中英文對(duì)照裝飾施工合同

1、建筑裝飾工程施工合同Contract發(fā)包方（簡(jiǎn)稱甲方）PartyA:承包方（簡(jiǎn)稱乙方）：上海巧點(diǎn)裝飾設(shè)計(jì)有限公司PartyB:i-pointdesign(InspirationPointDesign)依照,以及其他有關(guān)法律法例規(guī)定的原則，聯(lián)合本工程的詳細(xì)情況，甲、乙雙方在相同、自覺(jué)、磋商一致的基礎(chǔ)上達(dá)成以下協(xié)議，共同恪守Accordingto:“PRCContractLaw”,“LawontheProtectionofConsumerInterests”,“PRCPriceLaw”,SupervisionofContractTerms”,“ShanghaiConstructionMarketM

7、失由乙方負(fù)責(zé)。如甲方要另增加資料由甲方供應(yīng)，并應(yīng)符合以下規(guī)定：MaterialprovidedbyPartyB:AnymaterialsorequipmentsuppliedbyPartyBwhichdonotmeetthedesignandconstructionrequirementsareprohibited.AnyextramaterialsrequestedbyPartyAwhichwerenotintheoriginaldesignmustbepaidforbyPartyA.甲方供應(yīng)的資料：另擬補(bǔ)充附件甲方負(fù)責(zé)采買供應(yīng)的資料、設(shè)施，應(yīng)符合設(shè)計(jì)施工要求的合格產(chǎn)品，并應(yīng)準(zhǔn)時(shí)供應(yīng)到現(xiàn)場(chǎng)。

8、乙方發(fā)現(xiàn)甲方供應(yīng)的資料、設(shè)施有質(zhì)量問(wèn)題或規(guī)格差異，應(yīng)及時(shí)向甲方提出，甲方仍要求使用的，由此造成工程損失，責(zé)任由甲方肩負(fù)。甲方供應(yīng)的資料準(zhǔn)時(shí)到達(dá)現(xiàn)場(chǎng)后，由乙方負(fù)責(zé)保存MaterialprovidedbyPartyA:(seetheannex:“TableofMaterialstobeprovidedbytheOwnerIfPartyAacquiresmaterialsfortheproject,itshouldfirstcheckwithPartyBthatthematerialsmatchtothedesignrequirements,andoncethematerialsareintheca

9、reofPartyB,thenPartyBisresponsibleforthematerials.IfPartyArequiressomematerialswhichdonotfittothedesignthenitshallbetheresponsibilityofPartyAtopayanyadditionalcostsincurredbyPartyB.四、對(duì)于工程質(zhì)量及查收的約定”).FULFILMENTOFTHISAGREEMENT1.本工程應(yīng)符合和市建設(shè)行政主管部門(mén)制定的其他地方標(biāo)準(zhǔn)質(zhì)量評(píng)定查收標(biāo)準(zhǔn)Theexecutionofthisprojectmustbeconsistentw

10、iththe“ArchitecturalandEngineeringRules”ofthecityadministrativedepartmentsresponsibleforthedevelopmentofbuildingsandlocalstandardsandqualityevaluationacceptancecriteria.本工程由乙方進(jìn)行設(shè)計(jì)，供應(yīng)施工圖紙一式兩份，雙方署名確認(rèn)PartyBmustprovideaduplicatecopyoftheconstructiondesignsanddrawings,andbothcopiesshouldbesignedbybothpar

11、ties.甲方供應(yīng)的資料、設(shè)施質(zhì)量不合格而影響工程質(zhì)量，其返工花銷由甲方肩負(fù)，工期相應(yīng)順延IfmaterialsprovidedbyPartyAfortheconstructiondonotmeetthenecessaryrequirements,PartyAshallbearresponsibilityforanyresultingdelaysinthecompletionintheproject.4.由于乙方原因造成質(zhì)量事故，其返工花銷由乙方肩負(fù)IfthequalityofPartyBsworkresultsinanyaccidents,theliabilityforsuchacciden

