HAVEADOPTEDTHISDIRECTIVE:Article1ForthepurposesofthisDirective,'vehicle'meansanymotorvehicleortrailerasdefinedinArticle2ofandAnnexIItoDirective70/156/EEC,withtheexceptionofvehiclesofcategoryM1Article2NoMemberStatemayrefusetograntECtype-approvalornationaltype-approvalofavehicletype,orrefuseorprohibitthesale,registration,entryintoserviceoruseofavehicleongroundsrelatingtoitsmassesanddimensionsifthesesatisfytherequirementssetoutinAnnexIhereto.Article3However,aMemberStatemayrefusetograntnationaltype-approvalofavehicletype,orrefuseorprohibitthesale,registration,entryintoserviceoruseofavehicle,orconsideritscertificateofconformityasnotvalidwithinthemeaningofArticle7(1)ofDirective70/156/EEC,orauthorizeitonlyforthecarriageofindivisibleloadsif,havingbeengrantedapprovalunderthisDirective,itbenefitsfromthederogationprovidedforinArticle7thereofandthatderogationconflictswiththenationalrequirementsinforceinthatMemberState.Article4WhenMemberStatesgrantnationaltype-approvalofvehiclesapprovedunderthisDirectiveorpermittheregistration,entryintoserviceoruseofsuchvehicles,theyassigntothemnationalregistration/in-servicemaximumpermissiblemassesaccordingtotheirrelevantnationalmaximumauthorizedmasses.Forthedeterminationoftheseregistration/in-servicemaximumpermissiblemasses,noMemberStatemayrefusetoapplytheprocedureprovidedforinAnnexIV,shouldthemanufacturerrequestitsapplication.Article5BywayofderogationfromArticle2,MemberStatesmaysubmitloadableandretractableaxlestonationaltechnicalrequirements.However,noMemberStatemayrefusetoapplythetechnicalrequirementslaiddowninsection3ofAnnexIVshouldthemanufacturerrequesttheirapplication.共110頁第11頁1997L0027——2003年4月15日—002.001▼B歐洲共同體委員已采用本指令:第1條對于本指令,“車輛”指的是除了M1類的車輛之外,在指令70/156/EEC附件II第2條中所定義的任一機(jī)動車或掛車第2條如果質(zhì)量和尺寸符合附錄I設(shè)定的要求,各成員國均不得以質(zhì)量和尺寸為理由拒絕給車輛發(fā)放EEC型式認(rèn)證或國內(nèi)型式認(rèn)證,或者拒絕或禁止其銷售、注冊、運(yùn)營或在路面使用。第3條但是,如果已經(jīng)發(fā)放了根據(jù)本指令的認(rèn)證,并得到了第7條中所述的削減,并且該削減與該成員國的國內(nèi)有效要求相沖突,則成員國可以拒絕未該型式車輛發(fā)放國內(nèi)型式認(rèn)證,或者拒絕或禁止其銷售、注冊、投入使用或車輛的使用,或可認(rèn)為其合格證按照指令70/156/EEC第7條(1)無效,或只對不可分荷載車架發(fā)放認(rèn)證。第4條當(dāng)成員國依據(jù)本指令對車輛發(fā)放國內(nèi)型式認(rèn)證或準(zhǔn)許這種車輛注冊、投入運(yùn)營或使用,則應(yīng)根據(jù)其相關(guān)的國內(nèi)最大批準(zhǔn)質(zhì)量為其分配國內(nèi)注冊/運(yùn)營最大允許質(zhì)量。要確定這些注冊/運(yùn)營最大許可質(zhì)量,如果廠商要求應(yīng)用,則各成員國不可拒絕采用附件IV中給出的程序。第5條經(jīng)過第2條的削減,成員國可以按國內(nèi)技術(shù)要求提交可承載及可收縮車橋。但是,如果廠商要求應(yīng)用,則各成員國不得拒絕采用附件IV第3部分給出的技術(shù)要求。