編號:NO.:廣東省勞動(dòng)合同LaborContractofGuangdongProvince廣東省人力資源和社會保障廳編制DraftedbyGuangdongProvincialHumanResources&SocialSecurityDepartment廣東省東莞市人力資源局印PrintedbyDongguanMunicipalHumanResourcesDepartment人力資源和社會保障效勞熱線:12333HumanResourcesandSocialSecurityServiceHotline:12333使用說明Guideline雙方在簽訂本合同前,應(yīng)認(rèn)真閱讀本合同。本合同一經(jīng)簽訂,即具有法律效力,雙方必須嚴(yán)格履行。1.Thepartieshereofshallreadthroughallcontentbeforesigningthiscontract.Thiscontractshallcomeintoforceuponsignature,andshallbeimplementedbybothparties.二、本合同必須由用人單位〔甲方〕的法定代表人〔或者委托代理人〕和職工〔乙方〕簽字或蓋章,并加蓋用人單位公章〔或者勞動(dòng)合同專用章〕。2.Thiscontractshallbesignedorsealedbytheemployee(PartyB)withthelegalrepresentativeoftheemployer(PartyA),andsealedwiththeofficialsealoftheemployer(orthespecificsealforlaborcontracts).三、本合同中的空欄,由雙方協(xié)商確定后填寫,并不得違反法律、法規(guī)和相關(guān)規(guī)定;不需填寫的空欄,劃上“/”。3.Blanksinthiscontractshallbefilleduponmutualcommunication,andshallNOTbreachanylaws,provisionsorrelatedregulations;blanksdoNOTneedtobefilled,puta/onit.四、工時(shí)制度分為標(biāo)準(zhǔn)工時(shí)、不定時(shí)、綜合計(jì)算工時(shí)三種。實(shí)行不定時(shí)、綜合計(jì)算工時(shí)工作制的,應(yīng)經(jīng)勞動(dòng)保障部門批準(zhǔn)。4.WorkingHoursystemisdividedintothreetypes,namelystandard-hourtype,irregular-hourtype,andcomprehensive-calculationtype.TheimplementationoftheirregularworkinghoursystemandcomprehensivecalculationworkinghoursystemshouldbeapprovedbytheLaborSecurityDepartment.五、本合同的未盡事宜,可另行簽訂補(bǔ)充協(xié)議,作為本合同的附件,與本合同一并履行。5.IssuesNOTcoveredinthiscontractcanbesupplementedwithextrawrittenandsignedagreements.Andthesupplementaryappendixofthiscontractshouldalsobeimplemented.六、本合同必須認(rèn)真填寫,字跡清楚、文字簡練、準(zhǔn)確,并不得擅自涂改。6.Cautiousness,clearwriting,concisenessandaccuracyarerequiredinthiscontract,andnoarbitraryalterationisallowed.七、本合同〔含附件〕簽訂后,甲、乙雙方各執(zhí)一份備查。7.Uponsignature(includingappendix),PartyAandPartyBshallholdonecopyeach.甲方〔用人單位〕:乙方〔勞動(dòng)者〕:PartyA(Employer):PartyB(Employee):名稱:姓名:Name:Name:法定代表人〔主要負(fù)責(zé)人〕:身份證號碼:IDCardNO.:Legalrepresentative(mainpersonincharge):戶籍地址:Domicile:通訊地址:通訊地址:CorrespondenceAddress:CorrespondenceAddress:經(jīng)濟(jì)類型:Businesstype:聯(lián)系:聯(lián)系:Tel:Tel:根據(jù)《中華人民共和國勞動(dòng)法》、《中華人民共和國勞動(dòng)合同法》和國家及省的有關(guān)規(guī)定,甲乙雙方按照合法、公平、平等自愿、協(xié)商一致、老實(shí)信用的原那么訂立本合同。ThisContractisconcludedonmutualbasisoflawfulness,fairness,equalityandfreewill,consensusandgoodfaithbyandbetweentheforesaidEmployerandEmployeeinaccordancewiththeLaborLawofthePeople'sRepublicofChina(thePRCLaborLaw),theLawofthePeople’sRepublicofChinaonEmploymentContracts(thePRCEmploymentContractLaw)andotherrelevantlawsandregulationsofChinaandofGuangdongProvince.勞動(dòng)合同期限Article1LaborContractTerm合同期ContractTerm雙方同意按以下第種方式確定本合同期限:Bothpartiesagreetodeterminethecontractterm(durationofservice)assetforthinItem(1)below:1.固定期限:從年月日起至年月日止。1.Fixed-term:fromdaymonthyeartodaymonthyear.2.無固定期限:從年月日起至法定終止條件出現(xiàn)時(shí)止。2.Open-endedterm:fromdaymonthyeartothedateonwhichstipulatedendingconditionoccurs.3.