□單項(xiàng)審圖/IndividualItem□其它/Others：2、船舶明細(xì)ShipInformation船名ShipName船舶登記號CCSClassNo.船舶類型Typeofship船旗國FlagState船舶航區(qū)/專用航線Servicearea/Specifiedroute總噸位Grosstonnage船東Owner本次設(shè)計(jì)單位聯(lián)系人/電話/郵箱DesignerofthisapplicationContact/Phone/Email送圖日期DateofplansubmissionFORMCHECKBOX紙質(zhì)送審PaperplansubmissionFORMCHECKBOX電子送審Electronicplansubmission需要說明的問題：Remarks:注/Note：FORMCHECKBOX適用/ApplicableFORMCHECKBOX不適用/NotApplicable（請繼續(xù)填寫續(xù)頁/Tobecontinued）委托方承諾并確認(rèn)已詳細(xì)閱讀下列條款及本協(xié)議提及的入級規(guī)范以及其他有關(guān)規(guī)范或規(guī)則見CCS網(wǎng)站“見CCS網(wǎng)站“營運(yùn)船舶適用規(guī)范、規(guī)則和公約清單”，是本協(xié)議的一部分。Theapplicantacknowledgeshavingreadthefollowingclauses,aswellasclassificationrulesandotherrelevantrulesorregulationsgivenintheapplicationindetail,andagreestobeboundbythem:委托方在委托中國船級社（CCS）進(jìn)行船舶審圖時，接受該船舶所適用的本社入級規(guī)范以及其他有關(guān)規(guī)范或規(guī)則中的全部條款約束。WhenapplyingtoChinaClassificationSociety(CCS)forplanapproval,theapplicantacceptstobeboundbyalltheprovisionsasspecifiedintheclassificationrulesorotherrelevantrulesorregulationsofCCSapplicabletotheship.在本社與委托人之間沒有其他合同時，本協(xié)議即為本社與委托方之間的合同。在本社與委托方就被委托船舶的檢驗(yàn)（包括審圖）簽有其他合同的，本協(xié)議各項(xiàng)內(nèi)容是CCS與委托方簽訂的有關(guān)合同的組成部分。本協(xié)議內(nèi)容與有關(guān)合同以及適用的入級規(guī)范、其他有關(guān)規(guī)范或規(guī)則有不一致的，在本協(xié)議的委托事項(xiàng)范圍內(nèi)，以本協(xié)議內(nèi)容為準(zhǔn)。WherenoanyothercontractissignedbetweenCCSandtheapplicant,theapplicationconstitutesthecontractbetweenCCSandtheapplicant.WhereCCShassignedanyothercontractwiththeapplicantinrespectofthesurveyoftheship(includingplanapproval),thecontentsoftheapplicationformanintegralpartoftherelevantcontractsignedbetweenCCSandtheapplicant.Intheeventofanyconflictorinconsistencybetweenthecontentsoftheapplicationandtherelevantcontract,applicableclassificationrules,orotherrelevantrulesandregulations,thecontentsoftheapplicationshallprevail,sofarastheitemsspecifiedintheapplicationareconcerned.委托方應(yīng)按照本社的要求提供審圖所需的圖紙、報(bào)告、文件、資料以及其他信息，并對所提供圖紙、報(bào)告、文件、資料以及其他信息的真實(shí)性、及時性和完整性負(fù)責(zé)。TheapplicantshallsubmittoCCSplans,reports,documents,dataandotherinformationnecessaryforplanapprovalinaccordancewiththerequirementsofCCSandshallberesponsibleforthetruthfulness,timelinessandcompletenessofsuchplans,reports,documents,dataandotherinformation.委托方應(yīng)根據(jù)上述信息參數(shù)所適用的本社規(guī)范及船旗國政府的要求（公約、法規(guī)等）進(jìn)行設(shè)計(jì)及必要的計(jì)算，并提交審圖。承諾建立適當(dāng)?shù)馁|(zhì)保體系，以保證船舶和產(chǎn)品的設(shè)計(jì)質(zhì)量。Theapplicantshallcarryoutdesignandnecessarycalculations,inaccordancewithCCSrulesandtherequirementsofthegovernmentoftheflagState(conventionsandregulationsetc.)applicabletotheaboveinformation,andsubmitthemforplanapproval.Theapplicantundertakestoestablishanappropriatequalityassurancesystemforthedesignqualityofshipsandassociatedmarineproducts.本社入級規(guī)范、有關(guān)規(guī)范或規(guī)則對本社批準(zhǔn)圖紙有效性做出了規(guī)定，委托方在本協(xié)議中填寫的相關(guān)信息的變更可能導(dǎo)致CCS審批圖紙的失效。ThevalidityofapprovedplansisstipulatedinclassificationrulesofCCS,relevantrulesorregulations.Theapprovedplansmaybeinvalidatedduetoanychangeofrelevantinformationgivenbytheapplicantintheapplication.委托方應(yīng)為本社的審圖工作提供方便，保證支付本社由審查批準(zhǔn)圖紙產(chǎn)生的費(fèi)用，即使由于委托方撤回委托使此項(xiàng)審圖未能由完成，委托方也應(yīng)據(jù)已進(jìn)行的工作按比例向本社支付相應(yīng)的費(fèi)用。TheapplicantshallfacilitateCCSinplanapprovalandundertaketopayfeesarisingfromplanapproval.Incaseoftheplanapprovalnotbeingfinishedduetowithdrawaloftheapplicationbytheapplicant,theapplicantshallpayonproratabasisfortheserviceprovided.本審圖服務(wù)產(chǎn)生的任何文件的內(nèi)容僅限委托方使用。委托方應(yīng)對本中心提供的文件和信息給予保密，未經(jīng)本中心書面同意，不得向船舶所有人、船舶設(shè)計(jì)方、船舶制造方以外的其他方透露。如其他方接受本審圖服務(wù)產(chǎn)生的文件的內(nèi)容導(dǎo)致的任何損害或損失，本社概不負(fù)責(zé)。Thecontentsofanydocumentproducedduringtheplanapprovalserviceshallbeonlyavailabletotheapplicant,whoshallkeepconfidentialthedocumentsandinformationprovidedbytheCenterandshallnotdisclosethemtoanypartyotherthantheshipowner,shipdesignerandshipbuilderwithoutwrittenpermissionfromtheCenter.CCSwillnotbeliableforanydamageorlossduetoacceptingsuchdocumentsbyanyotherparty.本社僅僅對由于自身疏忽行為而直接造成的損失或損害承擔(dān)責(zé)任，在任何情況下本社均不對間接損失或隨后引發(fā)附加損失或損害承擔(dān)責(zé)任。ThisSocietywillbeliableonlyforthelossordamageresultingdirectlyfromitsnegligenceact.InnoeventshallthisSocietybeliableforanyindirectcontractualorconsequentiallossesordamages.如經(jīng)證明合同關(guān)系方所遭受的損失或損害是由于本社或本社雇員、代理人或本社其他代表方的疏忽行為造成的，本社將承擔(dān)責(zé)任，并將按照入級規(guī)范、入級規(guī)則的規(guī)定支付賠償。但如該損失或損害系由如下行為所造成本社將不承擔(dān)任何責(zé)任：（1）本社雇員超越其受雇權(quán)限的行為；（2）本社的代理人或其他代表方超越本社對其書面授權(quán)范圍的行為。ThisSocietywillbeliableforthelossordamageduetonegligenceactprovidedattributetothisSocietyoritsemployees,agentsorotherpartiesactingonbehalfofthisSociety.AndinnocaseshalltheamountofthisliabilityexceedthelimitationvaluespecifiedintherelevantrulesandregulationsbyCCS.ThisSociety’sliabilityforthelossordamageisspeciallyexcludedwhensuchlossordamagearisesoutofanact:（1） byanemployeeofthisSocietyactingoutsidethetermsorscopeofhis/heremployment;or（2）byanyagentorotherpartyactingonbehalfofthisSociety,whensuchactexceedstheauthoritygrantedinwritingbythisSocietytosuchagentorparty.本協(xié)議適用中華人民共和國法律。除與本社另有約定外，凡因本社入級服務(wù)有關(guān)的任何爭議，均應(yīng)提交中國海事仲裁委員會，按照委托仲裁時該會現(xiàn)行有效的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對雙方均有約束力。ThelawsofthePeople’sRepublicofChinashallapplytotheapplication.UnlessotherwiseagreedwithCCS,anydisputeofwhatsoevernatureinrespecttotheclassificationserviceprovidedbyCCSshallbereferredtoChinaMaritimeArbitrationCommissionandarbitratedinaccordancewithitsarbitrationruleseffecti
