such damage or fault.租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞或故障時,應(yīng)及時通知甲方修復(fù);甲方應(yīng)在接到乙方通知后的 日內(nèi)進行維修。6-2 During the lease, Party B shall properly occupy the Premises and take good care of the facilities. Anyconsequences due to Party Bs improper operation or neglect shall be undertaken by Party B. If Party B refuses to do it, Party A may do the maintains for it. The e*penses arising from such maintains shall be paid by Party B.租賃期間,乙方應(yīng)合理使用并愛護該房屋及其附屬設(shè)施。因乙方使用不當或不合理使用,致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負責維修。乙方拒不維修,甲方可代為維修,費用由乙方承擔。6-3 During the lease, Party A shall guarantee the safety in use of the Premises. In the event Party A intends toinspect and maintain the Premises, he shall notify Party B days ahead of time. Party B shall cooperate and assist as best as possible while Party A is maintaining the Premises. Meanwhile, Party A shall reduce the effect on using the Premises of Party B.租賃期間,甲方保證該房屋及其附屬設(shè)施處于正常的可使用和安全的狀態(tài)。甲方對該房屋進行檢查、養(yǎng)護,應(yīng)提前 日通知乙方。檢查養(yǎng)護時,乙方應(yīng)予以配合。甲方應(yīng)減少對乙方使用該房屋的影響。6-4 E*cept for the stipulation in Anne* III, If Party B intends to redecorate the Premises or replaces the e*istingfacilities; a written approval shall be obtained in advance from Party A. If required by applicable bylaw or regulations, Party A shall (or: Party A shall entrust Party B to) also complete certain registration procedure at relevant government offices before the construction starts.除本合同附件(三)外,乙方另需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī)定向有關(guān)部門審批的,則還由 (甲方/甲方委托乙方)報有關(guān)部門批準后,方可進行。乙方增設(shè)的附屬設(shè)施和設(shè)備及其維修責任于甲、乙雙方另行書面約定。Article 7 Condition When the Premise Returned房屋返還時的狀態(tài)7-1 E*cept Party A approve the application for e*tending the lease from Party B, Party B shall return thePremises within days after the e*piration of this lease. Any delay of the delivery of the Premises made by Party B shall be charged RMB (USD) per day as a House Occupation Fee to Party A.除甲方同意乙方續(xù)租外,乙方應(yīng)在本合同的租期屆滿后的 _ 日內(nèi)返還該房屋,未經(jīng)甲方同意逾期返還房屋的,每逾期一日,乙方應(yīng)按 元/(人民/美金 幣)向甲方支付該房屋占用期間的使用費。7-2 The condition of the Premises when Party B returns it to Party A shall accord with the one that is after normal using. The return of the Premises shall be e*amined and confirmed by Party A. Meanwhile, both parties shall square up the charges with each other.乙方返還該房屋應(yīng)當符合正常使用后的狀態(tài)。返還時,應(yīng)經(jīng)甲方驗收認可,并相互結(jié)清各自應(yīng)當承擔的費用。Article 8 Sublet, Lease Transfer, and E*change轉(zhuǎn)租、轉(zhuǎn)讓和交換8-1 Unless otherwise stated in Supplementary Provisions, Party B may only transfer part or all of the Premises toa third party during the lease upon the written approval of Party A. However, Party B shall not sublet part of the room of the Premises to a third party or sublet the room to two or more than two lessees at the same time for residential purpose.除甲方已在本合同補充條款中同意乙方轉(zhuǎn)租外,乙方在租賃期內(nèi),需事先征得甲方的書面同意,方可將該房屋部分或全部轉(zhuǎn)租給他人。但同一間居住房屋,不得分割轉(zhuǎn)租。8-2 In case that Party B sublets the Premises,ntract shall be concluded with the sub-lessee and beregistered in the Real Estate Transanction Center of the district where the Premises is located.乙方轉(zhuǎn)租該房屋,應(yīng)按規(guī)定與受租方訂立書面的轉(zhuǎn)租合同。并按規(guī)定向該房屋所在區(qū)、縣房地產(chǎn)交易中心或農(nóng)場系統(tǒng)受理處辦理登記備案。