以完成一定工作任務(wù)為期限:從起至工作任務(wù)完成時(shí)止。該工作任務(wù)完成的標(biāo)志為。3Theperiodisdefinedasthecompletionofacertaintask:commencesfromandendswhenthetaskisdone.Thesettargetofcompletionis.〔二〕試用期B.ProbationPeriod雙方同意按以下第種方式確定試用期〔試用期包含在合同期內(nèi)〕:ThePartiesagreetodeterminetheprobationperiodpursuanttomodebelow〔theprobationperiodshallbeincludedinthetermoftheContract〕:無試用期。1.Noprobationperiod.2.試用期從年月日起至年月日止。2.Probationperiodcommencesfromdaymonthyearandendsondaymonthyear.〔勞動(dòng)合同期限三個(gè)月以上不滿一年的,試用期不得超過一個(gè)月;勞動(dòng)合同期限在一年以上不滿三年的,試用期不得超過二個(gè)月;三年以上固定期限和無固定期限的勞動(dòng)合同,試用期不得超過六個(gè)月。〕(Ifthelaborcontracthasatermofnotlessthanthreemonthsbutlessthanoneyear,theprobationperiodmayNOTexceedonemonth;ifthelaborcontracthasatermofmorethanoneyearandlessthanthreeyears,theprobationperiodmayNOTexceedtwomonths;andifthelaborcontracthasatermofnotlessthanthreeyearsorisopen-ended,theprobationperiodmayNOTexceedsixmonths.)二、工作內(nèi)容和工作地點(diǎn)Article2JobDescriptionandPlaceofWork〔一〕乙方的工作部門為,崗位〔管理技術(shù)崗位或生產(chǎn)操作崗位〕為,職務(wù)〔或工種〕為。A.ThedepartmentorgroupatwhichPartyBworksis:

.〔四〕甲方在合同期內(nèi)因生產(chǎn)經(jīng)營需要或其他原因調(diào)整乙方的工作崗位,或派乙方到本合同約定以外的地點(diǎn)、單位工作的,應(yīng)協(xié)商一致并按變更本合同辦理,雙方簽章確認(rèn)的協(xié)議書作為本合同的附件。D.Duringthetermofthiscontract,ifPartyAhastoadjustthepositionofPartyBduetotheneedsofproductionandbusinessoperationorothercauses,orassignPartyBtoworkintheplaceorcompanyotherthantheplaceorcompanyprovidedinthiscontract,thePartiesshallreachconsensusthroughnegotiationtoamendthiscontract.Theamendedagreementconcludedshallbetheappendixofthiscontract.三、工作時(shí)間和休息休假Article3WorkingHoursandRestandLeave〔一〕甲、乙雙方同意按以下第種方式確定乙方的工作時(shí)間:A.ThePartiesagreetodeterminetheworkinghourpursuanttomodebelow:1.標(biāo)準(zhǔn)工時(shí)工作制,即每日工作小時(shí),每周工作天,每周至少休息一天。1.Standardworkinghoursystem.PartyBshallworkforhoursadayandhoursaweek.PartyAshallguaranteethatPartyBhasatleastonedayoffinaweek.2.不定時(shí)工作制,即經(jīng)勞動(dòng)保障部門審批,乙方所在崗位實(shí)行不定時(shí)工作制。2.Irregularworkinghoursystem.ThepositionofPartyBshallpracticeirregularworkinghoursystemaftertheapprovalofcertainlaboradministrationauthority.3.綜合計(jì)算工時(shí)工作制,即經(jīng)勞動(dòng)保障部門審批,乙方所在崗位實(shí)行以為周期,總工時(shí)小時(shí)的綜合計(jì)算工時(shí)工作制。3.Workinghoursystemofcomprehensivecalculation.ThepositionofPartyBpracticestheWorkinghoursystemofcomprehensivecalculationaftertheapprovalofthelaboradministrationauthoritywiththecalculationcircleasandthetotalworkinghoursas.〔二〕甲方因生產(chǎn)〔工作〕需要,經(jīng)與工會和乙方協(xié)商后可以延長工作時(shí)間。除《勞動(dòng)法》第四十二條規(guī)定的情形外,一般每日不得超過一小時(shí),因特殊原因最長每日不得超過三小時(shí),每月不得超過三十六小時(shí)。B.PartyAmayextendtheworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandPartyB,but,withtheexceptionofthecircumstancesstipulatedinArticle42ofthePRCLaborLaw,theextendedworkinghourforadayshallgenerallyNOTexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallNOTexceedthreehoursadayandthetotalextensioninamonthshallNOTexceedthirty-sixhours.