航空包機運輸條款(中英文對照)航空包機運輸條款TERMSANDCONDITIONSFORTHETRANSPORTOFAIRCHARTERFLIGHTSTABLEOFCONTENTS第一章適用范圍Chapter1ApplicableScope第二章包機手續(xù)Chapter2CharterProcedure第三章乘機手續(xù)Chapter3BoardingProcedure第四章標(biāo)準(zhǔn)空中服務(wù)Chapter4StandardAirService第五章標(biāo)準(zhǔn)地面服Chapter5StandardGroundService第六章收費服務(wù)Chapter6PaymentServices第七章財務(wù)條款Chapter7TermsofFinance第八章保險條款Chapter8TermsofInsurance第九章價格條Chapter9TermsofPrice第十章延誤條款Chapter10TermsofDelay第十一章?急救條款Chapter11TermsofFirstAid第十二章?衛(wèi)星通信收費標(biāo)準(zhǔn)Chapter12ChargeStandardforSatelliteCommunicationService第十三章?不可抗力情況下收費原則Chapter13ChargingPrinciplesforForceMajeureCases第十四章?危險地區(qū)飛行收費Chapter14ChargeforFlightinDangerousRegion第十五章?特殊機場飛行條款Chapter15FlightTermsofSpecialAirports第十六章?航務(wù)申請條款Chapter16TermsofAirportApplication第十七章?行李物品攜帶條款Chapter17Luggageoritemscarryingterms第十八章?定義Chapter18Definition部分章節(jié)示例如下：第五條承運人根據(jù)包機人飛行意向提供報價單。Article5TheCARRIERshallprovidequotationinaccordancewiththeflightintentionoftheCHARTERER.包機人確認飛行后承運人為包機人提供包機運輸合同及《乘客保障信息單》（客戶填寫內(nèi)容包括航線、日期、時刻、人數(shù)、乘客姓名、證件名稱、證件號碼、行李重量、接送車輛、飛行各站聯(lián)系人及聯(lián)系方式、機上餐食要求等其他服務(wù)要求的詳細信息,詳見附件六）。AftertheCHARTERERhasconfirmedtheflight,theCARRIERshallprovidetheCHARTERERwithCharterFlightContractandFlightServiceInformationForm(seeAppendixVIforthecontentfilledinbytheclient,includingthespecificinformationofflightroute,date,time,passengernumber,passengername,credentialname,credentialNo.,luggageweight,pickingupvehicle,contactpersonandcontactinformationofeachflightstation,flightcateringrequirementsandotherservicerequirements).(一)如包機人在飛行過程中出現(xiàn)起飛時刻，飛行日期，任務(wù)航段、乘客信息、各地機場接送機聯(lián)系人或車輛等一切和飛行有關(guān)的信息變更，包機人有責(zé)任第一時間通知承運人。(1)Incasethere’schangeofinformationrelevanttotheflightincludingdeparturetime,flightdate,missionflightleg,passengerinformation,contractpersonforpickupserviceineachairport,orvehicle,theCHARTERERhastheresponsibilitytoinformtheCARRIERimmediately.(二)包機人應(yīng)保證每位乘客持有符合中國民航現(xiàn)行規(guī)定的有效證件，進出境乘客應(yīng)保證持有相關(guān)國家要求的有效旅行證件，國際飛行應(yīng)遵守各國航空管制規(guī)定和法律規(guī)定。(2)TheCHARTERERshallguaranteethateachpassengerholdsthevalidcredentialcomplyingwiththeexistinglawsandregulationsbyChinaCivilAviation.Thecrossingpassengershallguaranteetoholdvalidtravelcredentialsrequiredbyrelevantcountry,andinternationalflightshallfollowtheairtrafficcontrolstipulationsandlegalregulationsofeachcountry.