1、HOUSE LEASING CONTRACT上海市衡宇租 賃合同The parties of this agreement are:本合同兩邊當(dāng)事人:The Leaser (Party A):出租方(甲方) :The leasee (Party B):承租方(乙方) :Agent (Party C):中介方:上海浩坤房地產(chǎn)經(jīng)紀(jì)According to The Contract Law ofand The Regulation On Premise Leasing of Shanghai (hereinafter referred as tothe Regulation), Party A an

2、d Party B, of their own volition, upon friendly negotiation, hereby agree to sign this contract for the deal that Party A lets the premises which is legally owned by Party A to Party B and Party B lease from Party A the said premises.依照中華人民共和國合同法 、上海市衡宇租賃條例 (以下簡稱:條例)的規(guī)定,甲、乙兩邊在平等、志愿、公平和老實(shí)信譽(yù)的基礎(chǔ)上,經(jīng)協(xié)商一致

3、,就乙方承租甲方可依法出租的衡宇事宜,訂立本合同。Article 1 General Condition of the premises to be let出租或預(yù)租衡宇情形1-1Party A will let the premises located at Unit1801,Buliding Number 4, Lane366, Pucheng Road. (hereinafter referred as to the Premises) in Shanghai to Party B. The gross area of the Premises is equal to square me

4、ters. The purpose of the Premises is for residence. Annex I is the plane figure of the Premises. Party A has shown the plane figure and the Title-deed of the Premises (Number : 滬房地浦字 第 ) to Party B.甲方出租給乙方的衡宇座落在本市弄號室。(以下簡稱該衡宇) 。該衡宇出租建筑面積為平方米,衡宇用途為居住,衡宇類型為新工房、結(jié)構(gòu)為鋼混。甲方已向乙方出示該衡宇產(chǎn)權(quán)證(編號滬房地字第):1-2As the o

5、wner of the Premises, Party A establishes the lease relation with Party B. Prior to signing this contract, Party A has informed Party B of the mortgage on the Premises.甲方作為該衡宇的房產(chǎn)權(quán)利人與乙方成立租賃關(guān)系。簽定本合同前,甲方已告知乙方該衡宇已 未 設(shè)定抵押。1-3Range, Condition and Requirement of /for the part in common use of the Premises

6、and the conditions of the existing decoration and facilities are illustrated in the Annex II and III herein. Unless otherwise specified, the Annex will be regarded as an inspection list to be checked and followed when Party A hands over the Premises to Party B or Party B returns the Premises to Part

7、y A when the lease term is due.該衡宇的公用或合用部位的利用范圍、條件和要求及現(xiàn)有裝修、附屬設(shè)施、設(shè)備狀況有關(guān)事宜,由甲、乙兩邊別離在本合同附件(二)、(三)中加以列明。甲、乙兩邊同意該附件作為甲方向乙方交付該衡宇和本合同終止時(shí)乙方向甲方返還該衡宇的驗(yàn)收依據(jù)。Article 2 Occupation Purpose 租賃用途2-1Party B guaranteed that the Premises will only be occupied for Living purposes, and he will be abiden by theregulations

8、 on house using and managing in Shanghai乙方向甲方許諾,租賃該衡宇作為居住利用,并遵守國家和本市有關(guān)衡宇利用和物業(yè)治理的規(guī)定.2-2During the lease term, Party B shall not alter the use of the Premises unless Party B has obtained the writtenapproval from Party A and completed the relevant registration forms at corresponding government offices.

