精選優(yōu)質(zhì)文檔-----傾情為你奉上精選優(yōu)質(zhì)文檔-----傾情為你奉上專(zhuān)心---專(zhuān)注---專(zhuān)業(yè)專(zhuān)心---專(zhuān)注---專(zhuān)業(yè)精選優(yōu)質(zhì)文檔-----傾情為你奉上專(zhuān)心---專(zhuān)注---專(zhuān)業(yè)S/N:EmploymentContractEmployer:Employee:PublishedbyNingboLaborandSocialSecurityBureauEmployer(hereinafterreferredtoas“PartyA”):Name:LegalRepresentative:orChiefLeader:Address:Employee(hereinafterreferredtoas“PartyB”):Name:EducationalBackground:IdentificationCardNo:Residence:Thiscontractisexecutedbytwopartiesinaccordancewiththeapplicableprovisionof“TheLaborLawofthePeople’sRepublicofChina”,“LawofthePeople’sRepublicofChinaonEmploymentContracts”andotherlawsandregulationsonthebasisofequality,voluntarinessandconsensus.Article1TermofcontractandProbationPeriod,andshallcommenceon()Fixedperiod.ThetermofthisContractshallbe___years,from_____/_____/_____to_____/_____/_____duringwhichthereshallbeaprobationperiodof_____months,from_____/_____/_____to_____/______/______.Unfixedperiod.ThetermofthisContractshallbecalculatedfromthedateof_____/_____/_____,includingtheprobationperiodof_____months.Thiscontractshallbeterminatedwhenthecircumstancesofstatutoryterminationoccur.Thetermforfulfillingtheproductionwork.ThetermofthisContractshallbefromthedateof_____/_____/_____,aftersuchproductionworkiscompleted,bothpartiesshallterminatethelaborcontract.IfthisContractissignedbeforeemployment,thelaborrelationshallbeestablishedsincethedateofemployment.Article2JobDescriptionTheEmployeragreetoemployMr./Ms._____________(name)as_____________(jobtitle)in_____________Department,locatedin_____________(officelocationandcity).PartBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.Article3Workinghours,restbreaksandholidaysPartyAshallimplementthefollowing()typeofworkinghoursystemforthepositionofPartyB.Standardworkinghoursystem.Comprehensiveworkinghoursystem.Flexibleworkinghoursystem.Inaccordancewithgovernmentrequirements,partyAandpartyBshouldstrictlycomplywithrulesofwokingtimes.ForoptionA,thenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.ForoptionBorC,onthebasisofensurepartyBhaveagoodhealthandwouldlistentopartyB’sidea,partyAcantakemeasuresofconcentratedwork,concentratedrest,additionaltimeoff,flexibleworkinghourtoensurepartyBcanenjoytherightofrests,vocationsandcancompleteproductionsandworkingtasks.PartyBshallbeentitledtolegalannualvacations.Article4LaborRemunerationThesalaryoftheEmployeeisRMB_____permonthintheprobationaryperiod.Thissalaryshouldnotlowerthanthelowestsalarystandardonthesamepositioninourcompanyor80%ofitsofficialwage,anditsalsoshouldn’tlowerthanlocalminimumwagestandard.Aftertheprobationaryperiod,thesalaryoftheEmployeeshallbeRMB_______,andthewageswillbemadeby()a.Hourlywagesb.piecewagesAccordingtothewagedistributionsystemofpartyA,bythetwosidesconsensus,Duringthetermofthecontract,thesalaryadjustedbypartyAforpartyBisthewageofthiscontract(shouldn’tlowerthanlocalminimumwagestandard).PartyB’ssalarywillbepaidby()a.offeredbybanksb.payincashPartyAshouldpaythelegaltendertopartyBasmonthlysalary,thepartyAshouldpaythewagesbeforeeachmonth,andofferthepayrolltopartyB.Incaseoftheholidayorweekend,partyAshouldpayattherecentworkingdaypaymentaheadoftime.PartyAshouldpaypartyBovertimewagesinaccordancewithrelevantregulationifpartyArequestpartyBtoworkovertimeonworkingday,workonoff-daysorlegalholidays.AndthisshallbecarriedoutbyrelevantlawsandregulationsandtherelevantregulationspreparedbyPartyAinaccordancewithlaw.Article5Insurance,WelfareandBenefitsPartyAshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyB’Sbehalfinatimelymannerinaccordancewithgovernmentrequirements.Andthepersonalpartwillbedeductedfromthesalary.PartyB'svocationofpregnancy,childbirth,breast-feedingandthecorrespondingtreatmentshouldaccordingtotherelevantregulations,suchasmaternityinsurance,femaleemployee'slaborprotection,etc.ThetreatmentforPartyB’soccupationaldiseaseorjobrelatedinjuries(death),sicknessornon-jobrelatedinjuries,andtheproviedofmedicaidexpensespaidshouldbecarryoutbyndustrialinjuryinsurance,medicalinsuranceandrelatedprovisions.Article6WorkingProtection&WorkingConditions