〔三〕甲方按規(guī)定給予乙方享受法定休假日、年休假、婚假、喪假、探親假、產(chǎn)假、看護(hù)假等帶薪假期,并應(yīng)按本合同約定的工資標(biāo)準(zhǔn)支付工資。C.PartyAshallprovidePartyBwithpaidvacationsincludinglegalholidays,annualleave,marriageleave,funeralleave,homeleave,maternityleaveandnursingleave,andetc.inaccordancewithrelevantregulations,andshallpayvacationsalaryaccordingtothesalarystandardprovidedbythiscontract.四、勞動(dòng)報(bào)酬Article4LaborCompensation〔一〕乙方正常工作時(shí)間的工資按以下第種形式執(zhí)行,并不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。A.ThesalaryofPartyBfornormalworkinghoursshallbepaidpursuanttomodebelowandshallNOTbelessthanthelocalminimumsalaryrate.1.計(jì)時(shí)工資:1.hourlysalary〔1〕乙方正常工作時(shí)間工資按執(zhí)行,初始工資額為元/月或元/時(shí);(1)ThesalaryofPartyBfornormalworkinghoursshallbepaidpursuantto,thebeginning-amountisRMB/monthorRMB/hour;〔2〕乙方試用期工資為元/月〔試用期工資不得低于甲方相同崗位最低檔工資或者本合同約定工資的百分之八十,并不得低于甲方所在地的最低工資標(biāo)準(zhǔn)〕;(2)ThesalaryofPartyBforprobationperiodisRMB/month〔ThesalaryofPartyBonprobationshallNOTbelessthanthelowestsalarycategoryforthesamepositionofPartyAorlessthan80percentofthesalaryagreeduponinthiscontract,andmayNOTbelessthanthelocalminimumsalaryrate〕.2.計(jì)件工資:2.pieceworksalary〔1〕計(jì)件單價(jià);(1)Unitprice:;〔2〕勞動(dòng)定額〔確定的勞動(dòng)定額原那么上應(yīng)當(dāng)使本單位同崗位百分之七十以上的勞動(dòng)者在法定勞動(dòng)時(shí)間內(nèi)能夠完成〕;(2)AgreedQuota:(Thelaborquotasdeterminedgenerallyshallbetheamountofworkthatover70%employeesinthesamepositionoftheemployercanfinishwithinlegalworkinghours.)3.其他形式〔如實(shí)行年薪制或者按考核周期支付工資〕:。OtherForms(e.g.Annualsalaryorpaidbycertainassessmentcircle):.4.甲方根據(jù)本單位的生產(chǎn)經(jīng)營狀況、物價(jià)水平和政府公布的工資增長指導(dǎo)線等情況,依法確定本單位的工資分配制度。經(jīng)甲乙雙方協(xié)商或者以集體協(xié)商的形式,依法確定工資正常增長的具體方法和幅度。4.PartyAshalldetermineitssalarydistributionsysteminlightofthestatusquoofitsproductionandbusinessoperation,thepricelevelandsalarygrowthguidelineannouncedbythegovernment.ThespecificwaysandextentofnormalsalarygrowthshallbedeterminedthroughmutualconsultationbetweenthePartiesorthroughcollectivebargaining.〔二〕乙方的績效薪酬或獎(jiǎng)金的計(jì)發(fā)方法為:。B.ThecalculationmethodforPartyB’ssalaryandbonusshallbe:〔三〕乙方的津貼、補(bǔ)貼的發(fā)放標(biāo)準(zhǔn)和方法為:。C.ThesubsidiesandallowanceofPartyBshallbepaidinlinewiththefollowingstandardandmethod:.〔四〕工資必須以貨幣形式支付,不得以實(shí)物及有價(jià)證券替代貨幣支付。D.Thesalaryshallbepaidincurrencyinsteadofphysicalgoodsorsecurities.〔五〕甲方每月日發(fā)放〔當(dāng)月/上月〕工資。如遇法定休假日或休息日,那么提前到最近的工作日支付。E.PartyAshallpaythesalaryofthismonth/lastmonthon