9、乙方保證,在租賃期內(nèi)未征得甲方書面同意和按規(guī)定須經(jīng)有關(guān)部門審批核準(zhǔn)前,不擅自改變上款約定的利用用途。Article 3 Deliveries Date and Lease Terms交付日期和租賃期限3-1Party A shall deliver the Premises to Party B before Date. The lease term of the Premises is 12months that commence on Dateand will expire on Date,.甲乙兩邊約定,甲方于_年 _月 _日前即甲方在收到乙方支付的租賃保證金和叁個(gè)月租金時(shí),向乙方交付該

10、衡宇。 【出租】衡宇租賃期自_年 _月 _日起至 _年 _ _月_ _日止。3-2 Upo n the expiration of the lease, Party A is entitled to withdraw the rented premises, and Party B will vacate it in time. In the event Party B would like to extend the lease, he shall consult with Party A on relevant issue with a must of 1 month prior noti

11、ce to Party A.租賃期滿,甲方有權(quán)收回該衡宇,乙方應(yīng)如期返還。乙方需要繼續(xù)承租該衡宇的,那么應(yīng)于租賃期屆滿前 1 個(gè)月,向甲方提出續(xù)租書面要求,經(jīng)甲方同意后從頭簽定租賃合同。Article 4 Rent and Terms of Payment租金、支付方式和期限4-1The monthly rent is equal to RMB.This rent shall be fixed for 1 year (s) and from the 2nd year, it may adjusted by both parties herein throughnegotiation, whic

12、h is stipulated in the Supplementary Provisions.甲、乙兩邊約定, 【出租】月租金共計(jì)為人民幣元。 (大寫:人民幣元整 )。該衡宇租金 1年內(nèi)不變。如乙方需續(xù)租,自第2 年起,兩邊可協(xié)商對租金進(jìn)行調(diào)整。有關(guān)調(diào)整事宜由甲、乙兩邊在補(bǔ)充條款中約定。4-2Party B shall pay the monthly rent by thedate of that monthy bymonth rental which is RMB乙方應(yīng)于當(dāng)月日前向甲方支付租金,每個(gè)月支付1 次,金額為人民幣元。4-3The rent shall be paid in fo

13、llowing manners:Bank account :.乙方支付租金的方式如下:甲方帳號如下:戶名:賬號:乙方通過銀行劃賬的方式支付租金。Article 5 Deposit and Miscellaneous Charges保證金和其他費(fèi)用5-1It is agreed that Party B shall pay RMB, which is equal to the rent formonth(s), as a deposit toParty A when both party sign the contract.Party A shall make out a receipt in

14、written after receiving the foresaid amount.Upon the expiration of this lease, after deducting the fees, which shall be undertaken by Party B, from thedeposit, Party A shall return the rest to Party B without any interests.甲、乙兩邊約定,甲甲乙兩邊簽定租賃合同時(shí),乙方應(yīng)向甲方支付衡宇租賃保證金,保證金為的租金,即人民幣 元整。個(gè)月甲方收取保證金后應(yīng)向乙方開具收款憑證。租賃關(guān)

15、系終止時(shí),甲方收取的房屋租賃保證金除用以抵充合同約定由乙方承擔(dān)的費(fèi)用外,剩余部分無息歸還乙方。5-2During the period of the lease, all charges for use of water, electricity, gas, telecommunication, equipments, cable TV, satellite TV shall be paid by Party B . Party B shall pay receipt fee if need. Party A shall pay Property management fee.租賃期間,利用該

16、衡宇所發(fā)生的水、電、煤氣、通信設(shè)備、有線電視,衛(wèi)星電視等費(fèi)用由乙方承擔(dān)。物業(yè)治理費(fèi)由甲方承擔(dān)。乙方如需發(fā)票,那么費(fèi)用由乙方承擔(dān)。Article 6 Requirement for Use the Premise and Maintenance of the Premise衡宇利用要求和維修責(zé)任6-1In the event of any damage or fault of the rented premises, Party B shall inform Party A of it in time. The maintenance, shall be carried by Party A w

17、ithin 5 days after receiving the promptly notice from Party B on such damage or fault.租賃期間,乙方發(fā)覺該衡宇及其附屬設(shè)施有損壞或故障時(shí),應(yīng)及時(shí)通知甲方修復(fù);甲方應(yīng)在接到乙方通知后的 5 日內(nèi)進(jìn)行維修。超期不維修的,乙方可代為維修,費(fèi)用由甲方承擔(dān)。 6-2 During the lease, Party B shall properly occupy the Premises and take good care of the facilities. Any consequences due to Party

