6.12.2003ENOfficialJournaloftheEuropeanUnionL321DIRECTIVE2003/102/ECOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof17November2003relatingtotheprotectionofpedestriansandothervulnerableroadusersbeforeandintheeventofacollisionwithamotorvehicleandamendingCouncilDirective70/156/EECTHEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle95thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)InordertoreducethenumberofroadaccidentcasualtiesintheCommunity,itisnecessarytointroducemeasuressoastoimprovetheprotectionofpedestriansandothervulnerableroadusersbeforeandintheeventofacollisionwiththefrontofamotorvehicle.(2)Apackageofpassiveandactivemeasuresforimprovingsafety(avoidanceofaccidentsandreductionofsecondaryeffectsbytrafficcalmingandinfrastructureimprovements)forvulnerableroadusers,suchaspedestrians,cyclistsandmotorcyclists,isurgentlyneededintheframeworkoftheroadsafetyactionprogramme.(3)Theinternalmarketcomprisesanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalmustbeensuredandtothatendaCommunitytype-approvalsystemformotorvehiclesisinplace;thetechnicalrequirementsforthetype-approvalofmotorvehicleswithregardtopedestrianprotectionshouldbeharmonisedtoavoidtheadoptionofrequirementsthatdifferfromoneMemberStatetoanotherandtoensuretheproperfunctioningoftheinternalmarket.(1)OJC234,30.9.2003,p.10.(2)OpinionoftheEuropeanParliamentof3July2003(notyetpublishedintheOfficialJournal)andCouncilDecisionof4November2003(notyetpublishedintheOfficialJournal).共32頁第1頁L321歐盟公報6.12.2003歐洲議會及委員會指令2003/102/EC2003年11月17日關(guān)于在與車輛發(fā)生碰撞前和發(fā)生碰撞時對行人和其它易受傷害的道路使用者的保護,以及修訂委員會指令70/156/EEC歐洲議會和歐盟理事會,在考慮到歐洲共同體成立時的條約,尤其是該條約第95條,委員會的提議,經(jīng)濟和社會委員會的意見(1),根據(jù)條約第251條給出的流程(2),鑒于:(1)為了降低共同體內(nèi)交通事故傷亡的數(shù)量,必須采取措施以提高行人及其它弱勢道路使用者在與汽車前部發(fā)生碰撞時及碰撞之前的安全性。(2)對于弱勢道路使用者,如行人、騎機車者和騎摩托車者來說,迫切需要在公路安全動作計劃框架中推出一套主動及被動措施來提高安全性(通過穩(wěn)定交通和改進基礎(chǔ)設(shè)施來避免事故并減少副效應(yīng))。(3)鑒于該內(nèi)部市場應(yīng)無內(nèi)部國界限制,在此區(qū)域內(nèi)應(yīng)費用已在內(nèi)確保物品、人員、服務(wù)和資本自由流動,并且為汽車采用適當?shù)腅EC型式認證系統(tǒng);應(yīng)該對關(guān)于行人保護的汽車型式認證技術(shù)要求進行協(xié)調(diào)以避免成員國之間采用不同的要求,并確保內(nèi)部市場的正確運轉(zhuǎn)。(1)OJC234,2003年9月30日,第10(2)2003年7月3日歐洲議會意見(公報中尚未出版)以及2003年11月4日理事會決定(公報中尚未出版)。共32頁第2頁6.12.2003ENOfficialJournaloftheEuropeanUnionL321(4)Pedestrianprotectionobjectivescanbeachievedbyacombinationofactiveandpassivesafetymeasures;therecommendationsbytheEuropeanEnhancedVehicle-SafetyCommittee(EEVC)ofJune1999arethesubjectofawideconsensusinthisarea;thoserecommendationsproposeperformancerequirementsforthefrontalstructuresofcertaincategoriesofmotorvehiclestoreducetheiraggressiveness;thisDirectivepresentstestsandlimitvaluesbasedontheEEVCrecommendations.(5)TheCommissionshouldexaminethefeasibilityofextendingthescopeofthisDirectivetovehicleswithamaximummassofupto3,5tonnes,andreportitsfindingstotheEuropeanParliamentandtotheCouncil.