(三)由于包機人原因（如身份證、護照等證件與本人身份不符，或攜帶民航和國家法律法規(guī)規(guī)定的危險品登機，或不能按合同規(guī)定時間準(zhǔn)時登機等）包機人未能按約定時間執(zhí)行或未能履行簽訂的飛行計劃，承運人不負責(zé)因此導(dǎo)致未能飛行產(chǎn)生的后果，對于飛行計劃中未執(zhí)行的部分包機款，承運人應(yīng)返還包機人，但包機人應(yīng)承擔(dān)未執(zhí)行該飛行任務(wù)而產(chǎn)生的實際費用。(3)TheCARRIERshallbeexemptedfromtheliabilityforbreachofContractforfailuretoimplementthescheduledflightmissioninlightofthereasonscausedbytheCHARTERER(suchascredential(IDorpassport)notbeingconsistentwithone’sidentity,carryinganydangerousgoodsprohibitedbycivilaviationandstatelawsandregulations,orpassenger’sdelayedboarding).TheCARRIERshallreturntheunimplementedcharterexpensetotheCHARTERER,butCHARTERERshallassumeanyexpensesarisingtherefrom.(四)包機人如租用多架承運人飛機，需事先將每架飛機乘坐的乘客名單提供給承運人。(4)IncasetheCHARTERERrentsmultipleaircrafts,he/sheshallprovideCARRIERwiththepassengerlistforeachaircraft.(五)根據(jù)民航有關(guān)規(guī)定，如乘客攜帶行李超過承運人機型限制范圍，承運人可協(xié)助乘客辦理地面轉(zhuǎn)運或儲存，費用由乘客自理。如乘客堅持要求攜帶超額行李乘坐公務(wù)機，承運人有權(quán)拒絕起飛。如乘客攜帶特殊行李請?zhí)崆白稍兂羞\人。(5)Accordingtotherelevantstipulationsbycivilaviation,incasethepassengercarriestheluggageexceedingthelimitedrangeofthejettype,theCARRIERmayassistthepassengeringroundtransferorstorageandtheexpenseshallbepaidbythepassenger.Ifthepassengerstillinsiststotaketheextraluggageonboard,thecarriershallbeentitledtorefusetoprovideflightservices.Incaseofspecialluggage,thepassengershallconsulttheCARRIERinadvance.(六)如因承運人原因無法安排合同中原定機型執(zhí)行飛行，承運人將免費為包機人升級至更高級別機型保障飛行，若因包機人拒絕機型調(diào)配，則簽訂的包機合同可被終止，雙方承擔(dān)各自的損失。承運人機型等級順序從低到高依次為“豪客系列→灣流200系列→灣流IV→灣流V→灣流450系列→達索7X→灣流550→BBJ1→BBJ2－ACJ”。（6）IncasetheplannedjettypeinthecontractisnotavailablebecauseoftheCARRIER,theCARRIERshallprovideahigherleveljettypefortheCHARTERER.IftheCHARTERERrefusestoacceptthejetadjustment,thecontractshallbeended.TheCHARTERERandtheCARRIERshouldassumetheirrespectiveexpensesderivingtherefrom.第六條包機人按照合同規(guī)定時間支付包機款。Article6TheCHARTERERshallpaythecharterexpenseinaccordancewiththeContract.第七條承運人為包機人在指定保險公司承保。Article7TheCARRIERshallunderwritefortheCHARTERERinspecifiedinsurancecompany.第八條承運人在起飛前一天向包機聯(lián)系人提供航線各機場地面代理聯(lián)系方式，由各機場地面代理與包機聯(lián)系人直接聯(lián)系并約定飛行當(dāng)日迎候乘客的時間和地點。Article8TheCARRIERshallprovidethechartercontactpersonwithcontactinformationofeachairport'sgroundagentonedaybeforetheflight,sothegroundagentcandirectlycontactthechartercontactpersontodecidethetimeandlocationtomeetthepassengers.第九條飛行當(dāng)日起飛前一至二小時確認乘客到達當(dāng)?shù)貦C場的時間，并通報各保障單位做好飛行前準(zhǔn)備，根據(jù)約定的時間，機場地面代理在約定地點接引乘客進場、協(xié)助乘客辦理相關(guān)入場手續(xù)。