TheEuropeanUnionnoteswithdeepregretthat,withtheexecutionofMr.MarvallousKeenebytheStateofOhioon21July,theUnitedStateshascarriedoutits1,000thexecutionbylethalinjectionsincethereinstatementofthedeathpenaltyin1976. TheEuropeanUnionisopposedtotheuseofcapitalpunishmentinallcasesandunderallcircumstancesandhasconsistentlycalledforitsuniversalabolition.Webelievethattheabolitionofthedeathpenaltyisessentialtoprotecthumandignity,andtotheprogressivedevelopmentofhumanrights.TheEuropeanUnionconsidersthispunishmentcruelandinhuman.Ithasnotbeenfoundtoactasadeterrent,andanymiscarriageofjustice–whichisinevitableinanylegalsystem–isirreversible.Consequently,thedeathpenaltyisabolishedthroughouttheEuropeanUnion. TheEuropeanUnionalsorecallsthat,onDecember18,2021,theUnitedNationsGeneralAssemblyadoptedaresolutiononthedeathpenalty,reaffirmingitsResolutionadoptedinDecember2007,whichcallsuponallnationsthatstillusethedeathpenaltytoinstituteamoratoriumonexecutionswithaviewtoabolishingthepractice.

TheEuropeanUnionwarmlywelcomesandvaluesitscooperationwiththeUnitedStatesonawiderangeofhumanrightsconcernsaroundtheworld.TheEuropeanUnionthereforetakesthisopportunitytorenewitscalltotheUnitedStatesfederalandstateauthoritiesforamoratoriumontheapplicationofthedeathpenalty,pendingitscompletelegalabolition.EUDPGuidelinesAdoptedin1998andrevisedin2021,DPGuidelinesformthebasisforEUaction.Providecriteriaformakinggeneralorindividualrepresentations&outlineminimumstandardstobeappliedincountriesretainingthedeathpenalty.ApolicyareawherethereisastrongEUconsensus.TheEUistheonlyinternationalactortoactivelypursuetheabolitionoftheDPasapolicygoal.EUDPGuidelinesStatethat?

TheEuropeanUnionexpressesitsprofoundconcernoverthehumanrightssituationinIraq.TheEuropeanUniondeploresthereintroductionofexecutionsinIraq.Atleast117personsareknowntohavebeenexecutedsinceMaythisyear,whenthe2007suspensionofexecutionswasterminated.TheEUisconcernedby

indicationsthattheactualnumbersofexecutionsarehigher,andthatanother900personsarecurrentlyondeathrow,havingexhaustedlegalremedies.ReportsalsoindicatethatIraqisconsideringpublicexecutions.Inthiscontext,theEUexpressesitsconcernatthelackoffairtrials,aswellasinrelationtocredibleallegationsthatconfessionsareobtainedundertorture.

TheEUconsidersthedeathpenaltyacruelandinhumanpunishmentandaviolationoftherighttolife.TheEUthereforeurgestheGovernmentofIraqtoresumethedefactosuspensionofthedeathpenalty,pendingitsabolition.Suchastepwouldbeinlinewiththeglobaltrendtowardsabolition,asdemonstratedinteraliabyrecentUNGeneralAssemblyresolutions.

AstheIraqistateisconsolidatingfurther,anumberofprofoundchallengeshavetobeaddressed,includingstrengtheninggovernancestructurestobeabletoprotectitspopulationfromhumanrightsviolations.Inthisrespect,theEUreiteratestheimportanceitattachestothefightagainstimpunityandencouragestheGovernmentofIraqtodeepenitseffortstoworktoimproveaccountabilitystructureswiththeviewtoeradicateimpunity.TheEUisespeciallyconcernedbythedifficultyIraqiauthoritiesareexperiencinginpreventingtheappallingandarbitraryviolencedirectedagainstvulnerablegroupsinIraqisociety,suchaslethalattacksagainstethnicandreligiousminoritiesandhomosexualmen.Arbitraryviolenceagainstchildrenisfrequent,andisofspecialconcerntotheEU.

concerntotheEU.Exposedcategories,amongwhichkillingsanddisappearanceshavebeenreportedinthelastfewmonths,includeindividualsworkinginwomen’sorganisations,andpersonsadvocatingagainstprisonconditionsandtorture.TheEUnoteswithdeepconcernthatinsurgentgroupshavetargetedfemalepoliticians,civilservants,journalists,andwomen’srightsactivistsandadvocates.Femalelawyersrepresentingwomeninpersonalstatusmattersareparticularlytargeted,aswellaswomenprovidingprotectionforvulnerablegirlsandwomen,suchasthosethreatenedwith“honourkillings〞.Thedifficultconditionsprevailingforjournalists,withmembersofthepressbeingtargetedandkilledbymilitiagroups,constituteaseriousinfringementonthefreedomofexpression.TheEUcallsontheIraqiGovernmenttopromotefreedomofexpressionandfreedomofthemedia,includingfreedomofexpressionontheInternet.

Section3:HumanRightsDialoguesCasestudy3:EURussiaHRdialogueParticipation?Format?Scope?PresidencypressstatementonEU/RussianFederationhumanrightsconsultations OnNovember5,2021,theEuropeanUnionandtheRussianFederationheldthetenthroundofhumanrightsconsultationsinStockholm.ThehumanrightsconsultationsbetweentheEUandtheRussianFederationtookplaceforthefirsttimeinMarch2005. Theconsultationswereheldinanopenandconstructiveatmosphere. AttheconsultationstheEUandRussiacontinuedtoaddressthehumanrightssituationanddevelopmentsintheirrespectivecountries,withaparticularfocusoncooperationininternationalhumanrightsforaincludingtheUN,theCouncilofEuropeandtheOSCE,thefunctioningofcivilsociety,ruleoflawandjudiciaryreform,protectionofhumanrightsinthefightagainstterrorismandthefightagainstracismanddiscrimination.TheEUraisedanumberofconcernsrelatedtospecifichumanrightsissuesintheRussianFederation,includingintheNorthernCaucasus.TheEUalsoprovidedanswerstoRussia’sconcernsaboutcertainhumanrightsissuesintheEU.Bothsideswillcontinuetoprovideclarificationsonindividualcasesofconcernintherespectivecountries.TherewasanexchangeofideasonhowEUandRussiacouldincreasetheirpracticalcooperationintheareaofhumanrights.