8-3 During the lease term, Party B may, thrntract on subject alteration, transfer this lease to a thirdparty or e*change the Premises with a third party who is the lessee of another premises upon the written approval of Party A.在租賃期內(nèi),乙方將該房屋轉(zhuǎn)讓給他人承租或與他人承租的房屋進行交換,必須事先征得甲方書面同意。轉(zhuǎn)讓或交換后,該房屋承租權(quán)的受讓人或交換人應(yīng)與甲方簽訂租賃主體變更合同并繼續(xù)履行本合同。8-4 During the lease term, where Party A intends to offer for sale the Premises, he shall inform Party B of it witha prior notice of three months, and Party B has a priority right to purchase the Premises on equal terms.在租賃期內(nèi),甲方如需出售該房屋,應(yīng)提前三個月通知乙方。乙方在同等條件下有優(yōu)先購買權(quán)。Article 9 Dissolution 合同的解除9-1 During the lease, this contract may be terminated under the following condition, and both parties shall bee*cused from liability: 1) Force Majeure;2) The Premises is damaged, lost and appraised to be the dangerous house; 3) The Premises on which Party A created a mortgage is being handled甲、乙雙方同意在租賃期內(nèi),有下列情形之一的,本合同終止,雙方互不承擔責任:(一) 因不可抗力致使合同無法履行的;(二) 該房屋毀損、滅失或者被鑒定為危險房屋的;(三) 甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的。9-2 Under the following conditions, one party shall notify the other party to dissolve this contract in writing form.The breaching party shall pay a penalty at _ of the monthly rent herein to the other party. If the penalty is insufficient to cover the loss suffered by Party B, Party A shall pay the difference:(1) Party A delays the delivery of the Premises, and after being called on to performs the obligation, fails todo so within days by Party B;(2) The objectives of this contract cannot be realized due to the condition of the Premisesdelivered by Party A does not accord with the stipulation f this contract.(3) The Premises is damaged because Party B alters the use of the Premises without any written approvalfrom Party A;(4) The main body structure of the Premises is damaged due to Party B;(5) Party B sublet the Premise, transfer this lease and e*change the premises leased each without anyapproval from Party A;(6) Party B delays the rent payment for more than months;甲、乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違反合同的一方,應(yīng)向另一方按月租金的 倍支付違約金;給雙方造成損失的,支付的違約金不足抵付一方損失的,還應(yīng)賠償造成的損失與違約金的差額部分:(一)甲方未按時交付該房屋,經(jīng)乙方催告后 日內(nèi)仍未交付的;(二)甲方交付的該房屋不符合本合同的約定,致使不能實現(xiàn)租賃目的的;或甲方交付的房屋存在缺陷、危及乙方安全的。(三)乙方未征得甲方同意改變房屋用途,致使房屋損壞的; (四)因乙方原因造成房屋主體結(jié)構(gòu)損壞的;(五)乙方擅自轉(zhuǎn)租該房屋、轉(zhuǎn)讓該房屋承租權(quán)或與他人交換各自承租的房屋的;(六)乙方逾期不支付租金累計超過 月的;Article 10 The Responsibility of Party A and Party B for Breaching the Contract 違約責任10-1 Where the defects e*it while Party A is delivering the Premises, Party A shall repair it within daysafter the delivery. If Party A fails to do it, the rent shall be reduced and the article about the rent shall be changed.該房屋交付時存在缺陷的,甲方應(yīng)自交付之日起的 日內(nèi)進行修復(fù)、逾期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10-2 Party A shall compensate the damage of Party B resulting from the situation that Party A does not informParty B of the mortgage or any limitation on the Premises or its ownership before this lease.因甲方未在該合同中告知乙方,該房屋出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限制,造成乙方損失的,甲方應(yīng)負責賠償。