12、tsshallbethe5.responsibilityofPartyB.后，方能進(jìn)行該項(xiàng)目的施工、因此影響工程竣工日期的，責(zé)任由甲方肩負(fù)。凡甲方私自與施工人員約定改正施工內(nèi)容、增加施工項(xiàng)目所惹起的所有結(jié)果，甲方自負(fù)，給乙方造成損失的，甲方應(yīng)予賠償If,duringtheconstruction,PartyAwishestoproposeachangetothedesign,heshouldsigna“ChangeofProject”withPartyBandmustassumeresponsibilityforresultingdelaysorincreaseincosts.IfPartyA

13、secretlyattemptstochangetodesigndirectlywiththeconstructionpersonnelandthisactioncauseslosstoPartyB,thenPartyAmustcompensatePartyBforthisloss.工程查收：乙方負(fù)責(zé)理隱蔽工程和中間工程的檢查與查松手續(xù)。由乙方組織特地人員進(jìn)行查收。所有理隱蔽工程和中間工程的質(zhì)量由乙方負(fù)責(zé)Thestandardofwork.ItistheresponsibilityofPartyBtomakesurethatallconstructionworksarecarriedoutto

14、therequirementsofthedesignandtomakesurethatallinternalwallsandhiddenconstructionpartsaretotherequiredstandard.工程竣工：乙方竣工后即應(yīng)通知甲方查收，甲方應(yīng)在竣工當(dāng)日組織查收，并辦理查收移交鋒續(xù)，雙方簽。假如甲方在規(guī)準(zhǔn)時(shí)間內(nèi)不可以組織查收，須及時(shí)通知乙方，另定查收日期。如經(jīng)過(guò)竣工查收，甲方應(yīng)認(rèn)同原竣工日期，并肩負(fù)因此造成的乙方的看守花銷和其他有關(guān)花銷Projectcompletion.PartyBmustnotifyPartyAwhentheprojectiscompleteandrea

16、tracostsincurredbyPartyB.8.工程保修期一年。工程竣工查收后甲、乙雙方簽訂，憑保修單推行保修，保修期一年，從竣工查收簽章之日起算Oneyearwarranty.Aftercompletionoftheworkandsigningofthe“SingleWarranty”,thereshallbeaoneyearwarrantyontheconstruction.五、有關(guān)安全生產(chǎn)和防火的約定SAFEPRODUCTIONANDFIREREGULATIONS1.施工圖紙和施工說(shuō)明應(yīng)符合防火防事故的要求，主要包括電氣線路等管道暢達(dá)、合格。乙方在施工中應(yīng)采用必要的安全防范和消防措

17、施，保障作業(yè)人員及相鄰關(guān)系的安全,防范相鄰單位的管道擁堵、滲漏水、停電、物品破壞等事故發(fā)生Constructiondrawingsandconstructionmustbeinlinewithfirepreventionregulations,andaccidentpreventionrequirements.Thisincludeselectricalcircuitsandpipelines.PartyBshalltakemeasurestoensurethesafetyofworkersandneighborsattheconstructionssiteandmustpreventleak

18、ageofwater,interruptionsofpoweranddamagetoproperty.施工中凡波及改變房子構(gòu)造，拆、改承重墻，加大樓（地）面荷載，由甲方向物業(yè)管理部門(mén)提出申請(qǐng)，經(jīng)所在地建設(shè)行政主管部門(mén)贊同后方能施工Anychangestothehousingstructureordemolitionoralterationtoloadbearingwallsorincreaseinfloorloadmustfirstbeapprovedbythebuildingpropertymanagementbeforeconstructionbegins.雙方款項(xiàng)來(lái)往均應(yīng)出具正規(guī)收據(jù)和發(fā)

19、票，以備檢驗(yàn)和結(jié)算Bothpartiesmustprovidemoneyexchangereceiptsandinvoices.六、其他事項(xiàng)OTHERMATTERS1.甲方工作PartyA甲方應(yīng)在動(dòng)工前確認(rèn)施工圖紙并騰出足夠的施工空間，以除掉影響施工的阻攔物。甲方向乙方供應(yīng)施工需用的水、電等必備條件，并說(shuō)明使用注意事項(xiàng)WhenPartyAconfirmsthepre-constructionandconstructiondrawings,hemustalsomakesurethereissufficientspaceavailableattheconstructionsiteforconstr

