SomeAmericanIndiantribeshavealsoestablishedwaterrightsthroughthecourtsbasedontheirtraditionaldiversionanduseofcertainwaterspriortotheUnitedStates’acquisitionofsovereignty.Forexample,theRioGrandepueblosalreadyexistedwhentheUnitedStatesacquiredsovereigntyoverNewMexicoin1848.AlthoughtheyatthattimebecamepartoftheUnitedStates,thepueblolandsneverformallyconstitutedapartoffederalpubliclands;inanyevent,notreaty,statute,orexecutiveorderhaseverdesignatedorwithdrawnthepueblosfrompubliclandsasAmericanIndianreservations.Thisfact,however,hasnotbarredapplicationoftheWintersdoctrine.WhatconstitutesanAmericanIndianreservationisaquestionofpractice,notoflegaldefinition,andthepuebloshavealwaysbeentreatedasreservationsbytheUnitedStates.ThispragmaticapproachisbuttressedbyArizonav.California(1963),whereintheSupremeCourtindicatedthatthemannerinwhichanytypeoffederalreservationiscreateddoesnotaffecttheapplicationtoitoftheWintersdoctrine.Therefore,thereservedwaterrightsofPuebloIndianshavepriorityoverothercitizens’waterrightsasof1848,theyearinwhichpueblosmustbeconsideredtohavebecomereservations.

說一下做閱讀時的方法：

1.掃一遍文章，大概了解文章內容并注意關鍵字句，在心里大概記下來。這個步驟不超過50s-1min。

2.讀題目，在題目里找關鍵詞，然后結合通讀文章時大概記下來的關鍵字句，回到原文定位細讀。這個步驟不超過40s。

3.根據(jù)剛剛細讀文章定位處獲取到的信息，排除掉答案中的無關選項和錯誤選項，這個步驟大概1min左右。

文章里的黑體就是我第一遍讀文章的時候注意到的我認為的“關鍵字句〞。

文章脈絡：

首先第一段說1908年最高法院裁定流經F地或者其周邊的水使用權保存給印第安人，依據(jù)是以前的條約Winters。雖然這個條約沒有清楚寫明水權，不過法院覺得政府當初設保存地的時候就是為了防止土地荒蕪而有意保障印第安人的水權。文章來源：智課培訓然后說到后來的決定引申到Winters法案，說了政府為了特定目的留出水資源的條件是(1)這些地在政府的直接管轄范圍之內(2)這些土地從政府的公共用地中單列出來用以其他的特殊目的;(3)政府在設立保存地時也有意保存用水權的意圖。

然后第二段舉了個例外：一些部落因為歷史遺留問題在美國成立之前就享有水權，舉了R部落做例子。因為盡管新墨西哥成為了美國的一局部，R部落從來沒有成為政府的公共用地，也沒有任何法律檔說這塊地是公共用地，但是卻不影響Winters法案的適用性。

但是R部落卻一向被美國政府視為保存地，因為事實上什么組成保存地是一個實際操作問題，而不是法律定義的問題。之后作者舉出一個1963年ArizonaVSCalifornia的案例印證，在該案例中法院表示，無論保存地是通過何種方式建立起來的，都不影響Winters對它的適用性。因此，從1848年起，即pueblo被認為是保存地的那一年開始，R部落的人都享有優(yōu)先用水權。