(6)ThisDirectiveshouldbeconsideredasoneelementofabroaderpackageofmeasures,tobeundertakenbytheCommunity,theindustryandtherelevantauthoritiesoftheMemberStates,onthebasisofexchangesinbestpractice,inordertoaddresspre-crash(active),in-crash(passive),andpost-crashsafetyofpedestriansandothervulnerableroadusers,withrespecttoroadusers,vehiclesandinfrastructure.(7)Inviewofthespeedoftechnologicaldevelopmentinthisarea,alternativemeasuresatleastequivalentintermsofactualeffectivenesstotherequirementsofthisDirective—eitherpassiveoracombinationofactiveandpassivemeasures—maybeproposedbytheindustryandshallbeassessedfollowingafeasibilitystudycarriedoutbyindependentexpertsby1July2004;theintroductionofalternativemeasuresatleastequivalentintermsofactualeffectivenesswouldrequireadaptingoramendingthisDirective.(8)Becauseoftheongoingresearchandtechnicalprogressintheareaofpedestrianprotection,itisappropriatetointroduceadegreeofflexibilityinthisfield.Accordingly,thisDirectiveshouldestablishthefundamentalprovisionsregardingpedestrianprotectionintheformofteststobecompliedwithbynewtypesofvehiclesandbynewvehicles.ThetechnicalprescriptionsfortheapplicationofsuchtestsshouldbeadoptedbyCommissiondecision.(9)Therapidlyadvancingtechnologyinactivesafetymeansthatcollisionmitigationandavoidancesystemscouldprovidemajorsafetybenefits,forexampleinreducingcollisionspeedandadjustingimpactdirection.ThedevelopmentofsuchtechnologiesshouldbeencouragedbythisDirective.共32頁第3頁L321歐盟公報6.12.2003(4)可以通過采用整套主動和被動安全措施來實現(xiàn)行人保護目標;歐洲汽車安全強化委員會(EEVC)1999年6月的建議在本領(lǐng)域得到一致認同;該建議提出了某些種類汽車的正面結(jié)構(gòu)的性能要求以降低其攻擊性;本指令基于EEVC的建議給出了測試和極限值。(5)委員會應(yīng)該檢查將本指令的應(yīng)用范圍擴展到最大質(zhì)量達3,5噸車輛的可行性,并將結(jié)果報告給歐洲議會和理事會。(6)本指令應(yīng)視為一套更廣泛的措施,由共同體、成員國行業(yè)及相關(guān)機構(gòu)基于最實用的方式來實施,以便根據(jù)道路使用者、車輛和基礎(chǔ)設(shè)施來確定預(yù)碰撞(主動)、碰撞中(被動)及碰撞后行人及其它弱勢道路使用者的安全性。(7)考慮到該領(lǐng)域的技術(shù)發(fā)展速度,按照至少與本指令要求的實際有效性等效的替代措施-被動或主動與被動措施的組合-行業(yè)內(nèi)可以給出建議并根據(jù)2004年7月1日獨立專家進行的可行性研究進行評估;與實際有效性至少等效的替代措施的引用要求匹配或修正該指令。(8)由于在行人保護領(lǐng)域不斷進行的研究和技術(shù)進展,因此應(yīng)該在該領(lǐng)域推出一定的靈活度。因此,本指令應(yīng)該以符合新型車或新車的測試形式來確定關(guān)于行人保護的基本條例。應(yīng)該由委員會決定來采用這種測試應(yīng)用的技術(shù)說明。(9)主動安全的快速先進技術(shù)指的是減輕及避免碰撞的系統(tǒng)可以提供較好的安全優(yōu)勢,例如降低碰撞速度并調(diào)整撞擊方向。本指令應(yīng)該鼓勵這種技術(shù)的開發(fā)。共32頁第4頁6.12.2003ENOfficialJournaloftheEuropeanUnionL321(10)TheassociationsrepresentingtheEuropean,JapaneseandKoreanmotorvehiclemanufacturershavemadecommitmentstostartapplyingtheEEVCrecommendationsconcerninglimitvaluesandtests,oragreedalternativemeasuresofatleastequivalenteffect,asfrom2010,andafirstsetoflimitvaluesandtestsasfrom2005tonewtypesofvehiclesandtoapplythefirstsetofteststo80%ofallnewvehiclesasfrom1July2010,to90%ofallnewvehiclesasfrom1July2011andtoallnewvehiclesasfrom31December2012.(11)ThisDirectiveshouldalsocontributetoestablishingahighlevelofprotectioninthecontextoftheinternationalharmonisationoflegislationinthisarea,whichstartedunderthe1998AgreementoftheUN/ECEconcerningtheestablishmentofglobaltechnicalregulationsforwheeledvehicles,equipmentandpartswhichcanbefittedand/orbeusedonwheeledvehicles.