___________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________多方為主導(dǎo)時的,附件條款及說明一、當甲方為主導(dǎo)時,增加的多項條款及說明:1.1甲方優(yōu)先購買權(quán)說明:在本合同約定的房屋交易中,甲方享有在同等條件下優(yōu)先購買的權(quán)利。如乙方在合同約定的期限內(nèi)與第三方達成購房意向,甲方應(yīng)在收到通知之日起____個工作日內(nèi)作出是否行使優(yōu)先購買權(quán)的決定。若甲方放棄或未在規(guī)定時間內(nèi)行使優(yōu)先購買權(quán),視為甲方放棄該權(quán)利。1.2甲方支付定金說明:在合同簽訂之日起____個工作日內(nèi),甲方應(yīng)向乙方支付人民幣____元作為定金。若甲方在合同約定的時間內(nèi)未支付定金,乙方有權(quán)解除合同,并要求甲方承擔違約責任。1.3甲方責任承擔說明:甲方保證所提供房屋信息真實、準確,如因甲方提供虛假信息導(dǎo)致合同無法履行,甲方應(yīng)承擔全部責任,包括但不限于賠償乙方損失。1.4甲方提供貸款說明:甲方承諾在合同簽訂后____個工作日內(nèi),為乙方提供按揭貸款所需的相關(guān)資料和擔保。若甲方未能按期提供,乙方有權(quán)解除合同,并要求甲方承擔違約責任。二、當乙方為主導(dǎo)時,增加的多項條款及說明:2.1乙方優(yōu)先選擇權(quán)說明:在本合同約定的房屋交易中,乙方享有在同等條件下優(yōu)先選擇購房的權(quán)利。若甲方在合同約定的期限內(nèi)與第三方達成購房意向,乙方應(yīng)在收到通知之日起____個工作日內(nèi)作出是否行使優(yōu)先選擇權(quán)的決定。若乙方放棄或未在規(guī)定時間內(nèi)行使優(yōu)先選擇權(quán),視為乙方放棄該權(quán)利。2.2乙方支付尾款期限說明:乙方應(yīng)在合同約定的房屋交付前____個工作日內(nèi)支付房屋尾款。若乙方未按期支付,甲方有權(quán)解除合同,并要求乙方承擔違約責任。2.3乙方責任承擔說明:乙方保證所提供個人信息真實、準確,如因乙方提供虛假信息導(dǎo)致合同無法履行,乙方應(yīng)承擔全部責任,包括但不限于賠償甲方損失。2.4乙方配合過戶說明:乙方應(yīng)積極配合甲方辦理房屋產(chǎn)權(quán)過戶手續(xù),并在甲方要求的時間內(nèi)提供必要的文件和證明。若乙方未按期配合,甲方有權(quán)解除合同,并要求乙方承擔違約責任。三、當有第三方中介時,增加的多項條款及說明:3.1中介費用承擔說明:中介服務(wù)費用由____方承擔,具體金額為人民幣____元。若合同解除,中介費用由違約方承擔。3.2中介責任界定說明:中介方應(yīng)在本合同簽訂后____個工作日內(nèi),協(xié)助雙方完成房屋產(chǎn)權(quán)過戶手續(xù)。若中介方未能按期完成,乙方有權(quán)解除合同,并要求中介方承擔違約責任。3.3中介保密義務(wù)說明:中介方對本合同內(nèi)容及雙方信息負有保密義務(wù),未經(jīng)合同雙方同意,不得向任何第三方泄露。3.4中介傭金支付說明:中介方在本合同簽訂后____個工作日內(nèi),向甲方支付傭金。若合同解除,中介方已收取的傭金不予退還。3.5中介糾紛處理說明:若中介方與合同雙方之間發(fā)生糾紛,應(yīng)通過協(xié)商解決。若協(xié)商不成,可向有管轄權(quán)的人民法院提起訴訟。附件及其他補充說明一、附件列表:1.房屋產(chǎn)權(quán)證復(fù)印件2.交易合同備案表3.房屋買賣合同4.付款憑證5.房屋驗收報告6.產(chǎn)權(quán)過戶相關(guān)文件7.交易稅費繳納憑證8.中介服務(wù)合同(如有)9.爭議解決相關(guān)文件10.其他雙方約定的文件二、違約行為及認定:1.違約行為:甲方未按約定時間支付首付款或尾款。認定:甲方在合同約定的時間內(nèi)未支付首付款或尾款