Article9Confirmthearrivaltimeoneortwohoursbeforethedepartureandinformallsupportunitstowellpreparefortheflight.Inaccordancewiththeagreedtime,theairportgroundagentmeetsandguidesthepassengerstoentertheairportatagreedlocationandhelpthemgothroughrelevantboardingprocedure.第十條執(zhí)行包機飛行。Article10Thechartertakestheflight.第十一條?飛機抵達目的地前當(dāng)?shù)氐孛娲硖崆芭c迎接乘客的接機人取得聯(lián)系，通知等候乘客的時間和地點。Article11Beforearrivingatthedestination,thelocalgroundagentshallcontactthepick-uppersoninadvancetoinformthepick-uptimeandlocation.第十二條?飛機降落后當(dāng)?shù)貦C場地面代理安排乘客出場并送乘客至前來接機的車輛旁。Article12Aftertheaircraftislanded,thelocalairportgroundagentshallarrangethepassengerstoexittheairportandsendthemtothepick-upvehicle.第十三條?飛行結(jié)束后承運人征詢包機人的飛行意見，承運人在接收到包機人提出的意見或投訴后需要在5個工作日內(nèi)給予包機人回復(fù)處理意見或辦法。Article13Aftertheflight,theCARRIERshallaskCHARTERERforideasorcommentsontheflightandprovidetreatmentplanormethodwithin5workdaysafterreceivingtheopinionorcomplaint.第三章乘機手續(xù)Chapter3BoardingProcedure第十四條?國內(nèi)飛行乘客需要在起飛前20分鐘抵達起飛地機場，國際飛行乘客需要在起飛前2小時抵達起飛地機場；Article14Thedomesticflightpassengershallarriveattheairport20minutesbeforethedeparture,andinternationalflightpassengershallarriveattheairport2hoursbeforethedeparture.第十五條?北京出港航班：送乘客車輛停在貴賓室停車場，乘客走VIP通道過安檢，上貴賓擺渡車到達飛機下。Article15ForBeijingoutboundflights:thepick-upvehicleshallstopattheparkinglotfortheVIProom.ThepassengersgothroughthesafetyinspectionbyVIPpassageandarriveattheaircraftbyVIPshuttle.第十六條?北京進港航班：乘客下飛機后上貴賓擺渡車，擺渡到機坪出口乘客接機車輛等候處。Article16Beijinginboundflights:aftergettingofftheaircraft,thepassengersgetontheVIPshuttleandtheshuttlesendsthemtopick-upvehiclesattheexit.第十七條?包機人在飛行及進出機場過程中需隨身攜帶有效證件。Article17TheCHARTERERshallbringvalidcredentialalongduringflightandwhenenteringandexitingtheairport.第十八條?根據(jù)《中國民航乘客規(guī)定》，如乘客攜帶貴重物品乘機，需事先在《乘客保障信息單》中注明所帶物品清單并嚴格遵守國家與民航的法律法規(guī)，如未事先聲明，造成的任何后果，由包機人自行承擔(dān)。Article18InlinewithPassengerRequirementsofCivilAviationAdministrationofChina,passengersbringingpreciousitemsshallidentifythecarryingitemsinPassengerGuaranteeInformationFormandstrictlycomplywiththelawsandregulationsofChinaandcivilaviation.Ifnotstatedinadvance,theCHARTERERshallbeartheconsequencesarisingtherefrom.第十九條?貴重物品的性質(zhì)、價值等應(yīng)符合相關(guān)的國際規(guī)定和承運人規(guī)定，如乘客攜帶危險品或違禁物品，造成的任何后果，由包機人承擔(dān)。