EMPLOYMENTAGREEMENT（外籍教師）雇傭協(xié)議PartyA(EmployingParty):甲方（雇用方）：Address:地址：LegalRepresentative：法定代表人：IdentificationNumber：身份證號(hào)碼：PartyB(EmployedParty)：乙方：（受雇方）：Name:Gender:Nationality:姓名：性別：國(guó)籍：BirthDate:PassportNo:出生年月：護(hù)照號(hào)碼：Address:地址：I.PartyBwishestoengagetheserviceofPartyAGanzhouKingDoctorKindergartenofOxfordInternationalasaforeignEnglishteacher.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.乙方自愿作為甲方外教在甲方從事教學(xué)服務(wù)工作。雙方在友好合作的基礎(chǔ)上簽訂本合同，并發(fā)誓遵守合同中所規(guī)定的各項(xiàng)條款。II.Theperiodofservicewillbefromto.乙方在甲方服務(wù)期限為至。III.ThedutiesofPartyB(SeeTHEAPPENDIXOFSTANDARDWORKCONTRACTFORFOREIGNTEACHERS)乙方義務(wù)。（詳見(jiàn)《外籍教師工作合同附件》）IV.PartyB'smonthlysalarywillbe￥6000RMB.乙方在甲方工作期間月工資為：￥6000元，以人民幣形式支付。V.PartyA'sObligations甲方義務(wù)：1.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA'worksystemandregulationsconcerningadministrationofforeignexperts.甲方有義務(wù)向乙方介紹甲方所在當(dāng)?shù)氐南嚓P(guān)法律、法規(guī)以及甲方工作機(jī)制、規(guī)程、規(guī)定以及與外國(guó)專家管理相關(guān)的規(guī)章制度。2.PartyAshallconductdirection,supervisionandevaluationofPartyB'swork.甲方對(duì)乙方的工作負(fù)責(zé)指導(dǎo)、監(jiān)督以及評(píng)價(jià)。3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.甲方必須向乙方提供乙方工作和生活必需的條件和設(shè)施。4.PartyAshallprovidePartyBwithanassistantforworkingandlivingaffairs.甲方應(yīng)向乙方提供工作和生活聯(lián)系人5.PartyAshallpayPartyB'ssalaryregularlybythemonth.甲方應(yīng)向乙方每月按期發(fā)放工資。VI.PartyB'sobligations乙方義務(wù)：1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina'sinternalaffairs.乙方必須遵守中國(guó)的法律、法規(guī)和將關(guān)規(guī)定，不干涉中國(guó)內(nèi)政。2.PartyBshallobservePartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA'sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.乙方必需遵守甲方的工作制度及與外國(guó)專家管理相關(guān)的規(guī)定，并接受甲方在工作方面的安排、指導(dǎo)、監(jiān)督和評(píng)價(jià)。未經(jīng)甲方批準(zhǔn)，乙方不得從事任何兼職工作。3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.乙方必須按照計(jì)劃保質(zhì)保量完成甲方委派的工作。4.PartyBshallrespectChina'sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.乙方必須遵守中國(guó)的宗教政策，不允許從事與外籍專家身份不符的宗教活動(dòng)。5.PartyBshallrespecttheChinesepeople'smoralstandardsandcustoms.乙方必須尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。6.IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities.乙方如有嚴(yán)重疾病或傳染性疾病、或者女性有懷孕、待產(chǎn)、哺乳等情況，必須在簽訂合同之前，向甲方如實(shí)聲明，否則造成后果由乙方承擔(dān)全部責(zé)任。VII.Revision,CancellationandTerminationoftheContract合同的修改、取消和終止：1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6).雙方必須嚴(yán)格遵守合同中所規(guī)定的內(nèi)容。不經(jīng)雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第VI條第六款所規(guī)定的情況除外。2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.在雙方同意的情況下，可以對(duì)合同進(jìn)行修改、取消或者終止。但在此之前，必須嚴(yán)格遵守合同。3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;在以下情況下，甲方有權(quán)以書面形式通知乙方終止合同：(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.乙方?jīng)]有完成合同中所規(guī)定的內(nèi)容，或者經(jīng)甲方提醒仍沒(méi)有履行合同中所規(guī)定的義務(wù)。(2)Accordingtothedoctor'sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.經(jīng)醫(yī)生診斷，乙方在連續(xù)30日病假后仍不能恢復(fù)正常工作。4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:在以下情況下，乙方有權(quán)以書面形式通知甲方終止合同：(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.甲方?jīng)]有按照規(guī)定為乙方提供工作和生活所需條件和設(shè)備。(2)PartyAhasnotpaidPartyBasscheduled.甲方?jīng)]有按期向乙方發(fā)放勞務(wù)報(bào)酬。VIII.BreachPenalty違約金Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpaya任何一方不能按照合同中所規(guī)定內(nèi)容執(zhí)行，都將視為breachpenaltyof￥50000RMB.