艙面險條款(On Deck Clause)-華泰財險

華泰財產保險有限公司貨運險附加險條款茲經雙方理解并同意，艙面裝載的被保險貨物以與艙下裝載的貨物相同的承保thoseloadedunderdeck.Furtheragreedthatlossofordamagetoon-deckgoodswithoutanycoverduetorustareexclTheAssuredistodeclareallactualshipmentsorupontheexpiryandUnderwritershereonwilldebitthepremiumaccordingly.insuredarisingoutofloadingandunloading,hoisting,liftingoperations.4、退回或拒收貨物運輸條款Refused/RSubjecttotheoriginalinsuringconorwhichremainattheriskoftheAssuredbeyondthenormalcourseoftransituntildisposedofbytheAssuredbyreturntotheportofshipmentorotherwise.Thisinsurancemayalsobeextenmanufacturersand/orrepairersduetoaprespectissubjecttoprioradviceandrates,termsandconditionstobeThisInsuranceattachesfromthetimethegoodscommencementofthetransitandcontinuesinforceintheordinarycourseoftransitincludiplaceofstorageatthedestination.ItisunderstoodandagreedthatthisPolicyextendstocovertecourseoftransitupto90days.(longerperiodneedspriornotification).ThisClauseissubjectotherwisetothetermsandconditionsofthisPolicy.（一）一旦材料和設備運抵合約地點，被保險人應檢查材料和設備在運輸途中可能發(fā)生的損失，若裸ItisagreedandunderstoodthattheInsuredisrequest1.Inspectthematerialsandequipmentforpossiblesite.Inthecaseofunpackedgoodswheredamageisevidentsuchdamageistobe2.Inthecaseofpackedgoodswhichareleftintheirpackinguntilalaterdate,thepackingistobeusuallyinspeforsignsofpossibledamagetothegoods.Ifanysignofdamageisvisible,thegoodsthemselvesaretobereportedundertheMarineCover.3.WhenthePackingofthegoodsmanifestsnosignofdamageandthegoodsarethereforeleftpacked,anydamagediscoveredwhentheyareunpackedwillbeassumedtohaveoccurredduringtransifromthenatureofthedamagethatitcouldonlyhaveoccurredafterexpiryofthemarineinsurance.4.If,however,noclearevidencecanbededucedastowhenthedamagewascabesharedequallybetweenthisinsuranceandtheErectioninsurance.Thisclauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.Itisunderstoodandagreedthat,effectivefrominception,thispolicyandoffanymeansofconveyance.若由于運輸過程中產生任何中斷和/或發(fā)生被保險人無法控制的事件，或者由于傷亡事故和/或在點和/或在聯運船舶或運輸工具上，發(fā)生保險標的的累積價值超過本保險規(guī)定的限額的情況時，在被保險人Shouldtherebeanaccumulationofinterestsbeyondthelimitsexpressedininterruptionoftransitand/oroccurrencebeyondthecontroloftheInsured,orbyreasonofanycasualtyand/oratatranshippingpointand/oronaconnectingsteamerorconveyance,InsandshallbeliableforthefullamountatriskbutinnoeventtoexceedtwgiventoInsurer(s)assoonasknownto任何索賠預先支付賠償款項，但任何情況下的預先支付均應符合本保險合同的規(guī)定。ItisagreedthatattherequestoftheInsuredtheInsuapplicationoftheapplicableDeductible,providepaymentonaccountinrespectofancompliancewiththetermsandconditionsofthisPolicy.TheInsuredshallprovidetotheInpaymentsonaccount,forexamplebutnotlimitedtoproofoflosswithsupportingdocumentaccounts,foragreementandapproval.11、隱藏損失條款－限于90天ConcealedDamage-limit90風險的損失或損害，但以保險標的抵達最終倉庫的時間至發(fā)現前述損失或損害的Notwithstandingtheterminationofinsuredtransitasdeterminedherein,itisagreedthatliabilityofanylossordamagereasonablyattributabletotheoperationofperilsinsuredagainstduringtheperiodoftransitcoveredbythisPolicyprovidedthatthetimewhichmayelapsebetweenarrivalofthepropertyatthefinalwarehouseandthetimeofdiscoveryofsuchlossordamagedoesnotexceed90days.ItisfurtheragreedbytheInsuredthatanypackageshowingsignsofdamageimmediatelyandnormalclaimsprocedureadopte其他船舶運輸，被保險人應在知曉前述事實后盡快通知保險人，并補繳任何差額保險本保險不因被保險人由于自身無法控制的原因違反任何保證或條件而TheInsuredshallnotbeprejudicedbyanyunintentionalorinadvertentdelayoromissioninthereportinghoranyunintentionalerrorintheamountordescriptionoftheInsuredPropertyriskvesselconveyanceorvoyaiftheInsuredPropertybeshippedbyanyothervesselifnoticebegiventoInsurersassoonaspracticableaftersuchfactsbecomeknowntotheInsuredanddeficiencyofpremiumifanymadegood.ThisinsuranceshallnotbeaffectedbythefailureoftheInsuredtocomplywithanyofthewarrantiesorconditionsoverwhichtheyhaveno13.清理殘骸條款（A）RemovalofDebrisC在任何情況下，保險人在本條款項下承擔的賠償責任應以受損貨物價值的10％為限制，任一賠償請求expensesreasonablyandnecessarilyincurredbytheInsuredinconnectionwith:-a)removalanddisposalofdebrisb)dismantlingand/ordemolishingc)shoringupand/orprd)dumpingand/ordese)transshipmentandrecoverychargesconsequentuponfirealiabilitythereof2)thecostofremovalofcargofromanyvesselorcraftInnocaseshalltheinsurersbeliablindemnityUSD500,000anyoneclaim.14、清理殘骸條款（B）RemovalofDebriThisinsuranceisextendedtocover,inexpensesreasonablyincurredbytheAssuredfortheremovalanddisposalofdebrisofthesubjectmatterinsured,orpartthereof,byreasonofdamagetheretocausedbyaninsuredrisk,butexcludingabsolutely:(1)anyexpensesincurredinconsequenceofort(2)thecostofremovalofcargofromanyvesselorcraft.Theindemnityprovidedbythisclauseshallbeinadditiontotheindemnityprovidedelsewherehereto15%oftheinsuredvalueoftheshipment.Innocasehowevershallthisclausei貨物因拒收而無法向被保險人和/或收貨人交付，因此或其他任何原因而回運時，保險人按本保單的規(guī)ShipmentsuponwhichdeliverytotheInsuredand/orconsigneecannotbeaccomplacceptanceandwhicharereturnedfortsoldorotherwisedisposedofsubjecttotermsandConditionsofthiscover.16、7天戰(zhàn)爭險取消條款7DaysCancThissectionmaynotbecancelledeitherbytheInsuredorbyInsurersexceptinrespectofthefollowinSevendaysnoticeatanytimeinrespectofWar,Strikes,Riots,CivilCommotionsandMaliciousDamageetc;risksexceptinrespectofsendingstoorfromUMaliciousDamageetcriskswillbesubjecttofortyeighthoursnoticeofcancellation.Noticeifgivennottoapplytoanyriskswhichshallhavecommencedorbeendeclaredpriortoterminationofperiodofnotice.Itisunderstoodandagreedthat,effectivefrominception,thispolicyiandoffthecarryingvehicles.Itiswarrantedthattheloadingandunloadinprofessionalparty.overboard.Priornotificationofuncontainerisedon-deckshipments,ifany,ifatallpossibleinthecirequiredinordertoenableInsurerstoarrangInrespectofshipmentsincontainers,provideddoinvalidateclaimsfortheft,pilferage,shortageandnon-d20、合同到期保險費調整條款PremiumAdjustmentU茲經雙方理解并同意，被保險人每年應向保險人申報實ItisherebyagreedanduInsuredtotheCompanywithpremiumadjuThisclauseissubjectotherwisetotheterms,conditionsandexclusionsofthisPolicy.21、保險人90天通知解除合同條款90DaysNoticeofCanc90天通知被保險人解除保險合同。