13、低作設(shè)計(jì)費(fèi)）。設(shè)計(jì)人提交_設(shè)計(jì)文件后三天內(nèi)，發(fā)包人支付設(shè)計(jì)總額的30%，計(jì)_萬(wàn)元；之后，發(fā)包人應(yīng)按設(shè)計(jì)人所完成的施工圖工作量比例，分期分批向設(shè)計(jì)人支付總設(shè)計(jì)費(fèi)的20%，計(jì)_萬(wàn)元，施工圖完成后，發(fā)包人結(jié)清設(shè)計(jì)費(fèi)，不留尾款。雙方委托銀行代付代收有關(guān)費(fèi)用。Article 8 Terms of payment Within three days upon the effectiveness of this contract, the Employer shall pay 1% of RMB 1,800,000yuan, the appraised price of investment to the

14、transformer, namely RMB1,8000 yuan as the down payment.( the down payment shall be counted as the charges for design upon settlement of the contract). The Designer shall submit eight sets of design documents to Party A for submission to the power supply department and the Employer will pay % of RMB

15、1,800,000yuan, the appraised price of investment to the transformer, namely RMB 6,3000 yuan, without any remainder. The Parties shall entrust bank to collect and pay for relevant charges.第九條 雙方責(zé)任發(fā)包人責(zé)任發(fā)包人按本合同第五條規(guī)定的內(nèi)容，在規(guī)定的時(shí)間內(nèi)向設(shè)計(jì)人提交基礎(chǔ)資料及文件，并對(duì)其完整性、正確性及時(shí)限負(fù)責(zé)。發(fā)包人不得要求設(shè)計(jì)人違反國(guó)家有關(guān)標(biāo)準(zhǔn)進(jìn)行設(shè)計(jì)。發(fā)包人提交上述資料及文件超過(guò)規(guī)定期限15天以內(nèi)，

16、設(shè)計(jì)人按本合同第六條規(guī)定的交付設(shè)計(jì)文件時(shí)間順延；發(fā)包人交付上述資料及文件超過(guò)規(guī)定期限15天以上時(shí)，設(shè)計(jì)人有權(quán)重新確定提交設(shè)計(jì)文件的時(shí)間。Article 9 Responsibilities of the Parties Responsibilities of the Employer The Employer shall submit to Designer basic materials and documents withinspecified period as provided in Article 5 of this contract and shall be responsible

17、 for the completeness, accuracy and time limit of the materials and documents. The Employer shall not require the Designer to conduct design in violation of relevant national standards. In case there is a delay of less than 15 days exceeding the specified time limit for the delivery of the above mat

18、erials and documents by the Employer, the time limit for the Designer to deliver design documents shall be extended accordingly; in case there is a delay of more than 15 days exceeding the specified time limit for the delivery of the above materials and documents by the Employer, the Designer shall

19、have the right to re-determine the time for delivery of the design documents.發(fā)包人變更委托設(shè)計(jì)項(xiàng)目、規(guī)模、條件或因提交的資料錯(cuò)誤，或所提交資料作較大修改，以致造成設(shè)計(jì)人設(shè)計(jì)返工時(shí)，雙方除另行協(xié)商簽訂補(bǔ)充協(xié)議（或另訂合同）、重新明確有關(guān)條款外，發(fā)包人應(yīng)按設(shè)計(jì)人所耗工作量向設(shè)計(jì)人支付返工費(fèi)。在未簽訂合同前發(fā)包人已同意，設(shè)計(jì)人為發(fā)包人所做的各項(xiàng)設(shè)計(jì)工作，發(fā)包人應(yīng)支付相應(yīng)設(shè)計(jì)費(fèi)。 In case of the Designers rework on the design resulted for changes of the

20、 engineering, size and conditions of the design by the Employer or mistakes of the materials submitted or major revision on the submitted materials, the Parties shall conclude supplementary agreement separately (or conclude additional agreement) and redefine relevant terms and conditions, and the Em