(12)ThisDirectiveisoneoftheseparateDirectiveswhichhavetobecompliedwithinordertoconformtotheECtype-approvalprocedureestablishedbyCouncilDirective70/156/EECof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetype-approvalofmotorvehiclesandtheirtrailers(1).(13)Directive70/156/EECshouldthereforebeamendedaccordingly,HAVEADOPTEDTHISDIRECTIVE:Article11.ThisDirectiveshallapplytothefrontalsurfacesofvehicles.ForthepurposeofthisDirective,'vehicle'meansanymotorvehicleasdefinedinArticle2ofandAnnexIItoDirective70/156/EEC,ofcategoryM1,ofamaximummassnotexceeding2,5tonnes,andN1derivedfromM1,ofamaximummassnotexceeding2,5tonnes.2.ThepurposeofthisDirectiveistoreduceinjuriestopedestriansandothervulnerableroaduserswhoarehitbythefrontalsurfacesofthevehiclesdefinedinparagraph1.(1)OJL42,23.2.1970,p.1.DirectiveaslastamendedbyRegulation(EC)No807/2003(OJL122,16.5.2003,p.36).共32頁第5頁L321歐盟公報6.12.2003(10)代表歐洲、日本和韓國汽車廠商的協(xié)會已經(jīng)同意從2010年開始采用關(guān)于極限值和測試的EEVC建議,或同意采取至少等效的替代措施,第一類極限值和測試于2005年在新車型上進行,并且從2010年7月1日開始,在80%的新車上采用第一類測試,從2011年7月1日其增至90%,2012年12月31日起全部采用。(11)本指令也有助于確定本領(lǐng)域國際間協(xié)調(diào)一致的高級防護法規(guī),該法規(guī)基于1998年UN/ECE關(guān)于為輪式車輛、以及可以安裝和/或用于輪式車輛的設(shè)備和部件的全球技術(shù)條例所確定的協(xié)議。(12)本指令是必須履行的單獨指令,這是為了符合由1970年2月6日委員會指令70/156/EEC關(guān)于汽車及其掛車型式認證的成員國法律協(xié)調(diào)所確定的EEC型式認證過程(1)。(13)指令70/156/EEC也應(yīng)相應(yīng)做出修正,已采用本指令:第1條1.本指令適用于車輛的正向表面。在本指令中,‘車輛’指的是指令70/156/EEC附件II第2條所定義的最大質(zhì)量不超過2,5噸的任一M1類汽車,以及源自M1,最大質(zhì)量不超過2,5噸的N1類汽車。2.本指令的目的是降低與第1段所定義的車輛正面撞擊時對行人及其他弱勢道路使用者的損傷。(1)OJL42,1970年2月23日,第1頁。由條例(EC)No807/2003(OJL122,2003年5月16日,第36頁共32頁第6頁6.12.2003ENOfficialJournaloftheEuropeanUnionL321Article21.Witheffectfrom1January2004noMember—refuse,inrespectofatypeofvehicle,tograntECtype-approval,ornationaltype-approval,or—prohibittheregistration,saleorentryintoserviceofvehicles,providedthatthevehiclescomplywiththetechnicalprovisionssetoutinsection3.1.or3.2.ofAnnexI.2.Witheffectfrom1October2005,MemberStatesshallnolongergrant:—ECtype-approval,or—nationaltype-approval,exceptwheretheprovisionsofArticle8(2)ofDirective70/156/EECareinvoked,foranytypeofvehicleongroundsrelatingtopedestrianprotectionifthetechnicalprovisionssetoutinsection3.1.or3.2.ofAnnexIarenotcompliedwith.3.Paragraph2shallnotapplytovehicleswhichdonotdifferwithrespecttotheiressentialaspectsofbodyworkconstructionanddesignforwardoftheApillarsfromvehicletypeswhichhavebeengrantedECtype-approvalornationaltype-approvalbefore1October2005andwhichhavenotalreadybeenapprovedunderthisDirective.4.witheffectfrom1September2010,MemberStatesshallnolongergrant:—ECtype-approval,ornationaltype-approvalExceptwheretheprovisionsofArticle8(2)ofDirective70/156/EECareinvoked,foranytypeofvehicleongroundsrelatingtopedestrianprotectionifthetechnicalprovisionssetoutinsection3.2.ofAnnexItothisDirectivearenotcompliedwith.5.Witheffectfrom31December2012,MemberStatesshall:—considercertificatesofconformitywhichaccompanynewvehiclesinaccordancewiththeprovisionsofDirective70/156/EECtobenolongervalidforthepurposesofArticle7(1)ofthatDirective,and—prohibittheregistration,saleandentryintoserviceofnewvehicleswhicharenotaccompaniedbyacertificateofconformityinaccordancewithDirective70/156/EEC,ongroundsrelatingtopedestrianprotectionifthetechnicalprovisionssetoutinsection3.1.or3.2.ofAnnexIarenotcompliedwith.6.Witheffectfrom1September2015,MemberStatesshall:—considercertificatesofconformitywhichaccompanynewvehiclesinaccordancewiththeprovisionsofDirective70/156/EECtobenolongervalidforthepurposesofArticle7(1)ofthatDirective,and—prohibittheregistration,saleandentryintoserviceofnewvehicleswhicharenotaccompaniedbyacertificateofconformityinaccordancewithDirective70/156/EEC,ongroundsrelatingtopedestrianprotectionifthetechnicalprovisionssetoutinsection3.2.ofAnnexIarenotcompliedwith共32頁第7頁L321歐盟公報6.12.2003第2條1.從2004年1月1日生效之日起,如果該車輛符合附件I第3.1節(jié)或3.2節(jié)給出的技術(shù)條件,成員國不得以行人保護為理由:—拒絕對某種類型的車輛批準EEC型式認證或國內(nèi)型式認證,或者—禁止車輛的銷售、登記或投入運營,2.從2005年10月1日生效起,成員國不應(yīng)該再批準:—EEC型式認證,或—國內(nèi)型式認證,如果未滿足附件I第3.1.節(jié)或3.2節(jié)的技術(shù)條件,但是如果對任一型式的車輛以行人保護為理由,引用了指令70/156/EEC第8條第2款的條例的除外。3.第2段不適用于車身結(jié)構(gòu)和A柱前方設(shè)計基本方面相同的車輛,這類車輛在已經(jīng)2005年10月1日之前批準了EEC型式認證或國內(nèi)型式認證,但尚未得到本質(zhì)量的認證。4.從2010年9月1日生效起,成員國不應(yīng)該再批準:—EEC型式認證,或—國內(nèi)型式認證,如果未滿足本指令附件I3.2節(jié)的技術(shù)條件,但是如果對任一型式的車輛以行人保護為理由,引用了指令70/156/EEC第8條第2款的條例的除外,5.從2012年12月31日生效之日起,如果不符合附件I第3.1.節(jié)或3.2.節(jié)給出的技術(shù)條件,成員國應(yīng)該以行人保護為理由應(yīng)認為新車隨附的符合指令70/156/EEC的合格證不再適用于該指令第7條(1)的用途,并且禁止未隨附合乎指令70/156/EEC合格證的新車的注冊、銷售和投入運營,6.從2015年9月1日生效之日起,如果不符合附件I第3.2節(jié)給出的技術(shù)條件,成員國應(yīng)該以行人保護為理由,:—應(yīng)認為新車隨附的符合指令70/156/EEC的合格證不再適用于該指令第7條(1)的用途,并且—禁止未隨附合乎指令70/156/EEC合格證的新車的注冊、銷售和投入運營,如果不符合附件I第3.2節(jié)給出的技術(shù)條件,則以行人保護為理由。共72頁第8頁6.12.2003ENOfficialJournaloftheEuropeanUnionL321Article3SubjecttotheprovisionsofArticle2,MemberStatesshallensurethatthetestslaiddowninsection3.1.or3.2.ofAnnexIarecarriedoutinaccordancewiththetechnicalprescriptionstobespecifiedbyCommissiondecision.Article4EverymonththeapprovalauthoritiesoftheMemberStatesshalleachsendtotheCommissionacopyofthetype-approvalcertificate,themodelforwhichissetoutinAppendix2toAnnexII,inrespectofeachvehicletheyhaveapprovedinaccordancewiththisDirectiveduringthatmonth.Article51.TheCommission,actingonthebasisofrelevantinformationcommunicatedbytheapprovalauthoritiesandinterestedpartiesaswellasofindependentstudies,shallmonitortheprogressmadebytheindustryintheareaofpedestrianprotection,andshallcarryout,by1July2004,anindependentfeasibilityassessmentconcerningtheprovisionsofAnnexI,section3.2,andinparticularalternativemeasures—eitherpassiveoracombinationofactiveandpassivemeasures