Article19ThenatureandvalueofpreciousitemsshallcomplywithrelevantinternationalstipulationsandCARRIERregulations.IncasepassengerscarrydangerousgoodsorprohibiteditemsspecifiedbyPassengerRequirementsofCivilAviationAdministrationofChina,theCHARTERERshallbeliableforanyconsequencesarisingtherefrom.第二十條如乘客攜帶小動物，需參照《中國民用航空旅客、行李國內(nèi)運輸規(guī)則》中關(guān)于小動物的規(guī)定。Article20PassengerscarryingsmallanimalsinthecourseofdomesticflightsshallabidebyregulationsonliveanimalstipulatedbyChina'scivilaviationpassengers,baggage,domestictransportationrules.第二十一條包機人須認真了解前往國家和地區(qū)的證件要求，并應(yīng)保證每位乘機人持有有效證件。承運人可按時提醒并協(xié)助包機人辦理相關(guān)證件手續(xù)，但由于包機人所提供的乘客證件與本人不符、失效或不符合前往國家或地區(qū)的相關(guān)規(guī)定而導(dǎo)致飛行未能按合同約定時間執(zhí)行或取消時，由包機人承擔(dān)所有相應(yīng)的責(zé)任，與承運人無關(guān)。承運人應(yīng)返還包機人合同中未執(zhí)行航段費用，但包機人需承擔(dān)因此而產(chǎn)生的實際費用，所有涉及乘客相關(guān)責(zé)任的問題，包機人和承運人有義務(wù)向乘客傳達。Article21TheCHARTERERshallensurethateachpassengerholdsvaliddocuments.IncasepassengerdocumentsprovidedbytheCHARTERERareinconsistentorinvalid,theCHARTERERshallassumeallresponsibilitiesincurredbyfailingtooperatetheflightonagreedscheduleunderthecontractorflightcancellation.TheCARRIERshallrefundthefeeofunimplementedfightlegstotheCHARTERERaccordingtothecontract,buttheCHARTERERshallpaytheactualcostsarisingtherefrom.AllissuesrelatedtotheliabilitiesofpassengersshallbecommunicatedtopassengersbytheCHARTERERandCARRIER.第二十二條包機人所執(zhí)行的航線涉及到中國境內(nèi)外的相關(guān)機場時，乘客應(yīng)自覺遵守相關(guān)的機場規(guī)定，如有違反而導(dǎo)致的法律責(zé)任和刑事責(zé)任，由乘客自行承擔(dān)。Article22PassengersshouldconsciouslyabidebyregulationsstipulatedbyrelevantdomesticairportswheretheCHARTERERimplementstheflightroutes.Thepassengershouldbearlegalandcriminalliabilitiesderivingtherefrominsuredbyhimselforherself.第二十三條包機人乘坐北京首都國際機場進出港國際航班時，需由客人本人填寫中華人民共和國海關(guān)統(tǒng)一制作的《進出境旅客行李物品申報單》并簽字，銷售代表、乘務(wù)員、地面服務(wù)人員等均不得代客人填寫；Article23?TheCharterneedtofillintheChinaCustomsLuggageDeclarationFormswhenChartertakeinternationalflightsinandoutofChinabyBeijingcapitalinternationalairport,salesrepresentatives,cabincrews,groundservicestaffsarenotallowedtofilloutInsteadofCharter.第二十四條合同中提到的兒童，是指年齡滿兩周歲但不滿十二周歲的人。?Article24Childrenmentionedinthecontractarepassengersovertwo(2)butlessthantwelve(12)yearsofage.第四章標(biāo)準(zhǔn)空中服務(wù)Chapter4StandardAirService第二十五條承運人會根據(jù)航程時刻信息，結(jié)合機型特點、乘客國籍、宗教信仰、身體狀況（是否有糖尿病、高血壓等）安排餐食。Article25Basedontheflighttime,TheCARRIERwillarrangethecateringbycombiningthejettypefeatures,passenger'snationality,religion,physicalcondition(whetherthere’sdiabetesmellitus,highbloodpressure,etc).