21、ployer should pay charges for rework to the Designer according to the workload.The Employer has agreed before the conclusion of the contract that it will pay charges of design to the Designer for all the design works conducted by the Designer.在合同履行期間，發(fā)包人要求終止或解除合同，設(shè)計(jì)人未開(kāi)始設(shè)計(jì)工作的，不退還發(fā)包人已付的定金；已開(kāi)始設(shè)計(jì)工作的，發(fā)包人

22、應(yīng)根據(jù)設(shè)計(jì)人已進(jìn)行的實(shí)際工作量，不足一半時(shí)，按該階段設(shè)計(jì)費(fèi)的一半支付；超過(guò)一半時(shí)，按該階段設(shè)計(jì)費(fèi)的全部支付。 During the performance of the contract, if the Employer requires to terminate or cancel the contract before the Designer starts the design work, the Designer will not return the down payment already paid by the Employer; if the Designer has star

23、ted the design work, the Employer shall pay for the actual workload already done by the Designer. When the actual workload of the design is less than half of the work at the stage, the Employer shall pay half of the payment for the design work at the stage. When the actual workload of the design is

24、more than half of the work at the stage, the Employer shall pay all the payment for the design work at the stage.發(fā)包人必須按合同規(guī)定支付定金，收到定金作為設(shè)計(jì)人設(shè)計(jì)開(kāi)工的標(biāo)志。未收到定金，設(shè)計(jì)人有權(quán)推遲設(shè)計(jì)工作的開(kāi)工時(shí)問(wèn)，且交付文件的時(shí)間順延。 The Employer should pay down payment as provided by the contract and receipt of down payment will be the symbol for the

25、commencement of the design work by the Designer. The Designer shall have the right to put off the commencement date of the design work if it has not received the down payment and the time for delivery shall be extended accordingly.發(fā)包人應(yīng)按本合同規(guī)定的金額和日期向設(shè)計(jì)人支付設(shè)計(jì)費(fèi)，每逾期支付一天，應(yīng)承擔(dān)應(yīng)支付金額千分之二的逾期違約金，且設(shè)計(jì)人提交設(shè)計(jì)文件的時(shí)間順延。

26、逾期超過(guò)30天以上時(shí)，設(shè)計(jì)人有權(quán)暫停履行下階段工作，并書面通知發(fā)包人。發(fā)包人的上級(jí)或設(shè)計(jì)審批部門對(duì)設(shè)計(jì)文件不審批或本合同項(xiàng)目停緩建，發(fā)包人均應(yīng)支付應(yīng)付的設(shè)計(jì)費(fèi)。 The Employer should pay charges for design to the Designer at the amount and date provided in this Contract. For each day of overdue payment, 2 of the overdue payment shall be paid as damages for overdue payment and the

27、 time for delivery by the Designer shall be extended accordingly. Where the delay of payment has exceeded 30 days, the Designer shall have the right to suspend the performance of the work at the next stage and give written notice to the Employer. In case the higher authority or competent department

28、of design approval would not approve the design documents or the engineering construction of this contract is suspended or stopped, the Employer should pay the payable charges for design.發(fā)包人要求設(shè)計(jì)人比合同規(guī)定時(shí)間提前交付設(shè)計(jì)文件時(shí)，須征得設(shè)計(jì)人同意，不得嚴(yán)重背離合理設(shè)計(jì)周期，且發(fā)包人應(yīng)支付趕工費(fèi)。發(fā)包人應(yīng)為設(shè)計(jì)人派駐現(xiàn)場(chǎng)的工作人員提供工作、生活及交通等方面的便利條件及必要的勞動(dòng)保護(hù)裝備。設(shè)計(jì)文件中選用的國(guó)

29、家標(biāo)準(zhǔn)圖、部標(biāo)準(zhǔn)圖及地方標(biāo)準(zhǔn)圖由發(fā)包人負(fù)責(zé)解決。 If the Employer require the Designer to delivery the design documents in advance, it should get the prior consent of the Designer without serious deviation from the reasonable design circle, and the Employer shall pay the crush cost. The Employer should offer conveniences in

30、 aspects of working, living and traffic and necessary labor-protection equipments.