ofeachmonth.Ifthepaydayhappenstobealegalholidayoranon-businessday,thesalaryshallbepaidinadvanceonthemostrecentbusinessday.〔六〕甲方依法安排乙方延長工作時(shí)間或者在休息日、法定休假日加班的,應(yīng)按《勞動(dòng)法》、《廣東省工資支付條例》的規(guī)定支付加班工資,但乙方休息日加班被安排補(bǔ)休的除外。F.IfPartyBisarrangedtoworkovertimeoronnon-businessday(s)oronlegalholidays,PartyAshallpayPartyBovertimesalaryinaccordancewiththePRCLaborLawandtheprovisionsofGuangdongProvinceonWagePayment,exceptthatPartyBisarrangedforcompensatorytime-offafterheorshehasbeenarrangedtoworkovertimeoronnon-businessday(s).五、社會保險(xiǎn)和福利待遇Article5SocialInsuranceandBenefitPackage〔一〕合同期內(nèi),甲方應(yīng)按國家、省和本地區(qū)的有關(guān)規(guī)定,依法為乙方辦理參加養(yǎng)老、醫(yī)療、失業(yè)、工傷、生育等社會保險(xiǎn)的手續(xù),按規(guī)定的繳費(fèi)基數(shù)和繳費(fèi)比例繳納應(yīng)由甲方承當(dāng)?shù)纳鐣kU(xiǎn)費(fèi),并按規(guī)定從乙方的工資中代為扣繳應(yīng)由個(gè)人承當(dāng)?shù)纳鐣kU(xiǎn)費(fèi)。甲方應(yīng)將為乙方辦理參加社會保險(xiǎn)手續(xù)和扣繳社會保險(xiǎn)費(fèi)的情況如實(shí)告知乙方。A.Duringthecontractperiod,PartyA,inaccordancewithrelevantregulationsofthecountry,theprovinceandlocalauthority,shallpaythepension,medical,unemployment,workinjuryandmaternityinsurancesforPartyB,andshallpaysocialinsurancewithprescribedpaymentbaseandratio.PartyBshallundertaketheindividualpartofsocialinsurance,andthepayableamountshallbedeductedbyPartyAfromPartyB’ssalary.PartyAshalltruthfullyinformtheinformationofPartyB’ssocialinsuranceproceduresandthedeductionamount.〔二〕乙方患病或非因工負(fù)傷,甲方應(yīng)按國家和地方的規(guī)定給予醫(yī)療期和醫(yī)療待遇,按醫(yī)療保險(xiǎn)及其他相關(guān)規(guī)定報(bào)銷醫(yī)療費(fèi)用,并在規(guī)定的醫(yī)療期內(nèi)支付病假工資或疾病救濟(jì)費(fèi),數(shù)額為元/月〔不低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的80%〕。B.IncasethatPartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBaperiodofmedicaltreatmentandsick-leavetreatmentstipulatedbynationalandlocalregulations,reimbursemedicalinsuranceandothermedicalpaymentinlightofcertainregulations,andpaythesicknesspayorsicknessreliefcostduringspecifiedmedicaltreatmentperiod;theamountshallbeRMBpermonth(nolessthan80%ofthelocalminimumsalarystandard).六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article6LaborProtection,WorkingConditionandProtectionAgainstOccupationalHazards〔一〕甲方按國家和省有關(guān)勞動(dòng)保護(hù)規(guī)定提供符合國家勞動(dòng)衛(wèi)生標(biāo)準(zhǔn)的勞動(dòng)作業(yè)場所,切實(shí)保護(hù)乙方在生產(chǎn)工作中的平安和健康。如乙方工作過程中可能產(chǎn)生職業(yè)病危害,甲方應(yīng)如實(shí)告知乙方,并按《職業(yè)病防治法》的規(guī)定保護(hù)乙方的健康及其相關(guān)權(quán)益。A.PartyAshallprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordancewithlaborprotectionregulationsofthenationandprovince,andprotectthesafetyandhealthofPartyBatworkplace.ProvidedthatPartyBmaysufferoccupationalhazardduringproductionprocedures,PartyBshallbewellnotifiedbyPartyA,andPartyAshallprotectthehealthandrelatedrightsofPartyBstipulatedbyCodeofOccupationalDiseasePreventionofPRC.〔二〕甲方根據(jù)乙方從事的工作崗位,按國家有關(guān)規(guī)定,發(fā)給乙方必要的勞動(dòng)保護(hù)用品,并按勞動(dòng)保護(hù)規(guī)定每〔年/季/月〕免費(fèi)安排乙方進(jìn)行體檢。B.AccordingtothepositionofPartyB,PartyAshallprovidePartyBwithlaborsafetysuppliesinconformitywithrelevantlawsandregulations,andprovidefreephysicalexaminationforPartyBevery(year/season/month)inaccordancewithlaborprotectionprovisions.〔三〕甲方按照國家、省和當(dāng)?shù)氐挠嘘P(guān)規(guī)定,做好女職工的勞動(dòng)保護(hù)和保健工作。C.PartyAmustcarryoutrelevantprovisionsformulatedbythenation,provinceandlocalauthorityforthelaborprotectionandhealth-careworkoffemaleworker.