第二十六條在自身具備配餐公司的機場，參照海南航空頭等艙標(biāo)準(zhǔn)配備餐食；在自身不具備配餐公司的機場，由機場代理或乘務(wù)員從星級酒店或高檔餐廳外購。外購餐食受航班起飛時刻、包機人指定地點衛(wèi)生條件、運輸保存等條件限制，承運人不承擔(dān)因以上不可控情況而產(chǎn)生的餐食安全和質(zhì)量責(zé)任。Article26TheairportswithcateringcompanyshallpreparethecateringbyreferringtofirstclassstandardofHainanAirlines,andairportswithoutcateringcompanyshallhavetheairportagentorflightattendantsbuyfoodfromstarhotelorfirstclassrestaurant.Outsourcingmealsischarteredflightdeparturetime,designatedplacesanitation,transportation,preservationconditions,suchasmorethanthecarrierdoesnotundertakebecauseofuncontrolledsituationoffoodsafetyandqualityresponsibility.第十一章急救條款Chapter11TermsofFirstAid第六十九條執(zhí)行急救飛行任務(wù)前，包機人須向承運人提交病人的醫(yī)療報告、攜帶醫(yī)療設(shè)備清單、呈民航局總調(diào)度室關(guān)于急救飛行航線申請函、急救飛行免責(zé)聲明等材料；Article69TheCHARTERERshallprovidetheCARRIERwiththepatient'smedicalreport,listofmedicalequipmenttransport,applicationletteronfirst-aidflightroutesubmittedtothegeneralcontrolcenterofCivilAviationAdministrationofChina,andtheDisclaimerofFirst-aidFlightbeforetheimplementationoffirst-aidflightmission;第七十條?在飛行過程中，如承運人發(fā)現(xiàn)病人的病情與提交的醫(yī)療報告不符，承運人可以拒載并要求包機人承擔(dān)已發(fā)生的全部費用，同時承運人保留因包機人有意隱瞞患者實際病況而引發(fā)不良后果的追償與索賠權(quán)利；Article70IncasetheCARRIERfindsthatthepatient'sconditiondoesnotconformtothesubmittedmedicalreportinthecourseofflight,theCARRIERmayrefusetotakethepassengerandrequiretheCHARTERERtopayallexpensesincurredthereof;meanwhile,theCARRIERreservesclaimsofrecoveryandrightsofindemnityforadverseconsequencescausedbytheCHARTERERwhointendstoconcealtheactualconditionofthepatient;第七十一條如承運人發(fā)現(xiàn)包機人攜帶醫(yī)療設(shè)備與提交的醫(yī)療設(shè)備清單不符，承運人可以拒載并要求包機人承擔(dān)已發(fā)生的全部費用；Article71IncasetheCARRIERfindsthatthemedicalequipmentcarriedbytheCHARTERERdoesnotconformtothesubmittedlist,theCARRIERmayrefusetotaketheequipmentandrequiretheCHARTERERtopayallexpensesincurredthereof;第七十二條?急救飛行免責(zé)聲明需在飛行前由患者親屬或患者授權(quán)代理人簽字后提交給承運人，承運人在飛行前未收到該協(xié)議，有權(quán)拒載；Article72TheDisclaimerofFirst-aidFlightshallbesubmittedtotheCARRIERuponthesignatureofthepatient’srelativeorauthorizedrepresentativepriortotheflight.TheCARRIERshallhavetherighttorefusetocarrythepatientwithouttheagreementpriortotheflight;第七十三條承運的病人如患有傳染性疾病，但是不處于傳染期，則應(yīng)當(dāng)出示醫(yī)生證明以及第三方出具的非傳染性證明方可承運；急救公司還應(yīng)負責(zé)在急救飛行結(jié)束后對飛機進行消毒或支付消毒所需費用；Article73Incasethepatientsuffersfrominfectiousdiseases,butnotintheinfectiousperiod,amedicalcertificateandnon-infectiouscertificateissuedbythethirdpartyshouldbesubmittedbeforetheflight;thefirst-aidcompanyshallberesponsibletosterilizetheaircraftattheendoftheflightandpaythesterilizationfee;第七十四條?