18、 B s improper operation or neglect shall be undertakenPartybyB. If Party B refuses to do it, Party A may do the maintains for it. The expenses arising from such maintains shall be paid by Party B.租賃期間,乙方應(yīng)合理利用并愛惜該衡宇及其附屬設(shè)施。因乙方利用不妥或不合理利用,致使該衡宇及其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負(fù)責(zé)維修。乙方拒不維修,甲方可代為維修,費(fèi)用由乙方承擔(dān)。6-3 During the

19、 lease, Party A shall guarantee the safety in use of the Premises. In the event Party A intends to inspect and maintain the Premises, he shall notify Party B 7 days ahead of time. Party B shall cooperate and assist as best as possible while Party A is maintaining the Premises. Meanwhile, Party A sha

20、ll reduce the effect on using the Premises of Party B.租賃期間,甲方保證該衡宇及其附屬設(shè)施處于正常的可利用和平安的狀態(tài)。甲方對該衡宇進(jìn)行檢查、養(yǎng)6-4護(hù),應(yīng)提早7 日通知乙方。檢查養(yǎng)護(hù)時(shí),乙方應(yīng)予以配合。甲方應(yīng)減少對乙方利用該衡宇的阻礙。Except for the stipulation in Annex III, If Party B intends to redecorate the Premises or replaces the existingfacilities;a written approval shall be obta

21、ined in advance from Party A. If required by applicable bylaw orregulations, Party A shall also complete certain registration procedure at relevant government offices before theconstruction starts.除本合同附件(三 )外,乙方另需裝修或增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事前征得甲方的書面同意,按規(guī)定向有關(guān)部門審批的,那么還由甲方報(bào)有關(guān)部門批準(zhǔn)后,方可進(jìn)行。乙方增設(shè)的附屬設(shè)施和設(shè)備及其維修責(zé)任于甲、乙兩邊另行書面

22、約定。Article 7 Condition When the Premise Returned衡宇返還時(shí)的狀態(tài)7-1Except Party A approve the application for extending the lease from Party B, Party B shall return the Premiseswithin 1 days after the expiration of this lease. Any delay of the delivery of the Premises made by Party B shallbe charged RMBper

23、day as a House Occupation Fee to Party A.除甲方同意乙方續(xù)租外,乙方應(yīng)在本合同的租期屆滿后的一日內(nèi)返還該衡宇,未經(jīng)甲方同意超期返還衡宇的,每超期一日,乙方應(yīng)按元人民幣 /日向甲方支付該衡宇占用期間的利用費(fèi)。7-2 The condition of the Premises when Party B returns it to Party A shall accord with the one that is after normal using. The return of the Premises shall be examined and confi

24、rmed by Party A. Meanwhile, both parties shall square up the charges with each other.乙方返還該衡宇應(yīng)當(dāng)符合正常利用后的狀態(tài)。返還時(shí),應(yīng)經(jīng)甲方驗(yàn)收認(rèn)可,并彼此結(jié)清各自應(yīng)當(dāng)承擔(dān)的費(fèi)用。Article 8 Sublet, Lease Transfer, and Exchange轉(zhuǎn)租、轉(zhuǎn)讓和互換8-1Unless otherwise stated in Supplementary Provisions, Party B may only transfer part or all of the Premises to

25、a third party during the lease upon the written approval of Party A. However, Party B shall not sublet part of the room of the Premises to a third party or sublet the room to two or more than two lessees at the same time for residential purpose.除甲方已在本合同補(bǔ)充條款中同意乙方轉(zhuǎn)租外,乙方在租賃期內(nèi),需事前征得甲方的書面同意,方可將該衡宇部份或全數(shù)轉(zhuǎn)租

26、給他人。但同一間居住衡宇,不得分割轉(zhuǎn)租。8-2 In case that Party B sublets the Premises, the Sublet Contract shall be concluded with the sub-lessee and be registered in the Real Estate Transanction Center of the district where the Premises is located.乙方轉(zhuǎn)租該衡宇,應(yīng)按規(guī)定與受租方訂立書面的轉(zhuǎn)租合同。并按規(guī)定向該衡宇所在區(qū)、縣房地產(chǎn)交易中心或農(nóng)場系統(tǒng)受理處辦理記錄備案。8-3During