在前述情形下，保險人ItisagreedandunderstoodthatthisPolicymacanceledatanytimeattheoptionoftheCompanybygiving90-DayspriornoticetabovecasestheCompanyshallretai22、品牌和商標條款Brandand如果貼有品牌或商標的財產或以任何方式帶有或暗含制造商或被保險人應當承擔保證或責任的財產遭的貨物是否適合使用。如果被保險人認為貨物不適合使用，則該貨物不得出售或以其他方式進行Incaseofdamagetopropertybearingabrandortrademark,orwhichinanywaycarriesorimpliestheguaranteeortheresponsibilityofthemanufacturerorInsured,thesalvagevalueofsuchpropertysremovalinthecustomarymanner(attheInsurer’sexpense)ofallsuchbrandcharacteristics.TheinsuredshallhavefullrighttothepossessionofallgoodsinvolvedinanylossunderthisPolicyandshallretaincontrolofalldamagedgoods.Thejudgeastowhetherthegoodeemedbytheinsuredtotheunfitforconsumptionshallbesoldorotherdispositionofsuchgoods.23、故意損壞條款－海關服務DeliberateDamage-CustomsService本保險亦特別承保被保險人因海關工作人員在進行檢驗時或其他正當的政府機構替海關對被保險貨物ThisinsuranceisalsospeciallytoperformanceofinspectiondutiesbyCustomsServiceAgentsorotherdulyconstitutedgovernmentalagencieswhoareperforminginspectiondutiesoforfortheCustomsServic24、空運重置條款ReplacementbItisagreedthatwherethereislossordamagewhichisthesubjectofaclaimherenecessarytoforwardreplacementsbyAir,Underwriterswillpaytheextracostssoinvolved,suof15%(ortheequivalentinanyothercurrency),notwithstandingthattheoriginalconsignmentwasnotdispatchedbyAir.25、故意不當行為WillfulMiscNotwithstandinganythingtothecontrarycontainedelsewherehereinorinthelawandpracticetowhichissubject,thisinsuranceshallnotexcludelossdamageorexpenseattributabletowillfulmiscoorpersonscommittedwithouttheprivityofthedirectorsand/orofficersorwhoeverisc26、有人看守運輸工具/船舶盜竊全賠條款FullTheftonatteNotwithstandinganythingcontainedhereintothecoconditions,thePolicyisextendedtoprovidethefullindemnityifthegoodsoranypartthereofwhilstinthenormalcourseoftransitshallbestolenordamagedbytheftnotconsequenceuponforcibleandviolentaction,theCowillindemnifytheInsuredagainstsuchlossgoodswhilethecarryingvehicleand/ortheinsuredgoodsareleftunattended.ThisClauseissubjectotherwisetotheterms,conditionsandexceptionsoft本保險合同擴展承保被保險人在目的地重新整理或重置本保險合同承保的運送至該目的地的商品或貨（2）包裝在運送開始之時不存在任何損壞，具體以簽發(fā)的清潔提單（發(fā)貨人未出具保函）為證或被保I.商品或貨物將進行下一段運輸過程，但原包裝不能經受下一段運輸過程中的承保風險；II.原包裝上的痕跡顯示內裝貨物或商品可能發(fā)生損壞，因此需要打開包裝進行必要的測試和檢驗。ThispolicyisextendedtoindemnifytheAssuredforactualereplacingof,atthedestination,thepackageofgoodsand/ormerchandiseinsuredunderthisPolicyduringtransittosuchdestination,providedthat:i.Thetypeofpackagewouldnormallywithstandthetransitwithoutdamage.ii.Packingtobefreefromdamageatinceptionofthetransitasevidencedbyissuance(withoutaLetterofIndemnityhavingbeengivenbytheshipper);orotherwiseprovenbytheAssured.iii.Damaget