20、uctiontotakeplace.PartyAmustmakesurethatPartyBhaseverythingnecessaryonsiteforcompletionoftheconstruction,particularlyelectricityandwater.做好施工中因臨時(shí)使用公用部位操作影響鄰居關(guān)系等的協(xié)調(diào)工作PartyAmusttakecareofthepublicrelationsintheconstructionsiteareaneighbors.particularlywiththe2.乙方工作PartyB1.參加甲方召集的現(xiàn)場(chǎng)交底PartyBmustbeavaila

21、bletoattendmeetingsorganizedbyPartyA.2.乙方按要求組織施工，保質(zhì)、保量、如期達(dá)成施工任務(wù)PartyBmustfollowtheconstructionplans,andtheconstructionmustbedurable,andmustmeetthescheduledcompletiondate.七、違約責(zé)任LIABILITYFORBREACHOFCONTRACT由于甲方原因以致緩期動(dòng)工或中途歇工，工期順延IfPartyAcausesanydelaystothecompletionofthisproject,thenthescheduledcomple

22、tiondateshouldbeadjustedaccordingly.2.由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造價(jià)0.1(大寫(xiě):千分之一)的違約金IfPartyBcausesanydelaytothecompletionofthisproject,thenPartyBmustpaytoPartyAafeeof0.1(inwords:1/1000)ofthetotaloverallprojectfeeforeachdaybeyondthescheduledcompletiondate.甲方未辦理有關(guān)手續(xù)，強(qiáng)行要求乙方拆改原有建筑承重構(gòu)造及共用設(shè)施管線，由此發(fā)生的損失或事故（包

23、括罰款）由甲方負(fù)責(zé)并肩負(fù)責(zé)任IfPartyAinstructsPartyBtomakeanyalterationstoaloadbearingwallandPartyAhasnotsoughtandreceivedpermissionfromthebuildingpropertymanagement,PartyAshallberesponsibleforanyresultingcostsandshallindemnifyPartyBforanyadditionalexpensesincurred.乙方私自拆改原有建筑承重構(gòu)造或共用設(shè)施管線，由此發(fā)生的損失或事故（包括罰款），由乙方負(fù)責(zé)并肩負(fù)責(zé)任

24、IfPartyBmakesanyunauthorizedchangestoloadbearingwallsorbuildingpipelinesandsuchchangesresultindamagesorloss,itshallbetheresponsibilityofPartyBtopayforsuchloss.5.工程未辦理查收、結(jié)算手續(xù)，甲方提早使用或私自動(dòng)用工程成品由此造成無(wú)法查收和損失的責(zé)并肩負(fù)責(zé)任,由甲方負(fù)PartyAshallberesponsibleforanyextracostsincurredduetohisuseofthepropertybeforethefinalco

25、mpletionmeetingandsigningofthe“EngineeringQualityAcceptancedocument”.八、糾葛辦理方式DISPUTES因工程質(zhì)量雙方發(fā)生爭(zhēng)議時(shí)，憑本合同文本向有關(guān)行業(yè)協(xié)會(huì)申請(qǐng)調(diào)停，也可向所在區(qū)、縣建設(shè)行政主管部門(mén)或花銷者協(xié)會(huì)投訴Ifthereisadisputebetweentheparties,thiscontractshouldbesubmittedtotherelevanttradeassociationformediationandalsotothehostdistrictandcountybuildingdepartmentsinc

26、hargeofadministrativecomplaints,ortoconsumerassociations.2.當(dāng)事人不愿經(jīng)過(guò)磋商、調(diào)停解決、或磋商、調(diào)停不可以時(shí)，可以依照本合同約定向仲裁-人民法院提起訴訟-上海仲裁委員會(huì)申請(qǐng)if,afternegotiation,mediationand/orconsultation,thepartieshavefailedtoreachanagreement,thenthedisputeshouldbe:submittedtothe-ShanghaiArbitrationCommission-filedasalawsuit.九、合同改正和消除AMENDMENTANDTERMINATION1.合同經(jīng)雙方署名見(jiàn)效后，雙方必定嚴(yán)格恪守。任何一方要求改正合同內(nèi)容或消除合約，由雙方磋商解決，經(jīng)雙方署名確認(rèn)后見(jiàn)效Afterthiscontractissigneditmustbestrictlyadheredto.Afterthecontractissigned,neitherpartycanleavethecontractwithoutagreementoftheotherparty.2.本合同簽訂后，工程不得轉(zhuǎn)包Afterthiscontractissigned,theprojectsha