〔四〕乙方有權(quán)拒絕甲方的違章指揮、強(qiáng)令冒險(xiǎn)作業(yè),對甲方及其管理人員漠視乙方生命平安和身體健康的行為,有權(quán)對甲方提出批評并向有關(guān)部門檢舉、控告。D.PartyBisentitledtorefusetocarryoutanydangerousoperationforceduponhim/herbyPartyA.ProvidedthatPartyAoritsmanagementcrewisindifferenttothesafetyandhealthofPartyB,PartyBhastherighttoimpeachorsuetorelevantgovernmentdepartments.〔五〕臺風(fēng)黃色、橙色、紅色或者暴雨紅色預(yù)警信號生效期間,除必需在崗的工作人員外,甲方應(yīng)當(dāng)根據(jù)工作地點(diǎn)、工作性質(zhì)、防災(zāi)避災(zāi)需要等情況安排工作人員推遲上班、提前下班或者停工,并為在崗工作人員以及因天氣原因滯留單位的工作人員提供必要的避險(xiǎn)措施。E.Providedthatthetyphoonyellow,orange,redwarningsignalORtherainstormredwarningsignalareissued,exceptforthoseneededtobeonduty,PartyAshallarrangeemployeestopostponetowork,toleaveearlierorstopworkingaccordingtotheplaceofwork,worknatureandtheneedofdisasterprevention,andnecessarypreventionmeasuresshallbetakenforemployeesondutyorstaffstrandedatworkplaceduetothebadweather.〔六〕乙方患職業(yè)病、因工負(fù)傷或者因工死亡的,甲方應(yīng)按《工傷保險(xiǎn)條例》的規(guī)定辦理。F.IfPartyBsuffersoccupationaldisease,work-relatedinjuryordeathduetowork,PartyAshallhandleitinaccordancewithRegulationsonWorkInjuryInsurance.七、合同的變更Article7ModificationoftheEmploymentContract〔一〕任何一方要求變更本合同的有關(guān)內(nèi)容,都應(yīng)以書面形式通知對方。A.EitherPartymaymodifyrelevanttermsoftheEmploymentContractwithwrittennoticetotheotherParty.〔二〕甲方變更名稱、法定代表人、主要負(fù)責(zé)人或者投資人等事項(xiàng),不影響本合同的履行。B.TheimplementationofthiscontractshallNOTbeaffectedbythechangeofname,legalrepresentative,principalpersoninchargeorinvestorofPartyA.〔三〕甲方發(fā)生合并或者分立等情況,本合同繼續(xù)有效,由承繼甲方權(quán)利和義務(wù)的單位繼續(xù)履行。C.IfmergeordivisionoccurstoPartyA,thiscontractremainseffective,andshallbeimplementedbythecompanywhosucceedsPartyA'srightsandobligations.〔四〕甲乙雙方經(jīng)協(xié)商一致,可以變更本合同,并辦理書面變更手續(xù)。變更后的勞動(dòng)合同文本由甲乙雙方各執(zhí)一份。D.Thetwocontractingpartiesmayalterthiscontractthroughmutualconsultationandnegotiation,andrecordchangesinwrittenform.Eachpartyholdsonecopyofthealteredcontract.八、合同的解除和終止Article8TheDissolutionandTerminationofContract〔一〕解除A.Dissolution1.經(jīng)甲乙雙方協(xié)商一致,本合同可以解除。其中由甲方提出解除本合同的,應(yīng)按規(guī)定支付經(jīng)濟(jì)補(bǔ)償。1.Thepartiesheretomayrevokethiscontractbymutualconsensus.IfPartyAproposestorevokethiscontract,certaincompensationshouldbemadetoPartyB.2.有以下情形之一的,甲方可以解除本合同:2.PartyAmayrevokethiscontractprovidedthatPartyBhasanyofthefollowingcircumstances:〔1〕乙方在試用期內(nèi)被證明不符合錄用條件的;(1)Provedtohavefailedtherecruitmentrequirementsduringprobationperiod;〔2〕乙方嚴(yán)重違反甲方規(guī)章制度的;(2)SeriouslybreachtherulesandregulationsofPartyA;〔3〕乙方嚴(yán)重失職,營私舞弊,對甲方造成重大損害的;(3)CausingseriousdamagesduetoPartyB’sseriousderelictionofdutyorfraud;〔4〕乙方同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對完成甲方的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)甲方提出,拒不改正的;(4)EstablishedlaborrelationshipwithothercompaniesandhasgreatimpactoncompletingthetasksofPartyA,ORrefusetoendthelaborrelationshipwithothercompaniesafterrequestedbyPartyA.