錯(cuò)誤!未指定文件名。違約。違約方應(yīng)承擔(dān)￥50000元人民幣的違約金。錯(cuò)誤!未指定文件名。IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA'sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB'sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB'sreturnexpenses如果因不可抗原因乙方請(qǐng)求終止合同，andpayabreachpenaltytoPartyB.須出示有關(guān)部門開(kāi)具的證明材料，經(jīng)甲方批準(zhǔn)，自費(fèi)返程路費(fèi)。如果沒(méi)有正當(dāng)理由乙方擅自終止合同，乙方應(yīng)自費(fèi)返程路費(fèi)，并承擔(dān)違約責(zé)任。如果甲方因不可抗原因結(jié)束合同，經(jīng)乙方同意后，應(yīng)由甲方負(fù)責(zé)提供乙方返程路費(fèi)。如甲方?jīng)]有正當(dāng)理由擅自終止合同，應(yīng)負(fù)責(zé)向乙方提供返程路費(fèi)，并承擔(dān)違約責(zé)任。．IX.Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect本合同附件與合同正文具有同等法律效力。X.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty2weekspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstaying本合同自簽訂之日起生效，到合同期滿自然終止。如其中onafterthecontractexpires.任何一方有意延期，必須在合同期滿2周前向?qū)Ψ教岢觯陔p方同意下簽訂續(xù)約。合同期滿后，乙方負(fù)責(zé)之后的所有滯留費(fèi)用。XI.Arbitration仲裁Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt.有關(guān)合同內(nèi)容的含義，須雙方及時(shí)互相溝通，及時(shí)處理其中可能存在的爭(zhēng)議。如果經(jīng)雙方協(xié)商不能達(dá)成一致，可申請(qǐng)可向甲方所在地法院起訴。PartyAPartyB甲方：乙方：(Signature)(Signature)（簽名）（簽名）Date日期日期(PassportofPartyB)（乙方護(hù)照）THEAPPENDIXOFSTANDARDWORKCONTRACTFORFOREIGNTEACHERS外籍教師工作合同附件ⅠRequiredworkassignmentoftheemployedparty受雇方工作任務(wù)：1.Preparelessonswellpriortoteaching上課之前充分備課；2.ConductEnglishlessons課堂授課；3.Assessstudents'work對(duì)學(xué)生學(xué)習(xí)進(jìn)行考核4.Takeanactivepartinstudents'extra-curriculumactivitiesoftheemployingParty積極參與學(xué)生課外活動(dòng)。ⅡThesalarytreatment工資待遇1.Directpayment直接支付thofeachmonthfromthedayof20MonetarysalaryRMB/month.Thesalarywillbepaidonthestartingworktotheexpirationofthecontract.Incasethetimeisshorterthanawholemonth,thepaymentshallbecountedbyday.Thedailywageshallbe1/30ofthemonthlysalary(thesamewithFebruary).每月以人民幣形式支付工資。工資發(fā)放日期為合同簽訂后一直到合同期滿之間每月20日。如果遇到不滿一個(gè)月，按照天數(shù)計(jì)算工資，此時(shí)每日工資為月工資的1/30（二月份同）。2.Indirectpayment.間接支付1）Theemployingpartyagreestoprovidehousingconditionsandpayforthewaterandelectricity.雇用方提供住房條件和其水電費(fèi)。2）Theemployingpartyagreestopaytwiceforthedomestictravelingbonus.每學(xué)期兩次的國(guó)內(nèi)差旅交通費(fèi)報(bào)銷。3)Theemployingpartyagreestoaffordholidaysbonus.節(jié)假日補(bǔ)貼。ⅢWorkTime,RestandHolidays工作時(shí)間、休息和假期1.Theworktimeoftheemployedpartyshallbe40hourseveryweek(two-dayweekend)Iftheworktimecannotreachtheabove-mentionedamount,PartyAcanarrangeforPartyBsomeotherconcernedworkoractivities,otherwise,theemployedpartyshouldbepaidashavingreachedit.受雇方每周工作量為40小時(shí)（周末雙休）。如果受雇方不能達(dá)到以上工作量，雇用方可根據(jù)需要安排受雇方其他工作作為補(bǔ)充。如果因雇用方原因致使受雇方不能達(dá)到要求所需工作量，則視為乙方已經(jīng)滿足工作量。2.Iftheemployingpartyarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.Theexactpaymentshouldbenegotiatedbetweenthetwoparties.如果雇用方安排受雇方從事工作量以外的工作，應(yīng)付給雇用方額外工資。額外數(shù)額由雙方協(xié)商。holidaysandfestivalsinChina:paid3.TheemployedpartyisentitledtothefollowingNewYear'sDay,SpringFestival,MayDay,NationalDayandotherholidaysstipulatedbylawsandregulations.受雇方在中國(guó)享有以下假期和假日：元旦，春節(jié)，“五·一”勞動(dòng)節(jié)，國(guó)慶節(jié)以及法律、法規(guī)中所規(guī)定的其他節(jié)日。ⅣSickleaveandprivateaffairsleave病假和個(gè)人事假1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave.受雇方請(qǐng)病假應(yīng)持有雇用方指定的醫(yī)療機(jī)構(gòu)開(kāi)具的醫(yī)療證明。2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays'salarywillbedeductedforeachdaythereafter.雇用方應(yīng)準(zhǔn)許受雇方請(qǐng)個(gè)人事假。期間工
