對工程承包商保險責任的要求（中英文對照）InsurancetobetakenoutbytheContractor.承包商承擔保險：Inaccordancewiththeprovisionsofcontract,theContractorshallatitsexpensetakeoutandmaintainineffect,orcausetobetakenoutandmaintainedineffect,duringtheperformanceoftheContract,theinsurancesetforthbelowinthesumsandwiththedeductiblesandotherconditionsasspecified.TheidentityoftheinsurersandtheformofthepoliciesshallbesubjecttotheapprovalofEMPLOYER.ThecostsforinsurancetobeincludedinBidprice依照合同之規(guī)定，在合同履行期間，承包商負責投?；虼俪赏侗Ｒ员３衷摫ｋU有效，保險金額、扣除條款及其他條件規(guī)定如下。保險公司和保險單形式均須獲得業(yè)主正式批準。標價含保險費。1.ConstructionandErectionInsurance施工和安裝保險ThefollowinginsuranceshallbetakenoutandmaintainedbytheContractorduringtheperiodofdelivery/installation/construction/fieldtesting/commissioning/trialoperationattheSiteoftheWorkscoveredundertheContract:依照合同規(guī)定，承包商須在現(xiàn)場工程交付/安裝/施工/現(xiàn)場測試/調(diào)試/試運行期間投保和保持以下保險：(a)ErectionAllRisksInsurancetocovertheentireWorks(permanentand/ortemporary)fromanyandallkindsofdamageswhichitisstandardinternationalpracticeforacontractortoinsureundersuchapolicy;“安裝一切險”：范圍含全部工程保險（永久和/或臨時性工程保險），即承包商依照保險單規(guī)定按標準國際慣例投保的所有損害保險；(b)"Third-PartyLiabilityInsurance"tocoverinjuryordeathtopersonsordamagestopropertycausedbytheWorksorbytheContractor'svehicles,toolsand/orequipmentorperEmployerpersonnel;“第三方責任險”：范圍包括由于工程施工或承包商的車輛、工具和/或設(shè)備或工作人員造成的人員傷亡或財產(chǎn)損害；(c)"Workman'sCompensationInsurance".ThistypeofinsuranceisrequiredunderLawtobesecuredbytheContractorforhisemployees.TheContractorshall,therefore,faithfullycomplywiththerequirementsofsaidlaw.依照法律規(guī)定，承包商須保證為其雇員提供“職工賠償保險”。因此，承包商應(yīng)如實遵照上述法律要求為其雇員投保職工賠償保險。(d)AutomobileLiabilityInsurance“機動車責任保險”：CoveringuseofallvehiclesusedbytheContractororitsSubcontractors(whetherornotownedbythem)inconnectionwiththeexecutionoftheWorks.“機動車責任保險”：范圍包括承包商或其分包商為執(zhí)行施工使用的所有機動車輛(無論所述機動車輛是否屬于承包商或其分包商所有)的責任保險。TheContractorhastheresponsibilitytoensuretheinsurancesasmentionedabovebythewaytoemployatrustyInsuranceCompanywhichisacceptabletoEMPLOYER.TheseinsuranceswillbeeffectivetoFinalAcceptanceCertificateissuedbyOwnerspecifiedinContractAgreement.承包商負責確保提供上述所有保險，并投保守信可靠的、業(yè)主接受的保險公司。上述保險的有效期至業(yè)主發(fā)出合同協(xié)議規(guī)定的最終驗收證書之日。Beforecommencingthesoilinvestigationworksatsite,theContractorshallsubmittheaboveInsurancePoliciestogetherwiththeofficialreceiptsevidencingpremiumpayments.在現(xiàn)場進行土地勘察工作之前，承包商應(yīng)連同正式收據(jù)一起提交上述保險單，以證明其已經(jīng)支付保險金。BeneficiaryforErectionAllRisksshallbetheContractorwithinthePlantfence,andEMPLOYERoutofthePlantfence;BeneficiaryforThirdPartyLiabilityRiskshallbeEMPLOYER.安裝一切險受益人為電廠圍墻內(nèi)的承包商，以及電廠圍墻外的業(yè)主；第三者責任險受益人為業(yè)主。DeductibleslimitforErectionAllRisks:安裝一切險的免賠額限制如下：USD200,000.00A.O.AforLossorDamageduetoActsofGod由于自然災(zāi)害造成的任何一次事故的損失或損害扣除金額為200,000.00美元；USD200,000.00A.O.AforLossorDamageduetoCommissioning/TestingandMaintenancecausedbyTurbine由于汽輪機的調(diào)試/測試和維修期間發(fā)生造成的任何一次事故的損失或損害扣除金額為200,000.00美元；DeductiblelimitforThirdPartyLiabilitiesapplicableforpropertydamage:USD5000.00A.O.A適用于財產(chǎn)損害的第三方責任險的免賠額限制為：一次事故5000.00美元。DeductiblelimitforThirdPartyLiabilitiesapplicableforpersonalinjury:Nil適用于人員傷害險的第三方責任險的免賠額限制為：零美元。BeforePAC,theOwnershallbearthedeductiblesforthelossand/ordamagewhichiscausedbyreasonoftheOwner(includinghisemployeeandconsultant);Ifthelossand/ordamageiscausedbyanythirdparty,theContractorshallbearthedeductiblesforthelossand/ordamagewhichcannotbeclaimedfromtheinsurer;TheContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreason(excludingForceMajeure)；FromPACtoFAC,theContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbytheContractor.EMPLOYERshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreasons.臨時驗收之前，業(yè)主須承擔由于其(包括業(yè)主雇員和顧問人員)造成的損失和/損害的免賠額；若上述損失和/損害由于任何第三方造成，承包商須承擔造成的損失和/損害的免賠額（該部分保險金不能由保險公司賠付）。承包商還須承擔由于任何其他原因（不含不可抗力因素）造成的損失和/損害的免賠額；臨時驗收到最終驗收期間，承包商須承擔其自己造成的損失和/損害的免賠額。由于其他原因造成的損失和/損害的免賠額則由業(yè)主承擔。TheContractor確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的shallindemnifyEMPLOYERagainstallactions,suits,claim?s,demands,costorexpensesarisingfromorinconnectionwithanyaccident,illnessordeath(otherthansuchasmaybeattributabletoEMPLOYER,itsagentsorservEmployerants)topersonsemployedbytheContractororhisSubcontractoratSite.承包商應(yīng)確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的（不是由于業(yè)主、其代理商或雇員引起）所有訴訟、訟案、索賠、要求、成本或費用。TheContractorshallindemnifyEMPLOYERagainstalllossand/ordamagearisingfromitsimproperdesignfortheWorks.承包商須向由于其工程設(shè)計不當對業(yè)主造成的所有損失和/損害提供賠償。TheContractorshallinitiateandsuccessfullyobtainsecuritypaymentscoveringlossesand/ordamagesarisingoutoftheContract.FailuretoinitiateEmployerorsettletheclaimwithinareasonableperiodoftimeshallconstitutesufficientgroundsforEMPLOYERtoexerciseitsrightsundertheContract.ShouldtheContractorfailorrefusetomaintainitsinsuranceabove,EMPLOYERwillsecure,renewormaintainsaidinsurance,andanyandallexpensesincurredtherebyshallbedeductedfromanyandallsumsdueormaybecomeduetotheContractor.ThePerformanceBondsubmittedbytheContractorshallalsobeusedwherenecessarytocoversuchexpenses.承包商應(yīng)發(fā)起和獲得所有損失和/損害的賠償金。若承包商未能在合理的期限內(nèi)開始或解決該索賠，則業(yè)主有足夠理由履行其合同賦予的權(quán)利。若承包商未能或拒絕進行上述投保，則業(yè)主將提供、續(xù)?；虮３稚鲜霰ｋU有效，但由此招致的全部費用從任何或所有到期付款中扣除。根據(jù)需要，可以從承包商提交的履行保函中扣除上述費用。2.AllRiskInsuranceforTransportationofEquipmentandMaterials.設(shè)備和材料運輸一切險保險WithoutprejudicetotheContractor'sobligationsandresponsebilitiesundertheContract,theContractorshallinsuretheequipmentandmaterialstobesuppliedanddeliveredwithareputableinsurancecompanyacceptabletoEMPLOYER.TheinsuranceshallbetakenoutinthejointnamesoftheContractorandEMPLOYERfortheirrespectiverightsandinterests,andshallcoverallRisksincludingseaandlandtransport,andwarrisk,fromplaceoforigintotheSite.在與合同項下規(guī)定的承包商義務(wù)和責任不相沖突的情況下，承包商應(yīng)為將提供和交付的設(shè)備和材料投保一切險保險，承包商應(yīng)投保信用可靠的、業(yè)主接受的保險公司。由承包商和業(yè)主依照各自的合同權(quán)利和利益聯(lián)名共同投保，一切險范圍為從原產(chǎn)地到工程現(xiàn)場之間的所有運輸保險，包括海運險、陸運險、戰(zhàn)爭險。Theinsurancecoverageshallbeonehundredandtenpercent(110%)ofthedeliveredcostandinsurancepremiumsshallbepaidbytheContractor.Undersuchinsurance,theindemnitymustbepayableinUSdollars,freelyusabletoreplaceorrepairsuchgoods.TheContractor,actingasagentforEMPLOYER,shallinitiateproperactionandpursuesettlementregardinginsuranceclaimswheneverdamagesand/orlossesareinflictedonthegoods.TheContractorshallbeauthorizedtoreceivetheindemnitydirectlyfromtheinsurancecompaniesunlessotherwisedirectedbyEMPLOYER.保額為交付的材料或貨物的價值的百分之一十（110%），保費由承包商支付。依照本保險單之規(guī)定，保險賠付必須采用美元支付，其應(yīng)能夠自由使用，以更換或修復(fù)保險賠付部分的貨物。作為業(yè)主的代理人，當貨物出現(xiàn)任何損害和/或損失時，承包商應(yīng)采取適當?shù)男袆雍娃k法處理任何有關(guān)保險索賠。除業(yè)主指示外，承包商應(yīng)獲得授權(quán)，以便直接接受保險公司的賠付。EMPLOYERshallbenamedasco-insuredunderallinsurancepoliciestakenoutbytheContractorpursuanttoGC34.1,exceptforWorkman’sCompensation，andtheContractor'sSubcontractorsshallbenamedasco-insuredsun