〔5〕乙方以欺詐、脅迫的手段或者乘人之危,使甲方在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同致使本合同或者變更協(xié)議無效的;(5)PartyBhassignedormodifiedthislaborcontractagainstthetrueintentionsofPartyAthroughfraud,coercionorexploitationoftheunfavorablepositionofPartyA,asaresultofwhichthiscontractorthemodifiedagreementisdeemednullandvoid;〔6〕乙方被依法追究刑事責(zé)任的;(6)PartyBisprosecutedforcriminalliability;〔7〕乙方患病或非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事本合同約定的工作,也不能從事由甲方另行安排的工作的;(7)PartyB,duetoillnessornon-workrelatedinjury,canneitherengageintheoriginalworknorotherworkassignedbyPartyAafterduemedicaltreatment;〔8〕乙方不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;(8)PartyBisincompetentforworkbeforeandaftertrainingoradjustmentofpositions.〔9〕本合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,經(jīng)雙方協(xié)商未能就變更本合同達(dá)成協(xié)議的;(9)Bothpartiesheretomayrevokethiscontract,providedthatthiscontractcannotbefulfilledduetosignificantchangesofobjectivesituationsthatthiscontractwasbasedonwhensigned,andbothpartiescannotsettletoagreeonthechangesafternegotiation.甲方按照第〔7〕、〔8〕、〔9〕項(xiàng)規(guī)定解除本合同的,需提前三十日書面通知乙方〔或者額外支付乙方一個(gè)月工資〕,并按規(guī)定向乙方支付經(jīng)濟(jì)補(bǔ)償,其中按第〔7〕項(xiàng)解除本合同并符合有關(guān)規(guī)定的還需支付乙方醫(yī)療補(bǔ)助費(fèi)。IfPartyArevokesthiscontractinaccordancewithitem(7)(8)(9),PartyBshallbenotifiedinwrittenform(ormakeextractpaymentofonemonth’ssalary)andcertaineconomiccompensationshallbemadetoPartyB;specifically,ifPartyArevokesthiscontractaccordingtoitem(7),medicaltreatmentallowancesshallbemadetoPartyBconformingtorelevantregulations.3.有以下情形之一,甲方在履行規(guī)定程序后,可以裁減人員,并按規(guī)定支付經(jīng)濟(jì)補(bǔ)償:3.Underanyofthefollowingcircumstances,PartyAcanmakeredundanciesandpayeconomiccompensationtoPartyBinlinewithstipulatedregulations:〔1〕甲方依照企業(yè)破產(chǎn)法規(guī)定進(jìn)行重整的;(1)PartyAneedstoberestructuredpursuanttotheEnterpriseBankruptcyLawoftheRPC;〔2〕甲方生產(chǎn)經(jīng)營發(fā)生嚴(yán)重困難的;(2)PartyA’sproductionandoperationissufferingtremendousdifficulty;〔3〕甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營方式調(diào)整的;(3)PartyA’sproduction,significanttechnologyinnovationorbusinessmethodneedtobeadjusted;〔4〕其他因勞動(dòng)合同訂立時(shí)所依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使本合同無法履行的。(4)Othersituationswhicharecausedbythefailureofimplementationofthiscontractduetosignificantchangesofobjectivesituationsthatthiscontractwasbasedonwhensigned.4.乙方解除本合同,應(yīng)當(dāng)提前三十日以書面形式通知甲方;在試用期內(nèi)的,提前三日通知甲方。4.ProvidedthatPartyBistorevokethiscontract,writtennoticeshallbegiventoPartyA30daysaheadand3daysaheadduringprobationperiod.