共110頁第12頁1997L0027—N—15.04.2003—002.001Article6BywayofderogationfromArticle2andsection7.3.2.1ofAnnexI,MemberStatesmayrefusetograntnationaltype-approvalof,orrefuseorprohibitthesale,registrationorentryintoserviceoruseofbusesorcoachesthewidthofwhichexceeds2,50muntil31December1999,asprovidedbyArticle9ofDirective96/53/EC.Article7BywayofderogationfromArticle2andsection7.3ofAnnexI,andwithouttherequirementsofsection7.6ofAnnexIhavingtobefulfilled,MemberStatesmayapprovevehicleswithdimensionsexceedingthoselaiddowninthosesections.Detailsofthederogationshallbeincludedinthetype-approvalcertificateinAnnexIIItothisDirectiveandtheprovisionsofArticle3shallapply.Article8Directive70/156/EECisamendedasfollows:(a)AnnexIissupplementedasfollows:1.Footnote(j)shallbesupplementedasfollows:'forvehiclesotherthanthoseofcategoryM1,Directive97/27/EC,AnnexI,section2.4.1'.2.Footnote(k)shallbesupplementedasfollows:'forvehiclesotherthanthoseofcategoryM1,Directive97/27/EC,AnnexI,section2.4.2'.3.Footnote(l)shallbesupplementedasfollows:'forvehiclesotherthanthoseofcategoryMpDirective97/27/EC,AnnexI,section2.4.3'.(b)Item48ofAnnexIVisreplacedbythefollowingtext:M1M2M3N1N2N3O1O2O3O448referredtoinL233XXXXXXXXX'共110頁第13頁1997L0027——2003年4月15日—002.001▼B第6條經(jīng)過第2條和附件I第7.3.2.1節(jié)的削減,到1999年12月31日,如指令96/53/EC第9條所述,各成員國不可拒絕為客車或?qū)挾瘸^2,50米的大客車發(fā)放國內(nèi)型式認(rèn)證,或者拒絕或禁止其銷售、注冊、投入運(yùn)營或使用。第7條經(jīng)過第2條以及附件I第7.3節(jié)的削減,在未滿足附件I第7.6節(jié)的要求時(shí),成員國也可以為尺寸超過本節(jié)給定尺寸的車輛發(fā)放認(rèn)證。本指令附件III中的型式認(rèn)證證書應(yīng)包括削減細(xì)節(jié),并應(yīng)采用第3條的規(guī)定。第8條指令70/156/EEC修正如下:(a)附件I補(bǔ)充如下:1.腳注(j)應(yīng)該補(bǔ)充如下:“對于除M1類之外的車輛,指令97/27/EC、附件I,第2.4.1節(jié)”。2.腳注(k)應(yīng)該補(bǔ)充如下:“對于除M1類之外的車輛,指令97/27/EC、附件I,第2.4.2節(jié)”。3.腳注(l)應(yīng)該補(bǔ)充如下:“對于除Mp類之外的車輛,指令97/27/EC、附件I,第2.4.3節(jié)”。(b)附件IV中第48條由下文替代:M1M2M3N1N2N3O1O2O3O448L233XXXXXXXXX'共110頁第14頁1997L0027—N—15.04.2003—002.001▼BArticle91.MemberStatesshallbringintoforcethelaws,regulationsandadministrativeprovisionsnecessarytocomplywiththisDirectiveby22July1999atthelatest.TheyshallforthwithinformtheCommissionthereof.WhenMemberStatesadoptthesemeasures,theyshallcontainareferencetothisDirectiveorshallbeaccompaniedbysuchreferenceontheoccasionoftheirofficialpublication.ThemethodsofmakingsuchareferenceshallbelaiddownbytheMemberStates.2.MemberStatesshallcommunicatetotheCommissionthetextsofthemainprovisionsofnationallawwhichtheyadoptinthefieldgovernedbythisDirective.Article10ThisDirectiveshallenterintoforceonthe20thdayfollowingitspublicationintheOfficialJournaloftheEuropeanCommunities.Article11ThisDirectiveisaddressedtotheMemberStates.ANNEXI1.ThisDirectiveappliestothemasse
