工程安裝合同

1、工程安裝合同于年月日（簡稱甲方）與（簡稱乙方）簽訂安裝的項目合同。1. 安裝工程名稱：O2. 工程地點：甲方港口。3. 工程范圍：本合同所附圖紙及估價單。4. 完工期限：本安裝工程將配合甲方在甲方港口建造工程完工后天內(nèi)完成安裝工程其中包括試驗運行。5. 安裝工程總價格：美元整。6. 安裝工程付款進度：第一期：甲方在本合同開始實滋時付給乙方工程總價15%即 美元整。第二期：甲方在港口造船工程開始時付給乙方工程總價15%即美元整；第三期：在安裝管路時甲方付給乙方工程總價的10%即 美元整。第四期：在主機的主要設(shè)備運抵工地時甲方付給乙方工程總 價的40%即美元整；第五期：在安裝工程完畢時甲方付給乙方

2、工程總價的10%即 美元整；第1頁共9頁第六期：在工程驗收合格后甲方付給乙方工程總價余額的10% 即美元整。7. 違約罰款：因乙方原因未準時完工時應(yīng)由乙方負責應(yīng)付違約罰款每天按總價的1%計算即美元整。8. 增加或減少工程：若甲方需修改、增加或減少其工程計劃 時總價之增減應(yīng)按雙方規(guī)定之訂單計算。若需新增加工程量雙方 應(yīng)另行協(xié)商該項新增加工程之單價。若甲方因修改原計劃而將已 完工部分工程或已運抵工地之材料棄置甲方在驗收后應(yīng)按雙方規(guī) 定的單價對乙方已完成的工程費用及材料費予以支付。9. 監(jiān)督進度：甲方派去的監(jiān)督人員或代表對工程進度予以監(jiān) 督并有權(quán)予以監(jiān)工、指導(dǎo)。乙方應(yīng)按甲方人員或代表的指示正確 施工

3、不得以任何借口置之不理。10. 工程停工：若甲方通知乙方將工程停止其原因又并非是 乙方的責任乙方可停止工程并要求甲方按照已完成工程的數(shù)量、 運抵工地的材料及其他合理費用。在已交款中增付或扣除。11. 工程監(jiān)護：在工程開始后但在完工移交前已完工的工程 及留在工地的材料、工具、設(shè)備等均由乙方保管。除人力不能抵 抗的災(zāi)害外乙方應(yīng)對保管中的一切負損害之全責。如遇不可抵抗 的天災(zāi)人禍乙方應(yīng)詳列損害實情向甲方提出恢復(fù)原狀的價格及日 期。以供甲方核對付款之用。若甲方?jīng)Q定不再繼續(xù)施工按合同第 10條規(guī)定結(jié)束。第2頁共9頁12. 工程保險：除天災(zāi)或因甲方使用不當?shù)脑蛲庖曳綉?yīng)在甲方驗收后保證工程質(zhì)量良好年。13

4、. 附加條款：在工程進行中若因乙方的過錯使甲方或其他 人員受到傷害乙方應(yīng)負責賠償。但如果傷害原因是由甲方或與甲 方訂約之其他工程人員的過錯所造成則應(yīng)由甲方完全負責。14. 附件：本合同附件應(yīng)視為本合同的一部分與其他條款有 同等效力。附件包括：（1）圖樣；（2）估價單。15. 合同形式：本合同一式兩份甲乙雙方各執(zhí)一份。另各保 留兩份副本供雙方存檔備查。16. 附加條款：主機的保養(yǎng)一乙方應(yīng)在甲方驗收后提供免費及定期對保養(yǎng)服務(wù)一年每個月派員一次維護正常運行。本合同按雙方所簽日期生效。甲方（蓋章）:乙方（蓋章）:法定代表人（簽字）： 法定代表人（簽字）：年月日年月日簽訂地點：簽訂地點：附件第3頁共9頁