有以下情形之一的,乙方可以解除本合同,甲方應(yīng)按規(guī)定支付經(jīng)濟(jì)補(bǔ)償:PartyBmayrevokethiscontractunderthefollowingcircumstances,andPartyAshallmakeeconomiccompensationstoPartyBasstipulated:甲方未按照勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的;(1)PartyAfailedtoprovidelaborprotectionmeasuresorconditionsasagreedinthecontract;〔2〕甲方未及時(shí)足額支付勞動(dòng)報(bào)酬的;(2)PartyAfailedtopayPartyB’ssalaryinfullandintime;〔3〕甲方未依法為乙方繳納社會保險(xiǎn)費(fèi)的;(3)PartyAdidNOTpayforPartyB’ssocialinsuranceasstipulated;〔4〕甲方的規(guī)章制度違反法律、法規(guī)的規(guī)定,損害乙方權(quán)益的;(4)TherulesandregulationsofPartyAbreachthelawandregulations,andinfringetherightsandinterestsofPartyB;〔5〕甲方以欺詐、脅迫的手段或者乘人之危,使乙方在違背真實(shí)意思的情況下訂立或者變更本合同,致使本合同或者變更協(xié)議無效的;(5)PartyAhassignedormodifiedthislaborcontractagainstthetrueintentionsofPartyBthroughfraud,coercionorexploitationoftheunfavorablepositionofPartyA,asaresultofwhichthiscontractorthemodifiedagreementisdeemednullandvoid;〔6〕甲方免除自己的法定責(zé)任、排除乙方權(quán)利,致使本合同無效的;(6)ThiscontractisdeemednullandvoidgiventhatPartyAexemptsitsliabilitiesandPartyB’srights;〔7〕甲方違反法律、行政法規(guī)強(qiáng)制性規(guī)定,致使本合同無效的;(7)ThiscontractisdeemednullandvoidgiventhatPartyAviolatestheobligatoryprovisionsoflawsandregulations;〔8〕甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫乙方勞動(dòng),或者違章指揮、強(qiáng)令冒險(xiǎn)作業(yè)危及乙方人身平安的;(8)PartyBisforcedtoworkbyPartyAthroughviolence,coercionorunlawfulrestraintofindividualfreedom,ORifPartyBisforcedtoviolatethelaworengageinhazardousworkthatendangershisorherpersonalsafety;〔9〕法律、行政法規(guī)規(guī)定乙方可以解除勞動(dòng)合同的其他情形。(9)OthersituationstipulatedbylawsandregulationsthatPartyBisentitledtorevokethiscontract.甲方有上述第〔8〕項(xiàng)情形的,乙方可以立即解除勞動(dòng)合同,不需事先告知用人單位。Providedthatthecircumstancesofitem(8)occurs,PartyBhastherighttorevokethiscontractimmediatelywithoutnoticingPartyAinadvance.5.有以下情形之一的,甲方不得依據(jù)《勞動(dòng)合同法》第四十條、第四十一條的規(guī)定解除本合同:5.Shallanyofthefollowingcircumstancesoccur,PartyAisNOTallowedtorevokethiscontractonthebasisofarticle40and41oftheLaborContractLawofPRC:〔1〕乙方從事接觸職業(yè)病危害作業(yè)未進(jìn)行離崗前職業(yè)健康檢查,或者疑似職業(yè)病病人在診斷或者醫(yī)學(xué)觀察期間的;(1)PartyB,whoconductsoperationsthatexposeshimorhertooccupationaldiseasehazards,hasNOTgonethroughoccupationalhealthexaminationbeforeleavingthisposition,ORissuspectedofhavinganoccupationaldiseaseandisunderdiagnosisormedicalobservation;〔2〕乙方在本單位患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或局部喪失勞動(dòng)能力的;(2)PartyBisconfirmedtohaveoccupationaldiseasesinhis/herpositionorhaswork-relatedinjury,andisconfirmedtototallylostorpartiallylosttheabilitytowork;〔3〕乙方患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的;(3)PartyBisillorinjured,andisintheduemedicaltreatmentperiod;〔4〕女職工在孕期、產(chǎn)期、哺乳期的;(4)Femaleemployeesinpregnancy,lying-inperiodandlactationperiod;〕〔5〕乙方在本單位連續(xù)工作滿十五年,且距法定退休年齡缺乏五年的;(5)PartyBhasbeenworkinginthiscompanyfor15consecutiveyears,andthereislessthan5yearsbeforehe/shereacheslegalretirementage;〔6〕法律、行政法規(guī)規(guī)定的其他情形。(6)Othercircumstancesstipulatedbylawandadministrationregulations.〔二〕終止B.Termination1.本合同期滿或法定終止條件出現(xiàn),本合同即行終止。1.Thiscontractterminateswhenthecontracttermexpiresorlegalconditionstoterminateoccur.2.