27、the lease term, Party B may, through a legal contract on subject alteration, transfer this lease to a third party or exchange the Premises with a third party who is the lessee of another premises upon the written approval of Party A.在租賃期內(nèi), 乙方將該衡宇轉(zhuǎn)讓給他人承租或與他人承租的衡宇進(jìn)行互換,必需事前征得甲方書面同意。轉(zhuǎn)讓或互換后,該衡宇承租權(quán)的受讓人或互換

28、人應(yīng)與甲方簽定租賃主體變更合同并繼續(xù)履行本合同。8-4During the lease term, where Party A intends to offer for sale the Premises, he shall inform Party B of it with a prior notice of one months, and Party B give up a priority right to purchase the Premises.在租賃期內(nèi),甲方如需出售該衡宇,應(yīng)提早一個(gè)月通知乙方。同時(shí)乙方舍棄對該衡宇的優(yōu)先購買權(quán)。Article 9 Dissolution合同的解

29、除9-1During the lease, this contract may be terminated under the following condition, and both parties shall be excused from liability:Force Majeure;The Premises is damaged, lost and appraised to be the dangerous house;The Premises on which Party A created a mortgage is being handled甲、乙兩邊同意在租賃期內(nèi),有以下情

30、形之一的,本合同終止,兩邊互不承擔(dān)責(zé)任:( 一 ) 該房屋占用范圍內(nèi)的土地使用權(quán)依法提前收回的;( 二 ) 該房屋因社會公共利益被依法征用的;( 三 ) 該衡宇因城市建設(shè)需要被依法列入衡宇拆遷許可范圍的;( 四 ) 該房屋毀損、滅失或者被鑒定為危險(xiǎn)房屋的;( 五 ) 甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的。9-2 Under the following conditions, one party shall notify the other party to dissolve this contract in writing form. The breaching party sha

31、ll pay a penalty at one of the monthly rent herein to the other party. If the penalty is insufficient to cover the loss suffered by Party B, Party A shall pay the difference:Party A delays the delivery of the Premises, and after being called on to performs the obligation, fails to do so within 7 day

32、s by Party B;The objectives of this contract cannot be realized due to the condition of the Premises delivered by Party Adoes not accord with the stipulation f this contract.The Premises is damaged because Party B alters the use of the Premises without any written approval from Party A;The main body

33、 structure of the Premises is damaged due to Party B;Party B sublet the Premise, transfer this lease and exchange the premises leased each without any approval from Party A;Party B delays the rent payment for more than 15 days;甲、乙兩邊同意,有以下情形之一的,一方可書面通知另一方解除本合同。違背合同的一方,應(yīng)向另一方按月租金的 壹倍支付違約金;給兩邊造成損失的,支付的違

34、約金不足抵付一方損失的,還應(yīng)補(bǔ)償造成的損失與違約金的差額部份:(一 )甲方未按時(shí)交付該衡宇,經(jīng)乙方催告后7 日內(nèi)仍未交付的;( 二 ) 甲方交付的該衡宇不符合本合同的約定,致使不能實(shí)現(xiàn)租賃目的的;或甲方交付的衡宇存在缺點(diǎn)、危及乙方平安的。( 三 ) 乙方未征得甲方同意改變房屋用途,致使房屋損壞的;( 四 ) 因乙方原因造成房屋主體結(jié)構(gòu)損壞的;( 五 ) 乙方擅自轉(zhuǎn)租該房屋、轉(zhuǎn)讓該房屋承租權(quán)或與他人交換各自承租的房屋的;( 六 ) 乙方逾期不支付租金累計(jì)超過15 天的;Article 10The Responsibility of Party A and Party B for Breachin