10-3 During the lease, if the Premises is damaged and Party B suffers a property loss or physical injury due toParty As failure to carry out the repair and maintenance in time as stipulated herein, Party A shall be liable for such compensation.租賃期間,甲方不及時履行本合同約定的維修、養(yǎng)護責任,致使房屋損壞,造成乙方財產(chǎn)損失或人身傷害的,甲方應(yīng)承擔賠償責任。10-4 During the lease, in case Party A dissolve this contract without authorization and take back the Premises,Party A shall pay a penalty equal to times of the rent for the days which Party A take back thePremises ahead of time. If the penalty is insufficient to cover the loss suffered by Party B, Party A shall pay the difference.租賃期間,非本合同規(guī)定的情況甲方擅自解除本合同,提前收回該房屋的,甲方應(yīng)按提前收回天數(shù)的租金的 倍向乙方支付違約金。若支付的違約金不足抵付乙方損失的,甲方還應(yīng)負責賠償。10-5 If Party B decorates the Premises or replaces the facilities without the written approval or beyond the writtenapproval of Party A, Party B shall (recover the Premises of the original state or be liable for the compensation).乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設(shè)附屬設(shè)施的,甲方可以要求乙方 (恢復(fù)房屋原狀/賠償損失)。10-6 During the lease, where Party B quit the lease without authorization, Party B shall pay a penalty equal to_ times of the rent for the days which Party B quit the lease ahead of time. If the penalty is insufficient to cover the loss suffered by Party A, Party B shall pay the difference. Such penalty may be deducted from the deposit by Party A. If the deposit is insufficient to deduct, Party B shall pay it in addition.租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應(yīng)按提前退租天數(shù)的租金的 倍向甲方支付違約金。若違約金不足抵付甲方損失的,乙方還應(yīng)負責賠償。甲方可從租賃保證金中抵扣。保證金不足抵扣的,不足部分則由乙方另行支付。Article 11Miscellaneous 其他規(guī)定11-1 During the lease, in the event Party A would like to raise a mortgage on the Premises, Party A shall informParty B of such mortgage and guarantee that Party A shall consult with Party B on purchase of the Premises within days before the parties of the mortgage agree to sell off the Premises.租賃期間,甲方需抵押該房屋,應(yīng)當書面告知乙方,并向乙方承諾在抵押權(quán)利義務(wù)當事人各方處分該房屋前 日書面征詢乙方購買該房屋的意見。11-2 This agreement shall be taken legal effective on this e*ecution date. Within 15 days after this agreement,Party A shall apply for registration to Beijing Municipal/District (County) Real Estate Transaction Administration Office on behalf of both parties according to the municipal regulations. 本合同自雙方簽字后生效。生效后的15日內(nèi),由甲方負責按規(guī)定向房屋所在地區(qū)、縣房地產(chǎn)交易中心受理處辦理登記備案,領(lǐng)取房屋租賃登記備案證明。11-3 For the items not mentioned in the contract, Party A & B may fi* supplementary clause. The supplementaryclause and attached appendi* form integral parts of this contract. The handwriting or computed words in the blank spaces of this contract/supplementary clause and attached appendi* will be equally enforceable.本合同未盡事宜,經(jīng)甲、乙雙方協(xié)商一致,可訂立補充條款。本合同補充條款及附件均為本合同不可分割的一部分,本合同及其補充條款和附件內(nèi)空格部分填寫的文字與鉛印文字具有同等效力。11-4 When signing this contract. Party A and Party B are in clear senses and fully aware of the rights, duties, andliabilities they should take and are willing to comply with the contract. If one party violates the contract, the other party shall have the power to claim compensation according to this contract.甲、乙雙方在簽署本合同時,對各自的權(quán)利、義務(wù)、責任清楚明白,并愿按合同規(guī)定嚴格執(zhí)行。如一方違反本合同,另一方有權(quán)按本合同規(guī)定索賠。11-5 Any disputes arising when practicing the contract shall be settled through friendly negotiation.