本合同因以下情形之一終止的,甲方應(yīng)當(dāng)按規(guī)定向乙方支付經(jīng)濟(jì)補(bǔ)償:2.PartyAshallmakeeconomiccompensationtoPartyBifanyofthefollowingconditionsoccur:除甲方維持或者提高勞動(dòng)合同約定條件續(xù)訂勞動(dòng)合同,乙方不同意續(xù)訂的情形外,勞動(dòng)合同期滿的;(1)ExceptforthecasethatPartyAmaintainsorimprovestheagreedconditionstorenewthelaborcontractandPartyBdisagrees,thiscontractexpires;〔2〕甲方被依法宣告破產(chǎn)的;(2)PartyAisdeclaredbankruptbycourt;〔3〕甲方被撤消營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者甲方?jīng)Q定提前解散的;(3)ThelicenseofPartyAisrevokedandorderedtocloseorrescind,ORPartyAdecidedtodissolveinadvance;〔4〕法律、行政法規(guī)規(guī)定的其他情形。(4)Othercircumstancesstipulatedbylawandadministrationregulations.3.乙方有第八條第〔一〕項(xiàng)第5點(diǎn)情形之一,合同期滿的,甲方應(yīng)當(dāng)續(xù)延乙方合同期至相應(yīng)的情形消失時(shí)終止。但乙方在甲方患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者局部喪失勞動(dòng)能力的勞動(dòng)合同的終止,按照國家和省有關(guān)工傷保險(xiǎn)的規(guī)定執(zhí)行。3.Thiscontractexpireswhereasanyofthefollowingcircumstancesofparagraph(5)ofarticle8occurs,PartyAshallrenewthecontractwithPartyBtillcorrespondingcircumstancesdisappear.ButifPartyBsuffersfromoccupationaldiseaseorwork-relatedinjuryandisconfirmedtohavetotallyorpartiallylosttheabilitytowork,PartyAshallimplementthiscontractaccordingtoworkinjuryinsuranceregulationsformulatedbythecountryandtheprovince.〔三〕甲方違法解除或者終止本合同,乙方要求繼續(xù)履行本合同的,甲方應(yīng)當(dāng)繼續(xù)履行;乙方不要求繼續(xù)履行本合同或者本合同不能繼續(xù)履行的,甲方應(yīng)按規(guī)定的經(jīng)濟(jì)補(bǔ)償標(biāo)準(zhǔn)的二倍支付乙方賠償金。C.PartyAillegallyrevokeorterminatethiscontractwhereasPartyBrequesttocontinue,PartyAshallcontinue;providedthatPartyBdoNOTrequesttocontinueorthiscontractcannotbeimplemented,PartyAshallmakedoublecompensationtoPartyBinaccordancewithregulations.〔四〕合同解除或者終止的手續(xù)D.Procedurestorevokeorterminatethecontract:甲方應(yīng)當(dāng)在解除或者終止本合同時(shí)出具解除或者終止勞動(dòng)合同的證明,并在十五日內(nèi)為乙方辦理檔案和社會保險(xiǎn)關(guān)系轉(zhuǎn)移手續(xù)。PartyAshallissuecertificatesofcontractdissolutionorcontractterminationatthetimeofrevokingorterminatingthiscontract,andshallgothroughprocedurestotransferfilesandsocialinsuranceforPartyBwithin15days.九、調(diào)解與仲裁Article9ConciliationandArbitration雙方履行本合同如發(fā)生爭議,可先協(xié)商解決;不愿協(xié)商或協(xié)商不成的,可以向甲方勞動(dòng)爭議調(diào)解機(jī)構(gòu)申請調(diào)解;調(diào)解無效的,可在法定仲裁時(shí)效內(nèi)向有管轄權(quán)的勞動(dòng)爭議仲裁委員會申請仲裁;也可以直接向勞動(dòng)爭議仲裁委員會申請仲裁。對仲裁裁決不服的,可在法定期限內(nèi)向人民法院提起訴訟。Ifanydisputearisesbetweenthetwopartiesduringtheimplementationofthiscontract,itshouldberesolvedthroughnegotiationinthefirstplace;ifeitherpartyrefusestonegotiateoraresolutioncan’tbereached,anapplicationformediationcanbemadetoPartyA’slabordisputemediationbody;ifthemediationfails,eitherpartymayapplytotheLaborDisputeArbitrationCommissionofjurisdictionforarbitrationwithinthelimitationofthelegalarbitration;oreitherpartymayapplydirectlytotheLaborDisputeArbitrationCommissionforarbitration.Ifeitherpartyisnotsatisfiedwiththearbitration,itmaybringalawsuittothePeople'sCourtwithinthelegalperiod.十、效勞期與競業(yè)限制Article10DurationofServ