35、g the Contract違約責(zé)任10-1 Where the defects exit while Party A is delivering the Premises, Party A shall repair it within 3 days after the delivery. If Party A fails to do it, the rent shall be reduced and the article about the rent shall be changed.該衡宇交付時(shí)存在缺點(diǎn)的,甲方應(yīng)自交付之日起的3 日內(nèi)進(jìn)行修復(fù)、超期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金

36、條款。10-2 Party A shall compensate the damage of Party B resulting from the situation that Party A does not inform Party B of the mortgage or any limitation on the Premises or its ownership before this lease.因甲方未在該合同中告知乙方,該衡宇出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限制,造成乙方損失的,甲方應(yīng)負(fù)責(zé)補(bǔ)償。10-3 During the lease, if the Premises is da

37、maged and Party B suffers a property loss or physical injury due to PartyA s failure to carry out the repair and maintenance in time as stipulated herein, Party A shall be liable forsuchcompensation.租賃期間,甲方不及時(shí)履行本合同約定的維修、養(yǎng)護(hù)責(zé)任,致使衡宇損壞,造成乙方財(cái)產(chǎn)損失或人身損害的,甲方應(yīng)承擔(dān)補(bǔ)償責(zé)任。10-4 During the lease, in case Party A diss

38、olve this contract without authorization and take back the Premises, Party A shall pay a penalty equal to 1 times of the rent for the days which Party A take back the Premises ahead of time, and the maximum amount that can be claimed is the 1 month deposit.租賃期間,非本合同規(guī)定的情形甲方擅自解除本合同,提早收回該衡宇的,甲方應(yīng)按提早收回天數(shù)

39、的租金的 1 倍向乙方支付違約金 , 但金額最多不超過 1 個(gè)月的租賃保證金。10-5 If Party B decorates the Premises or replaces the facilities without the written approval or beyond the written approval of Party A, Party B shall Recover the Premises to the Original State .乙方未征得甲方書面同意或超出甲方書面同意的范圍和要求裝修衡宇或增設(shè)附屬設(shè)施的,甲方能夠要求乙方恢復(fù)衡宇原狀。10-6 During

40、 the lease, where Party B quit the lease without authorization, Party B shall pay a penalty equal to 1 times of the rent for the days which Party B quit the lease ahead of time. The 1 month deposit can be deductedby Party A as penalty, and the maximum amount that can be claimed is the 1 month deposi

41、t.租賃期間,非本合同規(guī)定的情形,乙方半途提早擅自退租的,乙方應(yīng)按提早退租天數(shù)的租金的方支付違約金,違約金可由甲方從 個(gè)月租賃保證金中相應(yīng)抵扣,但金額最多不超過倍向甲個(gè)月的租賃保證金。Article 11Miscellaneous其他規(guī)定11-1 During the lease, in the event Party A would like to raise a mortgage on the Premises, Party A shall inform Party B of such mortgage and guarantee that Party A shall consult wi

42、th Party B on purchase of the Premises within 30 days before the parties of the mortgage agree to sell off the Premises.租賃期間,甲方需抵押該衡宇,應(yīng)當(dāng)書面告知乙方,并向乙方許諾該衡宇抵押后當(dāng)事人協(xié)議以折價(jià)、變賣方式處分該衡宇前 30 日書面征詢乙方購買該衡宇的意見。11-2 This agreement shall be taken legal effective on this execution date by Shanghai Municipal Notary Off

43、ice for the lease of the privately owned and nonresidential premises.本合同自兩邊簽字后生效。11-3 For the items not mentioned in the contract, Party A & B may fix supplementary clause which shall not be in discrepancy with the state/city applicables bylaws on real estate transaction. The supplementary clause an

44、d attached appendix form integral parts of this contract. The handwriting or computed words in the blank spacesof this contract/supplementary clause and attached appendix will be equally enforceable.本合同未盡事宜,經(jīng)甲、乙兩邊協(xié)商一致,可訂立補(bǔ)充條款。本合同補(bǔ)充條款及附件均為本合同不可分割的一部份,本合同及其補(bǔ)充條款和附件內(nèi)空格部份填寫的文字與鉛印文字具有一樣效勞。11-4 When signing this contract.