如急救飛行為地區(qū)或國際航線，包機人需在飛行前按照各地機場及航空局的要求提供三關(guān)函及英文的醫(yī)療報告。Article74Incasethefirst-aidflightisimplementedatregionalorinternationalflightroute,theCHARTERERshallsubmitthreerelatedlettersandmedicalreportinEnglishbeforetheflightinaccordancewiththerequirementsofcorrespondingairportandairportaviationauthority.第七十五條?急救氧氣瓶配備規(guī)定：Article75OxygenCylinderAllocationRegulation:（一）合同負責(zé)人在與包機人簽訂《北京首都航空有限公司急救運輸服務(wù)合同》或《上海金鹿公務(wù)航空有限公司急救運輸服務(wù)合同》前，應(yīng)向包機人確定此次急救飛行中所需每瓶氧氣瓶的容量和瓶數(shù)（如需配備120升的氧氣瓶2瓶，311升的氧氣瓶1瓶）；（1）BeforethesigningofFirst-aidTransportationServiceContractofBeijingCapitalAirlinesCo.,LtdorFirst-aidTransportationServiceContractofShanghaiDeerJetAirlinesCo.,Ltd,thechartershouldinformthecarrierofthenumberandthecapacityofoxygencylinderneeded.(Forexample,120L:2;311L:1)（二）合同負責(zé)人需將包機人所需氧氣瓶瓶數(shù)、容量及收費金額在急救運輸服務(wù)合同正文“行程登記表”及報價單中注明清楚；（2）ThepersoninchargeofcontractsigningshouldstateclearlythenumberandcapacityofoxygencylinderneededandthechargeamountintheFlightRouteRegistrationFormoftheFirst-aidTransportationServiceContractaswellasthequotationlist.（三）簽訂急救運輸服務(wù)合同后，如因包機人原因原定氧氣瓶數(shù)量需要減少或飛行結(jié)束后尚有剩余，則承運人不退還未使用完畢的氧氣瓶費用；（3）AfterthesighingoftheFirst-aidTransportationServiceContract,thecartercannotreducethenumberofoxygencylinderandthecarrierwillnotrefundthechargeoftheoxygenleft.（四）簽訂急救運輸服務(wù)合同后，如因承運人原因無法按照包機人要求提供所需氧氣瓶數(shù)量，則承運人應(yīng)根據(jù)最終提供的氧氣瓶數(shù)量重新計算報價并簽訂合同，同時需將剩余氧氣瓶款項退還包機人；（4）WhenthecarriercannotprovideenoughoxygencylindersasrequiredbythecharterafterthesigningoftheFirst-aidTransportationServiceContractsigned,thecarriershouldrecalculatethequotationaccordingtotheoxygencylindersprovided,signanewcontract,andgivetheexcesschargebacktothecharter.（五）如因承運人原因給包機人提供的氧氣瓶數(shù)量或容量與包機人預(yù)訂不符（包括氧氣瓶瓶數(shù)少配，總氧氣容量配錯等），則承運人應(yīng)退還此次急救飛行氧氣瓶收費總款給包機人，同時追究相關(guān)責(zé)任人責(zé)任。（5）Whenthenumberandcapacityofoxygencylinderdonotmeetcharter’sorderbecauseofthecarrier’snegligence(forexample,thenumberisnotenoughorthetotalcapacityisincorrect),thecarriershouldgivebackallthechargeofoxygencylindertothecharter,andthepersoninchargewillgetthepunishment.第七十六條急救氧氣瓶收費標(biāo)準(zhǔn)：Article76ChargingStandardofFirst-aidOxygenCylinder：氧氣瓶收費標(biāo)準(zhǔn)ChargingStandardofFirst-aid