PartyAandPartyBshallstrictlycomplywiththenationalregulationswhichconcerningproductionsafetyandabidebyregulationsoflabourprotectionandoccupationalhazardsandprotectionofworkers.PartyAshallprovidePartyBprotectionfacilities,equipmentandlaborprotectionarticlesandotherlaborprotectionconditionsinaccordancewiththenationallabor.PartyBshallstrictlycomplywiththesafeoperationandtherelevantrulesandregulationspreparedbyPartyAinaccordancewithlaw.IfPartyAillegalcommandorforceriskoperation,partyBhavetherighttorefuseit.PartyAmuststrictlyimplementrelevantOccupationalDiseasePreventionLaws,forthepositionsexposetooccupationaldiseasehazards,suchasexposuretodust,radioactivesubstancesandothertoxicandhazardoussubstances,PartyAshouldtellthetruthanditsconsequencesonoccupationalhazards,protectivemeasuresandtreatmentofoccupationaldiseasestopartyB,andtakepreventivemeasuresandprotectionfacilitieswhichmeettherequirementsofthenationaloccupationalhealth.IfPartyBisengagedintheoperationthatmayexposetooccupationaldiseasehazards,PartyAshallorganizeoccupationalhealthexaminationbeforegoondutyandleavethepostinaccordancewithrelevantnationalprovisions,andshallconductregularoccupationalhealthexaminationonPartyBduringthecontractterm.Article7Amendment,TerminationandEndingofEmploymentContracts1.Theemploymentcontractcouldbeamendedinafriendlynegotiationwiththeamendmentprocedureoperatingintime.2.OtherthanthecircumstancesstipulatedinArticle38in“EmploymentContractLaw”,PartyBmayterminatehisemploymentcontractupon30days’priorwrittennoticetoPartyA.Duringhisprobationperiod,hemayterminatehisemploymentcontractbygivingPartyAthreedays’priornotice.3.PartyAmayterminateemploymentcontractinvolvinginthecircumstancesspecifiedinArticle39,40&41in“EmploymentContractLaw”.ShouldPartyBfallsinthecircumstancespecifiedinArticle42in“EmploymentContractLaw”,PartyAmustnotterminateemploymentcontractaccordingtoitemsregulatedinArticle40&41in“EmploymentContractLaw”.4.Theemploymentcontractmayterminateifitconformstothecircumstanceasspecifiedin“EmploymentContractLaw”andothernational,provincialandmunicipalemploymentcontractrelatedprovisions.5.Terminationofemploymentcontracttoemployeeswhosufferemploymentinjuryoroccupationaldiseaseshallbeoperatedagainstnationalemploymentinjuryprovisions.6.PartyAshallpaytheemployeeseverancepayinvolvinginthecircumstancesspecifiedinArticle46in“EmploymentContractLaw”7.Atthetimeofterminationorendingofanemploymentcontract,PartyAshallissueaproofofterminationorendingoftheemploymentcontractand,within15days,carryouttheproceduresforthetransferofPartyB’sfileandsocialinsuranceaccount.PartyBshallcarryouttheproceduresforthehandoverofhisworkasagreedbytheparties.Article8Covenants1.AccordingtoprovisionsofArticle22,23&24in“EmploymentContractLaw”a.b.2)Othercovenants:Article9PartyAshallestablishinternalrulesandregulationsagainstlegalprocedureswithPartyBinformedandnoted.PartyBshallstrictlyabidebyrulesandregulationssetbyPartyA.Article10Whereanemploymentdisputebetweenthepartiestakesplaceduringtheperformanceofthiscontract,thepartiesconcernedmayseekforasettlementthroughconsultationormayapplytotheemploymentdisputemediationcommitteeofPartyA’sunitfo
